BACKGROUND: The subject parcel,Tax Map 45 Parcel 91, contains approximately 3.635 acres and is located between
State Route 659 (Woodburn Road)to the north and State Route 1417(Woodbrook Drive)to the south in the Rio
Magisterial District. Parcel 91 is in the County Development Area and is zoned R-6(Residential)(see Attachments A&
B). The applicant is proposing to subdivide the subject parcel into three parcels(see Attachment C). This request is
defined as a subdivision in the County Subdivision Ordinance and is therefore subject to all subdivision regulations,
including Section 14-505,which prohibits separate driveways for lots created by subdivision.
DISCUSSION: Pursuant to Section 14-233(A), the following may be considered by the commission with the request
to construct a private road: Waiver of the requirements of Section 14-505(A), pertaining to the prohibition of
immediate access onto a public street, where the waiver is necessary to alleviate a clearly demonstrable danger or
significant degradation of the environment of the property or adjacent land because of existing development,
topography,other physical condition, as opposed to being a special privilege or convenience.
The applicant has requested approval of a private road under 14-232(A) Paragraph 4 (General Welfare) to serve two
lots (Proposed Lots A & B) off of Woodburn Road (see Attachment D). This private road (shared driveway)would be
built to the 2-lot standard, which the applicant has demonstrated in the request, would be less of a burden on the
surrounding community and would have less environmental impact than a road built to public road standards. In
addition, the Virginia Department of Transportation (VDOT) has required that the existing driveway serving the two
existing dwellings along Woodburn Road be vacated and moved as a result of the efforts to secure a future right of way
for the proposed Route 29 Bypass. VDOT has already approved the new entrance as a private entrance only with sight
distance deemed inadequate for a public road (see Attachment E & F), thus further necessitating the feasibility of a
private road.
The applicant has also requested a waiver of Section 14-505(A), which restricts more than one access point to parcels
from a public road. The request states that the proposed parcel (Lot C) on the south side of the property, which fronts
directly on the cul-de-sac of Woodbrook Drive, would be better served by Woodbrook Drive and would impact the
environment less by not extending any roadway through existing Parcel 91 from Woodburn Road (Attachment D).
This condition would also apply to extending one roadway from Woodbrook Drive to serve proposed lots A and B,
rather than allowing a private road as requested.
A site visit was conducted on August 2, 2001. After investigating the conditions of the site, the request for a private
road and waiver of Section 14-505(A) appear reasonable. Allowing the construction of a new private road serving Lots
A and B and granting a waiver of Section 14-505(A)would not be detrimental to the public health, safety or welfare,to
sound engineering practices, or to adjacent land. Rather, it will further the orderly development of the area.

Dear Mr. Guiler:
In reference to section 14-232 of the Albemarle County Code, I would like to request that
a private road be allowed to serve lots "A" and "B", as shown on the above referenced
plat. The proposed land fronts on Woodburn Road (Rt. 659) and is immediately adjacent
to the new proposed Western By-Pass. In fact a portion of Lot "A"was purchased by
VDOT for the construction of the By-Pass. At such time the By-Pass is constructed,
VDOT will build a new driveway as shown on the attached plan, to access the two
houses on Lot".B". The existing driveway across Lot "A"will be abandoned at this time.
Lot"C" will be accessed from Woodbrook Drive Extended only. It is intended for the
private road to serve only the existing houses on Lot "B"and any residence that is
constructed on Lot "A".
I feel this request is justified in Sec. 14-232 A - Paragraph 4. These two lots would be
better served by the one private road off Woodburn as shown on the proposed plat and
above mentioned VDOT plan. To construct a public road only 97 feet long would cause
confusion for drivers and possible danger to the homeowners of these two lots when a
street sign is installed, marking this a public road. Vehicles would be turning into this
road only to find it not to be a through passage. A private road would give the owners
more control and possibly help Agnor-Hurt School by not having another public street to
worry about.
I would also like to request a waiver of Sec. 14-505 Paragraph A, based on the fact that a
private road (driveway) to serve only two lots would certainly impact the land less than a
40 foot wide minimum State Road R.O.W. with Cul-de-sac. As you can see by the
proposed plat, we are dealing with two sites that are under one-half acre in size. As
mentioned above to build a public road only 97 feet long with cul-de-sac would take up a

good portion of the land and not only be a safety issue with the homeowners, but a
nuisance for VDOT to maintain.
This request also meets the criteria of 14-234—Paragraph C. Items 1-5
