The declaration I prepared for Phase 5A and which you returned is compiled from other Belvedere supplemental
declarations I have drafted over the past 2-3 years for other phases, and each of these contained different tailored
provisions. For your reference, I am attaching three other supplemental declarations we have recently recorded
because when I run track changes it does not make sense given that paragraphs are borrowed from more than one
declaration. For example, Phase 116 had Residential (detached) lots only and some private alleys for which the County
wanted to assure maintenance was handled by the HOA, whereas Phase IVA-1 had Townhouse lots only, and finally
Phase IVA-2 had Residential, Townhouse lots and alleys. Only Townhouse Lots have provisions for lots being maintained

by the HOA. All three of these were submitted to County Planner Paty Saternye, and presumably came to you at some
point.
With respect to Phase 5A, new language is added relating to the large retaining walls and their maintenance and private
water laterals for two lots. Paragraph 12 is also new and is intended to give the Architectural Review Committee the
right to modify guidelines in this area which is not subject to the NMD district architectural standards.

They can record the covenants with the SUB202100096 final plat, they'll just need to revise the language in the

I think that Garrett Smith makes a valid point below. I think that recordation of covenants with their
corresponding subdivision plats is probably fairly standard practice.
More importantly, I don't see County Code § 14-302(A)(14) as requiring plats to state the instrument
numbers of the recorded HOA covenants. Even if it did, perhaps the way to address this would for a plat note to
state that the HOA covenants are "recorded herewith" (just as the covenants state that the plat is "recorded
herewith").

I think that Garrett Smith makes a valid point below. I think that recordation of covenants with their
corresponding subdivision plats is probably fairly standard practice.
More importantly, I don't see County Code § 14-302(014) as requiring plats to state the instrument
numbers of the recorded HOA covenants. Even if it did, perhaps the way to address this would for a plat note to
state that the HOA covenants are "recorded herewith" (just as the covenants state that the plat is "recorded
herewith").
Hope that makes sense. Let me know if I'm mussing something. Thanks.

Andy: Thanks for approving our Belvedere 5A Supp. Declaration which is attached.
Comment 4(a) of the First Review Comments concerning the Belvedere 5A subdivision plat (which is under review), has
put us in a confusing cart -before -the -horse problem. As Cameron suggests, the Belvedere 5A easement plat was
recorded, and the Supp. Declaration of Covenants and Restrictions for Belvedere 5A are approved by you. However,
they have not been recorded, and I don't believe they should be until the subdivision plat is approved. Since paragraphs
1 and 2 of the 5A Supp. Declaration identify lots by number and type, it really doesn't make sense to me to record the
Declaration except with the subdivision plat attached. That's the approach we have been using consistently. Of course

we can't attach the plat if it isn't approved. And it won't get approved because it's waiting for a recording citation for
something that should be recorded with it!
As an attorney, I believe I need to make this technical point through you rather than your client, and hope you can
consider this and let Cameron know that comment 4(a) should not be legally necessary if we plan to record the
covenants with the plat.
I'm sorry to trouble you with this detail, but appreciate your attention and any help you can provide getting the
Belvedere 5A subdivision plat review moving again. This issue has it stalled.

Apologies as I was pulled away from addressing your request as it pertains to the supplemental declaration of covenants
and restrictions for 5A.
The declaration I prepared for Phase 5A and which you returned is compiled from other Belvedere supplemental
declarations I have drafted over the past 2-3 years for other phases, and each of these contained different tailored
provisions. For your reference, I am attaching three other supplemental declarations we have recently recorded
because when I run track changes it does not make sense given that paragraphs are borrowed from more than one
declaration. For example, Phase IIB had Residential (detached) lots only and some private alleys for which the County
wanted to assure maintenance was handled by the HOA, whereas Phase IVA-1 had Townhouse lots only, and finally

There are no further revisions for this sight distance deed of easement In addition, I had no comments
on the proposed Supplemental Declaration for Phase 5A. As I noted on January 27, this Declaration appears

I know they had drafted one before for the public drainage and SWIM easements (attached). I'm guessing just the
formatting needs to change a little? Do you have an idea of when we should expect the deeds?

The County Attorney has advised us that County staff need to prepare the deeds of easement for public drainage and
SWM easements. My colleagues in Engineering are working right now to draft the deeds. Once they are prepared, we
will send them to you. I've CC'd David and Frank in case you have any questions related to the deeds that are being
drafted.

email. I'm not sure what happened — it might've gone to my spam box for some reason. I apologize for this and I have
transmitted these revised documents to Engineering and the County Attorney for review. I will expedite this review and
try to verify that everything has been addressed by the end of the next week. Once I confirm with the others, I will send
