Thank you for sending the proper form, and I apologize for the confusion. This form did not make its way to me from
Bohler.
I do have one question. On the approved easement plat (attached here), there are two separate references to public
access easements. One is described as a "private street easement with public access." This is the private street
providing access to Ashwood Boulevard; this private street would continue the (proposed) Archer Avenue through the
subject property. The other is described as a "variable width public access easement." This is the travelway providing
access to the property from Route 29. This is how both are described on the plat legend:
DENOTES 57' PRIVATE STREET EASEMENT WITH PUBLIC ACCESS HEREBY
DEDICATED. PRIVATE STREET EASEMENT WILL BE HELD BY SEMINOLE TRAIL, LLC.
PA DENOTES VARIABLE WIDTH PUBLIC ACCESS
EASEMENT HEREBY DEDICATED TO PUBLIC USE.
My question is: because the form you provided speaks of "travelways," I just wanted to confirm that it is appropriate for
purposes of the deed of easement to refer to both easements referenced above as travelways. I think the second
easement clearly fits the concept of a travelway. But I recall that during the rezoning of this property there was much
discussion of the private street vs. travelway concept, and I believe the first easement is meant to be a private street. If
the first easement (Archer Avenue) should instead be referenced as a private street easement in the deed, please let me
know.
I know there is some urgency on this with the property owner's construction schedule, and I would appreciate hearing
your thoughts at your earliest convenience.

Bohler.
I do have one question. On the approved easement plat (attached here), there are two separate references to public
access easements. One is described as a "private street easement with public access." This is the private street
providing access to Ashwood Boulevard; this private street would continue the (proposed) Archer Avenue through the
subject property. The other is described as a "variable width public access easement." This is the travelway providing
access to the property from Route 29. This is how both are described on the plat legend:

) DEDICATED. PRIVATE STREET EASEMENT WILL BE HELD BY SEMINOLE TRAIL. LLC.

My question is: because the form you provided speaks of "travelways," I just wanted to confirm that it is appropriate for

easement clearly fits the concept of a travelway. But I recall that during the rezoning of this property there was much
discussion of the private street vs. travelway concept, and I believe the first easement is meant to be a private street. If
the first easement (Archer Avenue) should instead be referenced as a private street easement in the deed, please let me
know.
I know there is some urgency on this with the property owner's construction schedule, and I would appreciate hearing
your thoughts at your earliest convenience.

Bohler.
I do have one question. On the approved easement plat (attached here), there are two separate references to public
access easements. One is described as a "private street easement with public access." This is the private street
providing access to Ashwood Boulevard; this private street would continue the (proposed) Archer Avenue through the
subject property. The other is described as a "variable width public access easement." This is the travelway providing
access to the property from Route 29. This is how both are described on the plat legend:
DENOTES 57' PRIVATE STREET EASEMENT WITH PUBLIC ACCESS HEREBY
DEDICATED. PRIVATE STREET EASEMENT WILL BE HELD BY SEMINOLE TRAIL, LLC.
PA DENOTES VARIABLE WIDTH PUBLIC ACCESS
EASEMENT HEREBY DEDICATED TO PUBLIC USE.
My question is: because the form you provided speaks of "travelways," I just wanted to confirm that it is appropriate for
purposes of the deed of easement to refer to both easements referenced above as travelways. I think the second
easement clearly fits the concept of a travelway. But I recall that during the rezoning of this property there was much
discussion of the private street vs. travelway concept, and I believe the first easement is meant to be a private street. If
the first easement (Archer Avenue) should instead be referenced as a private street easement in the deed, please let me
know.
I know there is some urgency on this with the property owner's construction schedule, and I would appreciate hearing
your thoughts at your earliest convenience.

Deed for Public Access — Yes, the County is the grantee I believe. The deed that will be provided will be sent to the
County Attorneys office for review before the plat is approved. The CAO will most likely provide revisions and ensure all
applicable signatures, information, etc. is included.
The BLA and Easement Plat is a combined plat. Once approved it will be recorded and show the boundary line
adjustment and all applicable easements. I'm not sure if I'm following your question correctly, but no I don't believe a
separate document needs to be prepared for the BLA.
Substitution Request — Yes, please send to me and I will review with the Planning Director. No, a separate fee isn't
required. It's part of the site plan review. Attached is an example. Provide as much information as possible.

Everything John has stated is correct.
However, we still also need a deed of dedication to the public for the private street easement/public access easement.
In similar fashion to the SWM/Drainage deeds I will need to review those documents with the CAD before approval.
Since this likely does not involve any changes to the Plat I am fine with you all preparing final copies of the plat and
delivering them to the office with the SWM and Drainage deeds. But, final approval/signature of the plat will not be
completed until that public access deed is completed and ready to go along with the plat.

he offers by way of guidance takes precedence. Next step: please submit original signed notarized plat ( x 3) and original

I cannot speak for CAO ( court schedules, conflicts, etc.) but if you send revised plat ( please revise date) to me as a .PDF, then
I should have what I need to send draft deeds to CAO for their review. It rarely takes CAO more than a week to respond, at
which point, I send deeds to you /Bohler /Applicant for notarized /original signatures on deeds and plat, these items to be
returned for county executive signature /execution (— I week), at which point, we will notify executed deeds -plat are available
for pickup and recordation. My part, perhaps could happen today if we receive .PDF. CAO, perhaps a week, execution/county
exec. signature, perhaps a week, then, a bit of this is on your end...

With your help, Engineering sent draft deeds to CAO —we received response barely 30 minutes later (remarkable): 'As long as
the plat really is revised today, and neither the title nor the relevant labels change, your draft deeds look fine to
me. ' Moments ago, CAO sent slight edit revision, incorporated in attached. Let's skip ahead. Kevin is in charge —whatever
he offers by way of guidance takes precedence. Next step: please submit original signed notarized plat ( x 3) and original
signed notarized deed ( 1 each /see Attached) under transmittal to my attention that states `Not for review, for signature
approval' to McIntire office, address below. Office Lobby Hours: M, W, F, 9-4.

I cannot speak for CAO ( court schedules, conflicts, etc.) but if you send revised plat ( please revise date) to me as a .PDF, then
I should have what I need to send draft deeds to CAO for their review. It rarely takes CAO more than a week to respond, at
which point, I send deeds to you Kohler /Applicant for notarized /original signatures on deeds and plat, these items to be
returned for county executive signature /execution (— I week), at which point, we will notify executed deeds -plat are available
for pickup and recordation. My part, perhaps could happen today if we receive .PDF. CAO, perhaps a week, execution/county
exec. signature, perhaps a week, then, a bit of this is on your end...

ACSA and VDOT have provided no objection and I have completed my Planning review. So, I will be sending out a
comment letter as soon as I hear from you.
They will need deeds for public access and deeds for the SWM and Drainage easements, but other than that everything

Good Afternoon Richard and John,
I wanted to email and update you both on SUB2022-91. I sent the attached comments to the Applicant today. Based on
VDOT's comments it seems like the easements shown on this Plat are on land that is to be dedicated as right-of-way.
Once that land is dedicated as right-of-way, VDOT has indicated that the proposed easements will not be needed. That
said, I don't think you guys need to provide any review comments for this application until the Plat is resubmitted, if at
all. Please let me know if you have any questions on this. The second application, SUB2022-92 still needs your review,
but at this time you can hold off on SUB2022-91. Thanks!

Good Morning,
For the Final Site Plan resubmission we have 45 days from the re -submittal date (April 20`h) to review the plans. I believe
that date is June 3rd. I have received most comments already, but I am waiting for Engineering to finalize their comments
before sending them out. Our Engineering reviewer has been out sick the last few days, but I expect to have those
comments within the next week or so.
For the Easement and BLA Plat applications. Those were processed on our May 16th submittal date, so I just received
them this week. Our submittal and application distribution follows our posted submittal schedule which is every 1' and
3'd Monday of each month. Since they came in on the 10th it fell to our submittal date of the 16th. We have 60 days from
the submittal date to officially send out review comments, but typically they are completed in about half that time. Since
reviewers are just now receiving these applications I can't estimate when I will have a full set of review comments out,
but it'll likely be mid -June. I will know more information as review comments start to come in to me in the coming
weeks.
The ARB reviewer for this application is Khristopher Taggart. I would reach out to him for an update on the ARB review
timeline.
