The proposal is on two parcels for a total ACTION: 10.36 acres zoned RA,Rural Area. The properties,described as Tax Map 79 Parcels 23B &23C are located in the Scottsville Magisterial INFORMATION: District on North Milton Road [Route#729] approximately 0.28 miles CONSENT AGENDA: Yes from the intersection of Richmond Road[US Route 250 E] and North ACTION: Yes Milton Road. The Comprehensive Plan designates this property as Rural Area. ATTACHMENTS: Yes STAFF CONTACT(S): REVIEWED BY: AGM/WDF I Francis MacCall BACKGROUND: The applicant proposes to construct a fifty(50)space parking lot to provide the required amount of parking for the additional seating that was approved for special events with SP-2002-019. Approval of a site plan waiver and commencement of construction of the parking by October 2,2004 are steps being taken to comply with the conditions of the Special Use Permit. (Attachment C) This proposal warrants the need for a site plan.In accord with Section 32.2.2 of the Zoning Ordinance,the applicant is requesting that the Planning Commission waive the drawing of certain aspects of the required site plan. DISCUSSION: Section 32.2.2 of the Zoning Ordinance states: "The forgoing notwithstanding, after notice in accordance with Section 2.4.2.5,the Commission may waive the drawing of a site development plan in a particular case upon finding that the requirement of such plan would not forward the purposes of this ordinance or otherwise serve the public interest;provided that ifio such waiver shall be made until the Commission has considered the recommendation of the agent. In the case of ponditional approval,the agent in his recommendation shall state the relationship of the recommended condition to the *visions of this section.No condition shall be imposed which could not be imposed through the application of the regulations of section 32.0." ti. Based on the comments of the Site Review Committee staff opinion is that requirement of a site plan would not forward the purposes of the ordinance or otherwise serve the public interest. The plan meets most of the site plan contents requirement and has allowed staff to adequately review and comment on the details of the proposal. The Site Review Committee has reviewed this request and has not identified any unfavorable conditions that would arise from excluding certain content from the plan. The County's Historic Preservation Planner has stated that the location and size of the lot will have a negative visual impact on the historic resources at Clifton and surrounding historic sites in the Milton area. (Attachment D) Staff is providing the comments of the Historic Preservation Planner to the Planning Commission as information only. The conditions of the special use permit do not restrict the location of the parking. The issue before the Planning Commission is not the location of the parking. The issue before the Planning Commission is the approval of a plan of lesser detail than required by Section 32.5 of the Zoning Ordinance. In the approval of a modification request,the Commission may not impose conditions it could not impose on a site plan meeting all the content requirements of the ordinance. Approval of the plan and commencement of Construction will allow the Special Use Permit conditions to be met. Staff recommends approval of the site plan waiver request with the conditions specified below. RECOMMENDATION AND CONDITIONS OF APPROVAL: Staffrecommends approval of the request for a site plan waiver with the following conditions: 1 The site plan shall not be signed until the following conditions are met: 1. Prior to the commencement of any construction activity, an erosion and sediment control plan and a stormwater management plan must be reviewed and approved by the Current Development Division. IN. 2. County approval and recordation of a plat which combines Tax Map 79,Parcels 23B and 23C into one parcel. 3. Submittal of a revised landscape plan providing screening of the parking area from Milton Road. Screening shall consist of the equivalent of evergreen trees in a double staggered row planted fifteen(15)on center. Please note that this approval is subject to the following conditions: 1. A site plan shall be submitted for review and approval; 2. All requirements from the Health Department shall be met prior to final site plan approval; 3. Construction of the parking lot shall commence within twenty-four(24) months upon approval or this special use shall expire; 4. Approval is limited to a fifty-two(52)-seat restaurant with full dinner hours available(no limited seating) plus fourteen (14) guestrooms. At no time shall the aggregate of guests of the Inn, the restaurant, and any special events on the premises exceed two hundred (200)people or the number of people approved by the Health Department,whichever is less; and 5. Hours of restaurant operation for the public, other than guests of the Inn, shall be from 6:00 p.m. to 11:00 p.m. • In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within twenty-four(24) months after the issuance of such permit, the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section,the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2)years from the date of the issuance. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance, you must comply with the conditions in this letter. The Virginia Department of Historic Resources'(DHR)Historic Resource Data Sharing System(DSS)has identified Clifton Inn(Clifton)(Tax Map 79-23B)as historic(DHR ID 002-0155)and listed on the Virginia Landmarks Register and National Register of Historic Places. The primary resource on the property is a dwelling(c. 1800)with 19th and 20th century additions built in the Colonial Revival Style.Various outbuildings include a detailed brick office(c. 1833- 45);ruins of an early 19th century springhouse;the shaft of a 19th century stone lined ice house;an early 20th century chicken coop;and an altered 1920s brick garage. 2. Surrounding Tax Map 79-23B and 23C are the following resources considered to be historic according to the Virginia Department of Historic Resources' (DHR)Historic Resource Data Sharing System(DSS): a. 002-1514—Milton Lock and Dam. b. 002-1617—Milton Farm. c. 002-0299—Locust Grove. d. 002-1510—Milton Canal Lock. 3. This proposal has raised the following concern: a. The current proposal varies dramatically from the one submitted with the request for the Special Use Permit (SP2002-00019).The construction of a 50-space parking lot as illustrated will include extensive land disturbance and the removal of mature evergreen and deciduous trees up to the edge of Clifton Inn Drive and within 13' of Milton Road(S.R.279).As submitted,it is anticipated that the parking lot will create a negative visual impact on the historic resources located on the subject parcel,and others in the area of historic Milton,and is therefore not appropriate for this site in the proposed location.For these reasons we cannot support the request for the site plan waiver and we recommend an alternative solution: In order to minimize the visual impact of the proposed parking lot on the historic resources identified above,we strongly recommend that the applicant redesign the rectangular configuration of the lot.This could be accomplished through the redistribution of the overflow parking spaces into smaller areas such as a)along the edge of Clifton Inn Road and b)a smaller,curvilinear lot that follows the natural topography north of the tennis courts.We further suggest that the applicant explore alternative paving materials,such as grass pavers,which will provide a vehicle-resistant alternative to impervious pavements.These solutions could reduce the required area of disturbance and required cut and fill,reducing the resultant runoff,and preserve the wooded area along Milton Road.The resulting parking area would compliment existing features,landscaping,and natural vegetation leading to Clifton Inn and Milton,and would protect the historic character of this part of Albemarle County. Should the site plan waiver be approved with the parking lot as shown,we recommend that none of the landscape requirements of the Ordinance be waived. VII!
