DEED OF DEDICATION
THIS DEED OF DEDICATION is made this —day of December, 2020, by and between
UNIVERSITY OF VIRGINIA FOUNDATION, a Virginia non -stock corporation ("Grantor"),
and the COUNTY OF ALBEMARLE,VIRGINIA, a political subdivision of the Commonwealth
of Virginia ("Grantee").
WITNESSETH:
WHEREAS, the Grantor is the owner in fee simple of the real property located in
Albemarle County that is described below and hereinafter referred to as the "Property"; and
WHEREAS, the Grantor offers to grant, convey, and dedicate the Property to the County
in fee simple for public use; and
WHEREAS, the Grantee is willing to accept the Grantor's offer of dedication.
NOW, THEREFORE, in consideration of the mutual premises, the Grantor hereby
GRANTS, CONVEYS, and DEDICATES for public use to the Grantee, its successors and assigns,
with GENERAL WARRANTY AND ENGLISH COVENANTS OF TITLE, the following
described real property:
All that certain tract or parcel of land, with all improvements thereon and all
appurtenances thereunto belonging, containing 2.625 acres, more or less, as more
particularly shown and described as "2.625 Ac. (Adjusted) to be Dedicated as
'Special Lot' (for Public Use)" on that certain plat made by Timmons Group, dated
November 2, 2020, last revised December 3, 2020, consisting of 2 pages, entitled
"PLAT SHOWING BOUNDARY LINE ADJUSTMENT & LAND TO BE
DEDICATED AS A SPECIAL LOT ON THE PROPERTY OF AND FROM
UNIVERSITY OF VIRGINIA FOUNDATION TAX MAP PARCELS 32-18B &
202100002468.003
32-6R RIO MAGISTERIAL DISTRICT ALBEMARLE COUNTY, VIRGINIA,"
which plat is attached hereto and incorporated by this reference; and being a portion
of the property acquired by University of Virginia Foundation as recited in that
certain deed of confirmation recorded in the Office of the Clerk of the Circuit Court
of Albemarle County, Virginia, in Deed Book 2712, page 325.
This conveyance is made subject to all easements, reservations, restrictions, and conditions
contained in duly recorded deeds, plats, and other instruments constituting constructive notice in
the chain of title to the Property which have not expired by a time limitation contained therein or
have not otherwise become ineffective.
The Grantee, acting by and through its County Executive, duly authorized by resolution
adopted by the Board of Supervisors of the County of Albemarle, Virginia, accepts the conveyance
of the Property pursuant to Virginia Code § 15.2-1803, as evidenced by the County Executive's
signature hereto and the recordation of this Deed.
