Could you please update me on SUB2016000144 Westlake Hills Subdivision Residue (2 Lot).
Since it was so many months ago I've attached the comments for your reference.
Although it has been more than 6 months since any activity specifically on this submission it was dependent on
SUB2016-79 being approved and recorded. It was not approved until 3/6/17. 1 do not know if it has been recorded yet
or not.
So, at this point I'm treating 3/6/17 as the date of last activity. That would mean 6 months of inactivity, and automatic
withdrawal of the plat, would not be until 9/6/17.
If you know of any other activity and/or communication with reviewers, or steps to address the comments, that has
taken place since then please let me know so I can base the inactivity date on those instead.
Do you plan to resubmit this subdivision plat?
Have the decisions been made about how to handle the road and whether a different type of submission will need to
be made?

Paty — Hope you are doing well. Are you sure a Supplemental Declaration needs to go to the county attorney's office for
review. Generally, it is a simple document that subjects a new phase of land to an existing recorded Declaration. We
have done many over several neighborhoods in Albemarle and this would be the first one that has been reviewed by the
CA office. Let me know... just trying to help you guys out since things are pretty backed up.

Kris,
Yes, I still have both SUB201600158 Lot 25 & Open Space and SUB201600079 Westlake Hill Phase II under
review and in my possession.
Generally, I am running about 2 to 3 weeks behind the "preferred deadlines" that we try to accomplish. We
have had a temporary reduction in plan reviewers at the same time as a large influx in
submissions. Therefore, the "preferred deadlines" have been extremely hard to meet for the last few months
and continue to be so. This applies to first submissions and resubmissions.
Since you were in a hurry I had been trying to get to your resubmissions a little quicker, at the cost of making
other reviews later. When I was reminded last week that the HOA documents had not been submitted even
for the first round of review by the County Attorney's office, even though it had been specified in the
comments, I realized approval was not imminent.

Also, revisiting the road bond question (as we were also discussing it for the 2-lot division), the roads have to
be built or bonded for Phase II before approval of the plat as well.
I do not think that has taken place for phase II yet.

I'm looking at two of the Westlake Hills submissions now. I don't yet know the outcome of the review, but I
wanted to give you a heads up ASAP on something you may not be aware of.
Please see the email below. This is in reference to Phase 11, the one you said is the priority.
Unless I am not remembering something correctly I still have not received the document mentioned
(Comment #13). Since this has to be reviewed by the County Attorney this could be what slows you down and
it is something that has been a comment on all three reviews.

Please let me know if you have any question.
Two things to note:
To my knowledge we have not gotten a response to Comment #13 about the maintenance Instrument
for privately owned street trees, common areas, etc. If this has been submitted, with the previous
reviewer or on a previous phase, please have someone forward me any information they have on that
review. Although this is an item that is not "on the plat" it is something that has to be approved before
the plat can be. It is also a review, through the County Attorney's office, that can be time
consuming. Therefore, if at all possible, I suggest the documentation be submitted as soon as possible.
Comment #11, in the last submission, had a typo in it. I apologize for this. To the best of my
knowledge this comment had not been addressed and still needs to be. If because of the transitions
between reviewers it has been addressed please forward me any information pertaining to that.

currently also have a temporary reduction in review staff. Therefore, the preferred review deadlines have

SUB2016-79 being approved and recorded. It was not approved until 3/6/17. 1 do not know if it has been recorded yet
or not.
So, at this point I'm treating 3/6/17 as the date of last activity. That would mean 6 months of inactivity, and automatic
withdrawal of the plat, would not be until 9/6/17.

Yes, I still have both SUB201600158 Lot 25 & Open Space and SUB201600079 Westlake Hill Phase II under
review and in my possession.
Generally, I am running about 2 to 3 weeks behind the "preferred deadlines" that we try to accomplish. We
have had a temporary reduction in plan reviewers at the same time as a large influx in
submissions. Therefore, the "preferred deadlines" have been extremely hard to meet for the last few months
and continue to be so. This applies to first submissions and resubmissions.
Since you were in a hurry I had been trying to get to your resubmissions a little quicker, at the cost of making
other reviews later. When I was reminded last week that the HOA documents had not been submitted even
for the first round of review by the County Attorney's office, even though it had been specified in the
comments, I realized approval was not imminent.

• To my knowledge we have not gotten a response to Comment #13 about the maintenance Instrument

review. Although this is an item that is not "on the plat" it is something that has to be approved before
the plat can be. It is also a review, through the County Attorney's office, that can be time

Generally, I am running about 2 to 3 weeks behind the "preferred deadlines" that we try to accomplish. We
have had a temporary reduction in plan reviewers at the same time as a large influx in
submissions. Therefore, the "preferred deadlines" have been extremely hard to meet for the last few months
and continue to be so. This applies to first submissions and resubmissions.
Since you were in a hurry I had been trying to get to your resubmissions a little quicker, at the cost of making
other reviews later. When I was reminded last week that the HOA documents had not been submitted even
for the first round of review by the County Attorney's office, even though it had been specified in the
comments, I realized approval was not imminent.

Two things to note:
• To my knowledge we have not gotten a response to Comment #13 about the maintenance Instrument
for privately owned street trees, common areas, etc. If this has been submitted, with the previous
reviewer or on a previous phase, please have someone forward me any information they have on that
review. Although this is an item that is not "on the plat" it is something that has to be approved before
the plat can be. It is also a review, through the County Attorney's office, that can be time
consuming. Therefore, if at all possible, I suggest the documentation be submitted as soon as possible.
Comment #11, in the last submission, had a typo in it. I apologize for this. To the best of my
knowledge this comment had not been addressed and still needs to be. If because of the transitions
between reviewers it has been addressed please forward me any information pertaining to that.

Since it was so many months ago I've attached the comments for your reference.
Although it has been more than 6 months since any activity specifically on this submission it was dependent on
SUB2016-79 being approved and recorded. It was not approved until 3/6/17. 1 do not know if it has been recorded yet
or not.
So, at this point I'm treating 3/6/17 as the date of last activity. That would mean 6 months of inactivity, and automatic
withdrawal of the plat, would not be until 9/6/17.
If you know of any other activity and/or communication with reviewers, or steps to address the comments, that has
taken place since then please let me know so I can base the inactivity date on those instead.
Do you plan to resubmit this subdivision plat?
Have the decisions been made about how to handle the road and whether a different type of submission will need to
be made?

review. Generally, it is a simple document that subjects a new phase of land to an existing recorded Declaration. We

Yes, I still have both SUB201600158 Lot 25 & Open Space and SUB201600079 Westlake Hill Phase II under
review and in my possession.
Generally, I am running about 2 to 3 weeks behind the "preferred deadlines" that we try to accomplish. We
have had a temporary reduction in plan reviewers at the same time as a large influx in
submissions. Therefore, the "preferred deadlines" have been extremely hard to meet for the last few months
and continue to be so. This applies to first submissions and resubmissions.
Since you were in a hurry I had been trying to get to your resubmissions a little quicker, at the cost of making
other reviews later. When I was reminded last week that the HOA documents had not been submitted even
for the first round of review by the County Attorney's office, even though it had been specified in the
comments, I realized approval was not imminent.

Two things to note:
• To my knowledge we have not gotten a response to Comment #13 about the maintenance Instrument
for privately owned street trees, common areas, etc. If this has been submitted, with the previous
reviewer or on a previous phase, please have someone forward me any information they have on that
review. Although this is an item that is not "on the plat" it is something that has to be approved before
the plat can be. It is also a review, through the County Attorney's office, that can be time
consuming. Therefore, if at all possible, I suggest the documentation be submitted as soon as possible.
Comment #11, in the last submission, had a typo in it. I apologize for this. To the best of my
knowledge this comment had not been addressed and still needs to be. If because of the transitions
between reviewers it has been addressed please forward me any information pertaining to that.

review. Generally, it is a simple document that subjects a new phase of land to an existing recorded Declaration. We
have done many over several neighborhoods in Albemarle and this would be the first one that has been reviewed by the

Yes, I still have both SUB201600158 Lot 25 & Open Space and SUB201600079 Westlake Hill Phase II under
review and in my possession.
Generally, I am running about 2 to 3 weeks behind the "preferred deadlines" that we try to accomplish. We
have had a temporary reduction in plan reviewers at the same time as a large influx in
submissions. Therefore, the "preferred deadlines" have been extremely hard to meet for the last few months
and continue to be so. This applies to first submissions and resubmissions.
Since you were in a hurry I had been trying to get to your resubmissions a little quicker, at the cost of making
other reviews later. When I was reminded last week that the HOA documents had not been submitted even
for the first round of review by the County Attorney's office, even though it had been specified in the
comments, I realized approval was not imminent.

Two things to note:
• To my knowledge we have not gotten a response to Comment #13 about the maintenance Instrument
for privately owned street trees, common areas, etc. If this has been submitted, with the previous
reviewer or on a previous phase, please have someone forward me any information they have on that
review. Although this is an item that is not "on the plat" it is something that has to be approved before
the plat can be. It is also a review, through the County Attorney's office, that can be time
consuming. Therefore, if at all possible, I suggest the documentation be submitted as soon as possible.

It was for sure a 2 lot private street that had a maintenance agreement.
I don't think the public road is going to work since it requires a road bond. That is a part of the issue

Is it possible that in the past you created an easement that was a "Private Street", with that
label and a private street maintenance agreement?
In the rural areas a private street can be approved by the agent for a two -lot subdivision (14-
232(B)(2)).
In the Development Areas that is not the case. In the development areas (14-233(A)(2)) the
commission has to approve a private street for a two -lot subdivision.
You of course can go that route is you wish.
Since you had an approved preliminary plan, and an approved set of road plans, I just thought
creating the public street now (instead of later) would be less time consuming then taking the
private street approval to the commission.
Also, please keep in mind that Engineering's comments on the first submission when it was

In reference to the easement versus road question you had on SUB201600144 Westlake Hills
Subdivision Residue:
• An easement will not work because the lot would not have any road frontage (14-403).
• When you were talking about projects in the past where you have used an easement to
access the lot in those circumstances did the parcel had road frontage? Megan said thal
is the only time she would know of where an easement would have been allowed for
the access. Do you have a specific project in mind that would be an example of where
you were allowed to use an easement to access a lot and the proposed lot did not have
frontage?
I will move forward with my comments unless there is something else we should discuss. In
the comments I will outline the process for changing the submission from a 2-lot to a full 14-
206 review.

Since you were on the way out the door when we chatted a few minutes ago I thought I would
follow up with an email.
In reference to the easement versus road question you had on SUB201600144 Westlake Hills
Subdivision Residue:
• An easement will not work because the lot would not have any road frontage (14-403).
• When you were talking about projects in the past where you have used an easement to
access the lot in those circumstances did the parcel had road frontage? Megan said that
is the only time she would know of where an easement would have been allowed for
the access. Do you have a specific project in mind that would be an example of where
you were allowed to use an easement to access a lot and the proposed lot did not have
frontage?
I will move forward with my comments unless there is something else we should discuss. In
the comments I will outline the process for changing the submission from a 2-lot to a full 14-
206 review.

It was for sure a 2 lot private street that had a maintenance agreement.
I don't think the public road is going to work since it requires a road bond. That is a part of the issue with the banks and
why we need this plat.

Is it possible that in the past you created an easement that was a "Private Street", with that label and a
private street maintenance agreement?
In the rural areas a private street can be approved by the agent for a two -lot subdivision (14-232(B)(2)).
In the Development Areas that is not the case. In the development areas (14-233(A)(2)) the commission has
to approve a private street for a two -lot subdivision.

public street now (instead of later) would be less time consuming then taking the private street approval to
the commission.

I have done this in the past for rural property not in the development area. I was not aware that being in the
development area prevented a "front -back" division using a 30' access easement to create 2 lots.
Bill F, can you confirm this is not allowed? The only purpose of the division is to create future phase parcels. All of this
property will be subdivided into lots with future plats.

Is it possible that in the past you created an easement that was a "Private Street", with that label and a
private street maintenance agreement?
In the rural areas a private street can be approved by the agent for a two -lot subdivision (14-232(B)(2)).
In the Development Areas that is not the case. In the development areas (14-233(A)(2)) the commission has
to approve a private street for a two -lot subdivision.
You of course can go that route is you wish.
Since you had an approved preliminary plan, and an approved set of road plans, I just thought creating the
public street now (instead of later) would be less time consuming then taking the private street approval to
the commission.
Also, please keep in mind that Engineering's comments on the first submission when it was shown as a "30'
Access Easement", and their comment (on County View but not sent to you yet) on this most recent
submission where it is shown as a public road, is that the bond for the road plan (SUB2014400067) needed to
be posted and approved before this plat can be approved.
Just so you know, Bill Fritz is out of the office until 10/25/16. 1 do not know if he will be answering emails
while he is away.

So I wanted to look into it since he isn't around to ask. He didn't say "bond" but since he said "posted" I
thought he was referring to the bonds.

I made a mistake in my email to you.
The plan isn't from this year. It is SUB201400067.
It called "Westlake Hills Phase 11, III & IV Road Plans".
I still have to check with Todd, as you suggested, but I thought if I gave you the right number maybe that
would help;).
As mentioned: Max's comment had said "Plat cannot be recommended for approval until the phase 3
portion of Road plan #SUB201400067 has been posted and approved." So I was looking for Phase 3 bonding
info.
I'm doing a lot on Westlake right now. So if you just let me know which phases have been bonded already it
might save sometime later O, since I will need to know with the future submissions as well.
