July 16, 2022 County of Albemarle I Community Development Department Planning Services RE: COMMENT RESPONSE to 1st Review, SUB2022-00094,0Id Trail Block 1, Lots 1-2 : BLA Plat TO: Mr. Andy Reitelbach, Senior Planner II C: Ms. Emily Cox, PE Mr. Jeremy Fox Please find below our responses to review of the plat referenced above (Old Trail Block 1, Lots 1-2 / BLA Plat); we appreciate your comments and review. Included (below) are comments provided by Albemarle County with responses (in red), accordingly: 1. [14-302(A)4] On the approved site plan for this property (SDP2019-00020), there appears to be a "variable width sidewalk and landscape maintenance easement" (recorded at D65421, page 720)for the area along Old Trail Drive. This reference appears to be slightly different from what is labeled on this BLA plat. Ensure the correct legal instrument is referenced. Noted, addressed. The easement previously labeled as 'Ex. Var. Width Sidewalk & Landscape Maintenance Easement DB. 5420, Pg. 719 has been corrected to read 'Ex. Var. Width Sidewalk & Maintenance Easement' which is recorded in DB. 3546, PG. 449 (and now labeled as such). There is an additional easement previously not depicted but now shown hereon as 'Ex. Var. Width Sidewalk & Landscape Maintenance Easement' which is of record in DB. 5421, PG. 718. This easement does not carry a description or courses (of record) but is implied to lie in specified areas between the existing sidewalk and maintenance easement extending back to the completed building footprint; therefore this isplot shown (as approximate) and Survey Note 12 is now added to explain the perceived intent of this easement. This recorded easement appears to have expanded the area subject to the sidewalk and landscape maintenance easement. Depict this expanded area. Yes, noted, and please see above. 2. [14-302(A)10] Note #10 about development rights should be removed from the plat. Properties zoned NMD are not subject to development rights requirements. (They apply only to properties zoned RA.) Addressed, original Survey note 10 is now removed as originally written and subsequent notes are now renumbered accordingly. 3. [ 14-302(B)1 ] Provide the date of last revision of the plat on all future submittals. Addressed, please note bottom left title block 'last revised' date and seal date update. 4.[14-302(B)S] Include the zoning overlay district that applies to these parcels: Entrance Corridor. Addressed. Please see zoning overlay district added for each parcel in Survey Note 1 and restated in new Survey Note 11.
