You can resubmit as a 2 lot subdivision. But before doing so you would need to officially request a withdrawal of the current submission (SUB201800122). As mentioned in my second email, you are not required to withdraw the current submission. However, if you dolt the family division will be denied. If you withdraw your submission you can ask for a refund of the submission fee. In order to do so you should email Jennifer Smith at jsmith2galbemarle.org but please copy me on that email so that I will know the process is underway. You will need to explain to Ms. Smith why a refund is required. When you resubmit you will have to pay the new fee specific for the new submission type. This division can be submitted under a two -lot subdivision. One thing I want to mention to you is that a public or "private street" is required in order to meet the "road frontage" requirement of the subdivision ordinance. If the road/driveway going through the property is not already 18 legally a "private street", and meets all private street requirements for what is being proposed, then a "private street" will have to be approved by the County. That would require Planning Commission approval, which is a separate process from the subdivision process. I can give you more details on that if it turns out to be necessary. The subdivision proposed would not meet the requirements for "agent" approval (which is more administrative) process because the road in question serves more parcels than the two that will be subject to your subdivision (Please see the attached section 14-232 (A&B) of the County's subdivision ordinance for information on when private streets may be authorized in the rural areas and who may authorize them). Until the submission is reviewed, and the underlying information on the existing road/driveway is provided and determined, we will not be able to tell you more about what will or will not be required in reference to meeting the street frontage requirement.
