Subject: SDP2022-00047 — Victorian Heights — Final Site Plan
The Planner for the Planning Services Division of the Albemarle County Department of Community
Development will recommend approval of the plan referred to above when the following items have been
satisfactorily addressed. (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.)
Comments — First Review of Victorian Heights — Final Site Plan (SDP2022-00047):
1. [32.5.2(a)] The application number for this project is SDP2022-00047. Revise the cover sheet to
include this number.
2. [30.2.61 This development will require review by the Planning Commission to determine
anticipated impacts of the cluster development and bonus density provisions and regulations on
the Airport Impact Area overlay district. Provide a narrative justifying why this proposed
development will not have a negative impact on the AIA requirements.
3. [2.2] The calculations for open space and the bonus density appear to be incorrect. For more
information, see comments from Zoning (near the end of this memo) regarding the calculation of
the bonus density provisions and the open space requirements.
4. [4.19] The setback note will need to be updated if the Board of Supervisors approves the special
exception request for modifying the setback regulations.
5. [4.19] The five-foot side setback on Lot 18 does not appear to be met. The building is
encroaching within that setback.
6. [32.5.2(a)] As a condo community, the requirements of Sec. 18-4.5 will need to be met.
7. [4.12.16] Widen the parallel parking spaces. They must be at least nine feet in width.
8. [32.5.2(a)] Provide the percentage amounts for the impervious areas and the paved circulation
areas.
9. [32.5.2(a)] Revise the building sites note on the cover sheet. There are more lots than what is
stated in that note.
10. [32.5.2(a)] There should be at least 36 building lots, as opposed to the 35 identified in the table
on the plan layout sheet. Building 1 will be on a different parcel from Buildings 2 and 3 because

of the open space area separating them. Or it intended that these buildings and the open space will
all be on the same parcel?
11. [4.16] Provide a substitution waiver request for the recreational facilities, as there is a note on the
cover sheet indicating one would be provided. However, one was not submitted with this
application. Staff cannot fully analyze the recreational facilities without knowing what is
proposed to be provided. The facilities as currently proposed do not meet the requirements.
12. [32.5.2(a)] Provide the width of the proposed planting strip on the site plan.
13. [32.5.2(a)] An interconnection needs to be provided to TMP 45-68D1 on the north side of this
project.
14. [32.5.2(a)] Provide the limits of the managed steep slopes on the layout plan (sheet 3).
15. [32.7.91 Landscaping Plan
a. Street trees need to be provided in front of Lots 10-18 and Lots 28-34. The
trees must be of an even spacing along the street right-of-way.
b. An easement will be required for any landscaping located on private lots.
c. Add a note stating: "All landscaping shall be installed by the first planting
season following the issuance of the first certificate of occupancy within the
development, or a phase thereof."
d. Add a note stating: "All landscaping and screening shall be maintained in a
healthy condition by the current owner or a property owners' association, and
replaced when necessary. Replacement material shall comply with the
approved landscape plan."
16. [32.5.26), 32.5.2(k)] An easement plat will be required. This easement plat must be recorded
prior to approval of the site plan. Provide a separate easement plat.
17. [32.5.20), 32.5.2(k)] An easement appears to overlap with the comer of the building on Lot 27.
Revise the location of either the building or the easement.
Comments — First Review of SE2022-00043 — Victorian Heights — Special Exception:
1. Provide exhibits depicting the proposed modifications to the stepbacks and setbacks for this
property, including what is required and what is being proposed.

Zoning has no objection to the setback or stepback SEs. What Zoning does object to is the bonus density
calculations. I don't think you take out ROW dedication when making the calculation. The open space
calculation is off as well.

Albemarle County Department of Fire -Rescue
Howard Lagomarsino, hlagomarsino@albemarle.org — Requested changes; see the comments below:
1) During demolition and/or construction, the following fire prevention steps are required, so please note them
on the plan:
a) Smoking shall be prohibited in areas where smoking makes conditions such as to make smoking a hazard
and these areas shall be designated with no smoking signs per Virginia Statewide Fire Prevention Code.
b) Areas where smoking can occur, shall have appropriate receptacles for discarded smoking materials per
Virginia Statewide Fire Prevention Code.
c) Per the Virginia Statewide Fire Prevention Code, vehicular access for firefighting shall be provided at all
construction and demolition sites, including access to within 100 ft. of temporary or permanent fire department
connections, and have no overhead wiring or other overhead obstructions lower than 13 ft. 6 inches; this access
may be via permanent or temporary road, but shall be capable of supporting fire apparatus in all weather
conditions.
d) Contractor shall ensure the street numbers are always plainly visible from the frontage street during
construction per the Virginia Statewide Fire Code.
e) An approved water supply for firefighting operations shall be in place and available as soon as combustible
materials arrive on site.
f) Waste and combustible debris shall be removed from the building at the end of each day and disposed of
in accordance with the Virginia Statewide Fire Code
g) Fire extinguishers shall be provided, with not less than one approved fire extinguisher at each stairwell, on
all floor levels where combustible materials have accumulated, in every storage and construction shed and in
areas of special; hazards, such as where flammable and combustible liquids are stored or used, in accordance
with the Virginia Statewide Fire Code.

h) Operations involving the use of cutting and welding shall comply with the Virginia Statewide Fire
Prevention Code and shall require a permit from the Albemarle County Fire Marshal's Office.
Albemarle County Service Authority (ACSA)

Submit utility plan to ACSA for review.
RWSA to be included as a reviewer and recommend approval.
Water meters are to be a minimum 2-feet away from driveways and curbs.
Provide fixture counts for the multi family buildings.
Typical easement dimensions extend 10-feet beyond ACSA utilities.
Relocate blow off assembly and meter vault, near Lot 34, away from retaining wall.
ACSA has concerns about the depth of the sewer behind Bldg 2. Explore running the sewer along the
pavement.
Separate the connections for the meter vaults and fire lines for Bldg 1 and 2.
Relocate MHS10 into the pavement.
Offsite sewer easements will need to be obtained prior to final approval.
Test pits of RWSA's water main should be done during the design phase to ensure there are no conflicts
with the sanitary sewer.
Sections of sanitary sewer greater than 15-feet deep should be DIP.

The Victorian Heights Final Site Plan has been reviewed by engineering. The following comments will
need to be addressed before approval:
1. Easement plat must be recorded before final site plan can be approved.
2. The plan does not match the approved WPO. WPO amendment must be submitted and
approved before final site plan can be approved.
3. Ensure the maximum proposed slope is 2:1. Please add a note showing the maximum 2:1
slope.
4. Engineered signed and sealed retaining wall plans will be necessary before final site plan
approval.
5. Sheet 5 appears to show public drainage easements that are not shown on Sheet 3A.
6. Please show all proposed easements on the landscaping sheet.
7. Please ensure County Code 18-4.12.17.b is met. This code states that entrances should
not exceed a 4% grade for a distance of 40 ft. from the intersected street.
8. [Sheet 6] Please show cross -slopes on typical road cross section details. .

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Collins Engineering, dated 27
June 2022, and offers the following comments:
1. Please change labeling of dedication of right of way from VDOT, to County of
Albemarle.
2. Please refer to VDOT's Road Design Manual, appendix F-pg., F-120, for commercial
entrance designs along Highways with curb & gutter. The propose entrance width on
Berkmar drive, needs to be a min., of 30'11. Berkmar drive is a major collector road.
Please provide two copies of the revised plan along with a comment response letter. If further
information is desired, please contact Willis Bedsaul at 434-422-9866.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
