Fairfax Street Alexandria, Virginia 22314 August 28 , 1989 Ms. Amelia Patterson Zoning Administrator Albermarle County 401 McIntyre Road Charlottesville, Virginia 22901-4596 Re: Clifton Dear Amelia: I appreciate you, Kathy, Jay and Bill taking the time to meet with me on Tuesday to discuss a variety of issues related to our operation as a country inn. I thought it might be useful to summarize my understanding of the meeting, concluding with a list of action items for me and your respective offices. The following is a list of specific issues which we discussed and which were resolved as set forth below. If any aspect of this is inconsistent with your understanding please let me know: 1. Conversion of Innkeeper Space to Rental Unit in the Main House. It was agreed that given the fact that the main house already has a valid permit and it has been inspected by the appropriate authorities that the change in the use of the space does not require a different occupancy permit or authorization of any kind. We envision that this will now be used as rental space for our guests. 2 . Lodging and Occupancy Permits. While the main house has a valid tourist lodging permit, the cottage and carriage house apparently do not yet possess certificates of occupancy. Jay assured me that since the latter two have been inspected by all the appropriate County authorities that certificates of occupancy will now be forthcoming. Jay also said he would confirm whether it might be preferable for us to have a updated certificate of occupancy for the main house in view of the fact that this was originally issued as a tourist lodging permit and our special use permit now allows us to have more than the five rooms permitted under the tourist lodging regulation. Jay indicated that he would proceed to obtain certificates of occupancy for all of these units and would advise me if he was unable to obtain one for the main house on the basis of the previously existing inspections and tourist lodging permit. 3 . Increase of Rental Units from 7 to 12 Units. It was agreed that if we wished to increase the number of our rental units beyond the 7 permitted in the special use permit that we should file a specific request to amend and update the special use permit which would be reviewed by the Planning Commission and the Board of Supervisors. We expect to do this prior to August 28th and would hope ,, VIII Ms. Amelia Patterson August 28 , 1989 Page 2 this could come before the Board of Supervisors no later than early to mid-October. As I stated, we already have 9 units which are now split between innkeeper use and guest use and thus we would be prepared to move forward quickly at least with respect to the initial 9 units. 4 . Continued Authorization for 50 Seat Restaurant Open to the Public. In the above context, we also discussed a continuation of the 50 seat restaurant permit authorization by including it in the special use permit. As we discussed, we currently offer only breakfasts and occasional dinners to guests of the inn. We do not offer meals to the public nor do we have any intention to offer meals to the public at this time. However, we may like to have the option to do so in the future. 5. Fish Pond or Swimming Pool . It was the County' s position IhsPrc that we could characterize the property in one of two �e � ways. It could either be viewed as a water facility P which is not a swimming pool (i.e. a fish pond) and would 16OCA- not require further inspections but could not benefit from the certificate of occupancy. On the other hand, if we choose to characterize it as a swimming pool then it would require an inspection by an approved engineer who would need instruction from Jay as to what he/she should analyze. I will get back in touch with you shortly regarding this matter. 6. Property Site Plan. It was suggested that I include a sketch of the lake and the property detailing how many units are contained in each of the buildings as well as the number of parking spaces which are on the property. I will attach that to the special use permit amendment application which will be sent to you under separate cover. My name is Mitch Willey; my wife, Emily, and I own Clifton the Country Inn, which is located on Route 729 in the Shadwell area of Albermarle County. My wife and I purchased Clifton a couple of years ago and turned it into an inn in September, 1985. Since that time, we have had several different innkeepers, who have been working directly with your office as we have expanded our operation. They also worked closely with your office two years ago when we requested a special use permit to enlarge our operation and to be permitted to have a fifty seat restaurant open to the public. As your records probably indicate, we received unanimous approval from both the Planning Commission and the Board of Supervisors for that special use permit. However, we hake decided not to proceed with the restaurant. One of the nicest things to come out of that entire zoning process was the opportunity to work with tie various people in your department and the Inspections and Health Departments; during the process we also realized that our neighbors and others are most enthusiastic about our preservation efforts and are active supporters of Clifton and its business. We have tried to retain every aspect of its historic character as we adhere to the notion that this is an important historic home which the public should have the opportunity to enjoy. At the same time, we have tried to retain the estate quality so that it still feels very much like someone's home, which has been open to a few invited guests. I am sure your records also indicate that Clifton is on the Virginia Register of Historic Places; I 've enclosed a copy of the designation and a little blurb from the Preservation magazine for your files. I hope I have not bored you with this amount of background but I thought it perhaps important for you to understand our overall philosophy. As an absentee owner, I have not generally been directly involved in discussions with your office. In fact, each of the local government agencies has been dealiAg with out "restoration engineer" , Joel Wollum, who has worked with the various offices to obtain all the necessary permits, inspection approvals, etc. But I thought that given the change in personnel at the inn that has Ms. Amelia M. Patterson August 10, 1989 Page 2 occurred in the past couple of years that I should be the primary contact and should therefore interject myself into these discussions at this stage. In this way your office will always know that I can be contacted if any additional information is sought. I am writing to you simply to advise you of our current situation; I am not certain that we need to do anything further with respect to formal authorizations or permits but I hope that if we do need to obtain such documents you can advise me of the process so that we can do so as soon as possible. Clifton is a very large home and we are fortunate enough to have a large number of rooms which can be rented to our guests or alternatively used for lodging for our staff. Clifton is configured in such a way that in the main house we have six suites of rooms, five of which we have historically rented to our guests, with the sixth (a downstairs suite) maintained as an innkeeper' s residence as well as two additional bedrooms for our staff. It is my understanding that the entire inn has a valid and up-to-date occupancy permit and the main house and other buildings which are in use have been inspected by both the Fire Marshall and the Health Department. I have been advised by my innkeepers on various occasions that these inspections have taken place periodically over the past couple of years but I would like to re-confirm that all inspections are up to date and current for both your records as well as our records. In addition, we have one rental space available in our carriage house and two additional rental spaces in the cottage. My wife and two daughters and I frequently occupy these additional spaces. Also, because we have a small staff and frequently a rapid turnover of the rooms, we need to have a spare room in order to safely assure guests that seven rooms will be available on a given evening. Until recently the best arrangement was for our innkeeper couple to live in the downstairs suite with other staff living in the other two single bedrooms that are in the main house. However, because of a recent change in staffing from a couple to three single innkeepers we have decided that it is more appropriate for the downstairs ' suite to be used for rental space and the cottage could be used for the innkeepers. As a result, we are changing the use of the downstairs suite from innkeeper residence to rental space. It is necessary that we have a different or additional occupancy permit for that space now that it is being occupied by guests rather than innkeepers? Fortunately our business is growing and Clifton seems to be in some demand these days; as a result, we are thinking that in the future we would like to perhaps use more of our spaces for rentals. Therefore, I would expect that we will be asking the County to expand the number of rooms we can rent from the current 7 to perhaps as many as 12 . We could offer 12 rooms without building Ms. Amelia M. Patterson August 10, 1989 Page 3 any additional space, but simply using the rooms that are already in the house or in the other buildings on the property which, of course, would not distract from the character and feel of the historic estate that presently exists. Perhaps you can also advise me as to the process we would need to follow in order to expand from the 7 to 12 rooms? I would simply like to introduce myself and see what, if anything further, we need to do with respect to our current situation. We will be forwarding the nomination to the National Park Service within sixty days. The Virginia Landmarks Register was established by an act of the General Assembly in 1966 and includes "the buildings, structures, and sites which are of statewide or national significance." It is our judgment that Clifton richly deserves this official recognition as one of the Commonwealth's historic resources. The National Register of Historic Places is maintained by the National Park Service of the Department of the Interior. I am hopeful that the Keeper of the National Register will approve our nomination and place this property on this official list of the nation's historic places. The protection of registered Virginia landmarks is of immediate concern to this office. It is our hope that you will let us know if we can be of any assistance in the preservation of this property.
