Revised comments are provided below, organized by Department, Division, or agency. Our comments are provided below. Comments are organized as follows: A. Comments on the Special Use Permit B. How the proposal relates to the Comprehensive Plan C. Additional comments from reviewers D. Additional information A. Special Use Permit 1. General a. Revise the special use permit application information to clarify the proposal and included attachments. Include labels on all documents including the application narrative, conceptual plan, and the floor plan. Bundle all documents together in one neat resubmission. The previous special use permit application documents SP201200008 provide an example of how these documents can be bundled together. See "legacy document 2012-08-30." Comment addressed. b. Staff recommends titling the application materials with the application number "SP202200003 Daylily Preschool." Please also title the conceptual plan with the application number and a date of revision. Comments addressed. 2. Use. a. Please revise and clarify all use information provided in the application narrative. Ensure the maximum number of children, teachers, hours of operation, and any additional information provided is correctly reflected in the application narrative. Comments addressed. The final application narrative is dated August 1, 2022. b. Based on Virginia Department of Health comments below, a drainfield assessment by a licensed professional is needed to ensure the existing well and septic can support the proposed preschool use at the new location. VDH staff also recommends that the applicant contact the Office of Drinking Water (ODW) to determine whether the water supply can be regulated as a community waterworks. Comments addressed. See VDH comment's attached. 3. Conceptual Plan. a. Staff recommends a more informative conceptual plan that better shows: property lines, building footprints, parking lot locations, teacher parking areas, playground areas, ingress and egress, and any proposed signage. Comment addressed. b. Staff recommends providing signage to ensure no parents enter the driveway on the property of 4297 Old Three Notch'd Rd (the proposed school building) and signage to ensure proper ingress and egress when dropping students off, leaving the site, and picking students up and leaving the site. Staff recommends adding a "parent pick-up and drop-off parking area" sign to the parking area. c. Engineering staff recommends physical pavement markings on site as well as appropriate signage. Comment addressed. d. Staff can assist with providing better maps, aerial maps, providing labels, etc. Please reach out if you need assistance. B. Comprehensive Plan Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The Rural Area Chapter (Chapter 7) of the Comprehensive Plan designates the subject properties for this proposal, TMP 57-29A and TMP 57-26, for Rural Area land uses. The intent of the Rural Area designation is to allow uses that preserve and protect agricultural, forestal, open space, and natural, historic, and scenic resources; and also to allow residential uses at a density of up to 0.5 acres per dwelling unit. Review of the proposal against specific objectives (obj.) in Comprehensive Plan found the following: • Obi. 5: Recognize and summort crossroads communities_ which serve as rural -scale communitv meetine places and provide opportunities for residents to take part in community life. While not specifically being in an identified crossroads community as outlined in the Comprehensive Plan, the proposed use along with the existing church contributes to providing a crossroads community -like area providing essential goods and services for the existing community in the area. • The proposed preschool will provide a needed service to the area while being located within an existing building on site and being at a scale that is appropriate for the area that does not require additional infrastructure. C. Additional Comments from Reviewers Planning Comments The following advisory comments related to planning matters are provided by Kevin McCollum, kmccollum@albemarle.org: 1. Should the special use permit be approved, the new use cannot commence without the appropriate building permits and zoning clearances. 2. Staff recommends several conditions below. Transportation Planning Comments Comments from Planning reviewer Kevin McDermott, kmcdermott&albemarle.org are below. 5/3/2022 1. Please provide additional detail on the pick-up and drop-off operation. A clear aerial that shows the extents of the parking/travelways, where teacher/staff parking is located, and the manner and placement of the car line is needed to ensure that there will not be impacts to the public roadway. 2. The Narrative says that parents will park and escort the children to the school building, but the Application Plan says that teachers will escort the students from the parking lot to the school building. Please clarify. 3. How many teachers/staff will the school have? Where will they park? 4. Assuming some families will have more than one child at the school, at 55 students it will likely be approximately 40 cars doing drop off in the morning. Please show that a car line can accommodate an appropriate length without blocking traffic on the public roads. 5. The current parking area is poorly defined with long areas of open access to the public roadway. This can cause confusion for drivers not knowing where it is appropriate to turn in to the lot or how to park. Staff recommends efforts to better define the parking area and access ways to reduce the confusion and improve safety and operations. Additional work to close the long areas of open access are recommended. 6. Does the church have any activities that conflict with school hours? This could be problematic especially at drop- off and pick-up times. 8/1/2022 1. No objection. Zoning The Zoning reviewer, Francis MacCall, flnaccall&albemarle.org, has provided no objection. Zoning staff will assist with drafting potential SP conditions. Engineering Comments from the Deputy County Engineer, Emily Cox, ecox2 =.albemarle.org are below: 4/10/2022 1. Pavement markings delineating parking spaces and providing directional signage should be provided. 8/3/2022 1. No objection Building Inspections The Building Inspections reviewer, Betty Slough, bslough@albemarle.org has no objections to this proposal. Fire/Rescue The Fire/Rescue reviewer, Howard Lagomarsino, hlagomarsino@albemarle.org has no objections to this proposal but offers the following information to consider. 1. Fire and emergency vehicle access to the structure to be used as the pre-school. 2. Establish an emergency preparedness plan. 3. The proposal has the potential of classification as a change of use for the structure to be used as the pre-school a. The building official has purview over any building renovations and requirements related to the change of use, ensure any issues identified by the building official related to fire, emergencies and safety are addressed (examples - adequate means of egress; need for fire alarms or fire protection systems due to change of use) Natural Resources Natural Resources Manager, Kimberly Biasiolli, kbiasiolli@albemarle.org, has no objection. Virginia Department of Health (VDH) Comments from the VDH reviewer, Alan Mazurowski, alan.mazurowski(2vdh.vir ig nia.gov, are provided below: 4/8/2022 1. As requested, I've reviewed the subject application, dated 2/2/2022, for a proposed 55 student daycare facility. This property appears to be served by onsite well and septic system, however I can find no records. I recommend the applicant provide a drainfield assessment by a licensed professional engineer to determine whether there is capacity for the proposed use. I also recommend that the applicant contact the Office of Drinking Water (ODW) to determine whether the water supply can be regulated as a community waterworks. 8/18/2022 As requested, I've reviewed the subject application, dated 7/12/2022, for a proposed 35 student daycare facility. The included PE assessment of the existing septic system reports that it should be adequate for up to 50 students & 4 staff, and the report from the Office of Drinking Water (ODW) states that the existing water system will be permitted by their office as a Waterworks. Therefore, I have no concerns and recommend approval. Albemarle County Service Authority (ACSA Comments from the ACSA reviewer, Richard Nelson, melson@serviceauthority.org, has no comments or objections to this proposal. SP202200003 Daylily Preschool is outside of the ACSA Jurisdictional Area. Virginia Department of Transportation (VDOT) VDOT reviewer John Wilson, john.c.wilson@vdot.vir ie nia.gov, has provided no objection to this proposal. Rivanna Water and Sewer Authority (RWSA) RWSA reviewer Dyon Vega, dvega@xivanna.org has provided no objections to this proposal. Additional Information SP Conditions Summary of potential proposed conditions: 1. Development of the use shall be in general accord with the conceptual plan dated 7/18/2022. To be in general accord with the Conceptual Plan, development shall reflect the following major elements within the development essential to the design of the development. a. Location of buildings and preschool b. Location of parking areas. c. Relation of buildings and parking to the street. d. Location of the "Do Not Enter" sign at the entrance of proposed preschool driveway as shown on the concept plan and a "Parent Pick -Up and Drop -Off Parking Area" sign near the area designated as "parent parking" on the concept plan. Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance. 2. Parking spaces shall remain delineated as shown on page 4 and 5 of the resubmittal documents dated 7/18/2022. 3. The maximum enrollment shall not exceed thirty-five (35) children/students. 4. The hours of operation for the preschool shall be limited to 8:30am-5:30pm Monday through Friday.
