The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
[32.6.2(i)] The five (5) shared parking spaces as shown on page 2 of the plat are not shown on an approved
site plan. We cannot approve a shared parking easement plat showing the location of parking spaces that do
not meet ordinance requirements and are not shown on an existing approved plan. However, the approved site
plan for the Halifax House property, SDP198500003, does show seven (7) available parking spaces adjacent
to the existing building at 3447. Staff recommends revising the plat to show the spaces to be shared will be
the existing spaces which were approved and shown on SDP198500003.
a. Once the Halifax House site plan is approved, the shared parking easement plat can then be amended
to show shared parking spaces in the area as shown on the plat. If the plan is to open the DS Tavern
before the Halifax House site improvements have been made, the shared parking spaces are going to
need to be the ones that officially exist as shown on that approved plan.
2. [14-301] When resubmitting the Plat, please submit the Plat as a separate resubmittal document. The initial
submission of this applications combined the plat and the application into one document.
a. Digital resubmission can be made online here.
3. [14-302(A)(4)] Ensure the private parking access easement covers the parking spaces in addition to the access
aisle. Label and quantify the number of shared parking spaces. If amending the plat as recommended in
Comment #1 above, please extend the private parking access easement down the length of the existing access
aisle and enure to cover the spaces to be shared.
4. [14-303(1)] Include the following note: Unless specifically denoted as public, the streets and other required
improvements in this subdivision are private in nature and will not be maintained by either the Virginia
Department of Transportation or any other public agency. The maintenance thereof is the mutual obligation
of the affected lot owners. Failure to maintain the improvements in substantially the same condition as
originally approved by the County may constitute a violation of County ordinance(s).
5. Please include a date of revision.
6. [14-302(A)(4) and 4.12.81 Submit a revised shared parking agreement. The County Attorney's office has
provided an example (attached). Please be more specific in the agreement when referring to the parking spaces
and quantify them. The agreement does not need to include any language about maintenance.

1. The former County Code § 14-317, which used to require County review and approval of private
improvement maintenance agreements, was repealed on February 16. Therefore, I no longer need to
review those agreements.
2. HOWEVER in its place, County Code § 14-303(N) now requires the following statement on
subdivision plats contain one or more private improvements (as defined in section 14-106): "Unless
specifically denoted as public, the streets and other required improvements in this subdivision are
private in nature and will not be maintained by either the Virginia Department of Transportation or any
other public agency. The maintenance thereof is the mutual obligation of the affected lot owners. Failure
to maintain the improvements in substantially the same condition as originally approved by the County
may constitute a violation of County ordinance(s)." Though I didn't see that note on the Halifax House
plat, it should be added.
3. The plat alone is not sufficient for a shared parking agreement. See the attached sample
agreement. Note especially that the number of required spaces must be specified.
