On July 20, 2022, the Board of Supervisors took action on your Special Exception on Tax Map Number 05800-00-00-
065C0 in the Samuel Miller District.
The Special Exception was approved by the Board's adoption of the attached Resolution and Conditions.
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no
uses on the property as approved above may lawfully begin until all applicable approvals have been received and
conditions have been met. This includes:
• compliance with the approved SPECIAL EXCEPTION; and
• approval of a ZONING CLEARANCE.

RESOLUTION TO APPROVE SE2022-00025
1213 TILMAN ROAD COTTAGE HOMESTAY
WHEREAS, upon consideration of the Memorandum prepared in conjunction with the SE2022-
00025 1213 Tilman Road Cottage Homestay Application and the attachments thereto, including staffs
supporting analysis, any comments received, and all of the factors relevant to the special exceptions in
Albemarle County Code §§ 18-5.1.48 and 18-33.9, the Albemarle County Board of Supervisors hereby finds
that that a modified regulation would satisfy the purposes of the Zoning Ordinance to at least an equivalent
degree as the applicable requirement, and that the proposed special exception:
(i) would not cause adverse impacts to the surrounding neighborhood;
(ii) would not cause adverse impacts to the public health, safety, or welfare;
(iii) would be consistent with the Comprehensive Plan and any applicable master or small -area
plan(s); and
(iv) would be consistent in size and scale with the surrounding neighborhood.
NOW, THEREFORE, BE IT RESOLVED, that in association with the 1213 Tilman Road Cottage
Homestay, the Albemarle County Board of Supervisors hereby approves the special exception to reduce the
required setbacks for a homestay use, subject to the conditions attached hereto.

duly adopted by the Board of Supervisors of Albemarle County, Virginia, by a vote of six to zero, as
recorded below, at a regular meeting held on July 20, 2022.

SE2022-00025 1213 Tilman Road Cottage Homestay Conditions
1. Parking for homestay guests must meet the requirements for homestays as outlined in
County Code § 18-5.1.48(b) (Attachment C).
Homestay use is -limited to the existing structure as currently configured and depicted on
the I -louse and Parking Exhibit dated June 28, 2022, or to additional structures or
additions meeting the setbacks required for homestays.
