On May 15, 1984, the A.C.P.C. approved the Paul Grady
Preliminary Plat, including a waiver of frontage, and
a waiver of the right-of-way reservation requirement.
This plat combined 1.0 acres of Parcel 15 with 2.02
acres of Parcel 15A (1740 House Antique Shop proper-
ty) . The final plat was administratively approved
on June 28, 1984 (Attachments #8 and 9).
On February 6, 1985, the Albemarle County Board of
Supervisors approved the proffered ZMA 84-26 Clarence
and Mary Elder. This rezoned the 1.0 acre (on which
the additional antique shop building is proposed)
from RA, Rural Areas, to C-1, Commercial.
TOPOGRAPHY OF AREA: The land rises from the stream along the
frontage at Route 250, to a plateau. The
proposed building site is on the plateau,
and the land rises sharply behind it.
CONDITION OF ROADS SERVING PROPOSAL: This segment of Route 250
West carries 8,420 vehicle
trips per day.
WATERSHED IMPOUNDMENT: This site is within the South Fork
Rivanna River Watershed; Ivy Creek Sub
Watershed; and Upper Ivy Creek Basin.
SOILS: No comment.
COMPREHENSIVE PLAN RECOMMENDATION: This site is Rural Area III.

At its meeting on February 6 , 1985, the Board of Super-
visors took the following actions :
Agenda Item No. 5. ZMA-84-26 . Clarence and Mary Ann
Elder. Request to rezone 1. 0 acre from RA, Rural Areas, to
C-1 Commercial. Property described as Tax Map 59 , Parcel 15A
(part) , is located on the south side of Route 250 West approx-
imately 1500 feet past the intersection of Routes 250 and 677 .
Samuel Miller Magisterial District. A proffer dated January
28 , 1985, addressed to Ronald S. Keeler was filed with this
office on February 5, 1985. The proffer, signed by Mr. R.
Lecky Stone, Jr. , attorney for the applicants , was presented
to the Board and was amended at the February 6 , 1985 meeting,
at whicn time Mr. Stone verbally agreed to the changes . The
request was APPROVED with the amended proffer:
"The owners proffer that their request be approved on
condition that:
1. The rezoning be limited to expansion consistent
with the existing commercial use of the 1740

2 . The owners be required to file a site plan for

located on the south side of Route 250 West about 1500 feet

CHARACTER OF AREA:
The property subject to this petition was purchased earlier this
year and combined with the existing 1740 House Antique Shop property
(2.02 acres of which 1.10 acres is zoned C-1, Commercial and 0.92
acres is zoned RA, Rural Areas) . The 1740 House Antique Shop has
recently been placed on the National Register of Historic Places
and the Virginia Historic Landmark Register. Variance from the
Scenic Highway setback was granted earlier this year to permit ex-
pansion of the existing building (see attached report) . An out-
building (smokehouse) has been recently located on the acre subject
to this petition. The only other commercial property in the area
is adjacent to the west (i.e. , vacant Peking Tea House) .
STAFF COMMENT:
During consideration of the 1980 zoning map, both the Peking Tea
House and 1740 House Antique Shop were recognized with C-1, Commercial
since both properties were zoned commercially (under prior zoning)
and in commercial usage. Commercial zoning in this area is not
consistent with the Comprehensive Plan. An added concern is that
this property is within the South Fork Rivanna River watershed.
Staff offers the following comment:
1) The request is to expand zoning which is inconsistent with
the Comprehensive Plan. Since the existing use was recognized
with appropriate zoning on the 1980 zoning map, staff opinion
is that limited expansion is not an unreasonable request;/pro-
vided that future development is clearly established and that
rezoning is limited to expansion of existing usage.
2) Staff can find no record of site plan approval for the existing
1740 House Antique Shop. Should rezoning be approved, site plan
approval for both existing and expanded usage should be required
(see Virginia Department of Highways and Transportation letters
of December 14 & 20, 1984) .

The following are our comments:
la. Willoughby Section Four Preliminary Plat, Route 631 S. : The
Department recommends that this preliminary plat not be approved until
the revised ZMA is approved. This preliminary plat appears to be in line
with the revised ZMA. There are still some questions concerning the
pavement design of Harris Road that is already constructed in the County.
The Department reconrends against the use of a roll curb in this develop-

State maintained road. There is an existing opening in the curbing for
a street entrance that does not appear on this plan, and this opening
should be closed off with curbing to match the existing roadway section.

Dear Ms. McCulley:
The Department addressed comments on the referenced site plan in
a letter dated February 7, 1985. Should this site be a new development
the Department would require that the entrances meet the Department's
minimum standards for commercial sites. Since the entrances to this
site are existing, the Department's recourse for upgrading them would
require legal action should the County not require the entrances to
be improved as a part of the rezoning and site plan for this develop-
ment. The Department recommends that the entrances be upgraded to
meet commercial standards since the usage of this site is commercial.
i(To reduce the hardship of improving the entrances, the Department
recommends that the western entrance be closed and the eastern entrance
upgraded to the Department's minimum commercial standards A) To widen
the western entrances would require removal of one or two large trees.
Therefore, the Department feels that upgrading the eastern entrances
would have less impact on the site and still provide adequate access to
the site. The Department also recommends that a turn lane be built
across the frontage of the property to the eastern entrance with CG-2
curbing. The CG-2 curbing would reduce the amount of land needed to
properly construct the turn lane. It was also observed that a fence
is on the highway right of way and this needs to be removed. tag

The CATS shows an ultimate right of way width of 1201' and currently
80' exists, therefore, an additional 20' of right of way would be neces—
sary on each side of the road for the ultimate construction. With the
railroad to the north of Route 250 and this site understood to be an
historical landmark to the south of Route 250, it may be difficult to
obtain the ultimate 120' of right of way. Also, this section of Route
250 is designated as a scenic highway. Until the CATS is revised this
is the only information the Department has available on the ultimate
right of way width.

The Albemarle County Planning Commission, at its meeting on May 15, 1984, approved
the above-noted preliminary plat, including a waiver of frontage and a waiver of
the right-of-way reservation requirement, subject to the following condition:
1. The final plat will not be signed until the following condition has been met:
a. Staff approval of technical requirements including 100' septic setback and
150' scenic highway setback.
The Planning Commission also granted administrative approval of the final plat.
Please be advised that preliminary plat approval is valid for six (6) months, or
until November 15, 1984. Failure to submit a final plat to the Planning Department
