RE: SUB201600022 Lamb Family Division— Final Subdivision Plat
Dear Ms. Lamb:
Pursuant to Albemarle County Code § 14-230(D),the above referenced subdivision plat has
been disapproved.The specific reason for disapproval is provided with references to specific
duly adopted ordinances, regulations or policies. Required modifications or corrections that will
permit approval of the preliminary subdivision plat are included as well. The reason for
disapproval is as follows:
Albemarle County Code § 14-403(A) requires each lot within a subdivision to have
frontage on an existing or proposed street. Albemarle County Code § 14-403(A)
applies to family subdivisions by way of County Code § 14-208(D).
An existing or proposed street may either be a "public street" or a "private street,"
as those terms are defined in County Code § 14-106, and to qualify as a "private
street,"the access easement must be approved as a "private street" under County
Code § 14-232 through 14-235. A private street would require a maintenance
agreement in accordance with County Code §14-317 for this subdivision. The
previously existing maintenance agreement can be updated to comply with
current County Code § 14-317 for this subdivision.
Within sixty (60) days after the date this notice of disapproval is provided to the applicant,the
subdivider may resubmit the final plat, as provided by Albemarle County Code § 14-230(E).
If a revised plat is not received within 60 days, the plat shall be deemed to be disapproved and
a new application and fee shall be required for submittal of the plat.

In accord with Albemarle County Code § 14-231,this decision may be appealed. The appeal
shall be in writing and be filed with the agent within ten (10) days after the date of the decision
by the agent
