The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-309, 14-310, 14-416] Soil evaluations. Soil reports per 14-309 are needed from the applicant for
review/approval by the Virginia Department of Health (VDH). Health Director approval of individual private wells
and onsite sewage systems are needed prior to final plat approval by the County. Rev. 1: Soils reports for
review/approval by VDH is needed prior to final plat approval. Please submit when ready.
2. [14-308.1, 14-203] Groundwater assessment. A Tier 2 Groundwater assessment is needed for this subdivision per
17-1000 and 17-1002 of the zoning ordinance. This evaluation is run by the County. Please submit the required
fee provided in Sec. 14-203 ($391.00 + 4% Technology surcharge = $406.64) via the online County payment
system and provide a receipt of payment to the Planning reviewer (Mariah Gleason). Rev. 1: A Tier 2 Groundwater
assessment analysis and fee is needed prior to final plat approval. Please submit when ready.
3. [14-400, 14-4031 Lot frontage. The proposed "private access easement' will need to be designated as a "New 30ft
Private Road" instead for Lot C-1 to meet minimum frontage requirements for Rural Area parcels. Please revise the
plat map and Note 6 (to change access easement to private road) accordingly. Rev. 1: Comment addressed.
4. [14-302(B)(10)] Stream buffers. Albemarle County GIS indicates that stream buffers are present on the subject
property. Revise the plat to locate existing stream buffers on the site map provided at the top of Sheet 2. Also,
provide the following note on the plat: "The stream buffers shown hereon shall be managed in accordance with the
Albemarle County Water Protection Ordinance." Rev. 1: Comment not addressed. The note, in particular, must be
added to the plat.
5. [14-302(A)(10)] Development Rights. The subdivision plat that created Lot C assigned only one development right
to the property. The parcel therefore only has one development right to assign to either Lot C or Lot C-1. Based on
the proposed plat the residue of Lot C, being 22.67 acres in size, can be created in accordance with the 21-acre
rule (see Sec. 10.3). This rule stipulates that each lot less than 21 acres in size have a development right. Therefore,
the one development right available to the property must be assigned to Lot C-1, which is 2.00 acres in size. As
such, please revise Note 8 on the plat to state the following: "The Residue of Lot C has no development rights and
may not be further divided. Lot C-1 is assigned one development right and may not be further divided." Rev. 1:
Comment addressed.
6. [14-302(A)(4-5)(15), 14-303(Q] Easements. According to a previous plat for this property, the subject parcel
may/may not be subject to an easement to Appalachian Electric Power Company DB 273-459. If it is subject,
please provide a note on the plat. Rev. 1: Comment dismissed.
7. [14-302(B)(7)] Reservoir watershed. Provide a note on the plat as to whether the subject property is within an
Albemarle County and/or City of Charlottesville water supply watershed. (Note: The subject property does not lie
within a water supply watershed of Albemarle County and/or City of Charlottesville.) Rev. 1: Comment addressed.
8. [14-303(N)] Private street. Due to a recent amendment to the subdivision ordinance, please replace Note 7 with
the following statement: "Unless specifically denoted as public, the streets and other required improvements in this
subdivision are private in nature and will not be maintained by either the Virginia Department of Transportation or
any other public agency. The maintenance thereof is the mutual obligation of the affected lot owners. Failure to
maintain the improvements in substantially the same condition as originally approved by the County may
constitute a violation of County ordinance(s)." Rev. 1: Comment addressed.
9. [14-301(B)] Scale. A scale is needed on Sheet 2. Rev. 1: Comment addressed.
10. [14-316] Please see the attached approval letter from the Virginia Department of Transportation (VDOT).
11. [Comment] Reminder that revised plats must include the original date of drawing and the revision dates) of each
subsequent version of the plat.
In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to
address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have
been voluntarily withdrawn by the applicant.
