We have a number of questions and comments which we believe should be addressed before we can recommend favorably on your SP request. We would be glad to meet with you to discuss these issues. Review comments are provided below, organized by Department, Division, or agency. Our comments are provided below. Comments are organized as follows: A. Comments on the Special Use Permit B. How the proposal relates to the Comprehensive Plan C. Additional comments from reviewers D. Additional information A. Special Use Permit 1. Use. a. Revise the Application Narrative to include information on the "future development' listed on the Concept Plan. Please provide as much information as possible on all additional structures, additions to existing buildings, and any plans for future expansion of the school. Staff recommends providing as much information as possible so that additional special use permit amendments in the future can possibly be avoided. b. Will there be any future increase in the student population? Will any of the future developments be caused by an increase in the student population or create the need to expand the student population? c. Alternatively, the future development can be removed from the concept plan and kept out of the narrative, and we can move forward with this application as it has been submitted. With this approach, however, future SP amendments will be required that reflect any new future development or expansion. 2. Conceptual Plan. a. Please include a title on the Concept Plan that states -SP202200019 Keswick School Concept Plan." Please include a date of revision on this drawing as well. b. Staff recommends showing the future development on the plan. c. See Engineering comments below and the attached Map. Show all applicable stream buffers on the concept plan. d. See Historic Preservation comments below. Show and label contributing historic structures on the Concept Plan. e. Conditions 5 and 6 for SP application SP200700009 Little Keswick School Amendment describe required plantings and screenings along the property line. Ensure these conditions are met and show these planting strips on the Concept Plan. B. Comprehensive Plan Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The Rural Area Chapter (Cho ter 7) of the Comprehensive Plan designates the subject property for this proposal, TMP 80-110, for Rural Area land uses. The intent of the Rural Area designation is to allow uses that preserve and protect agricultural, forestal, open space, and natural, historic, and scenic resources; and also to allow residential uses at a density of up to 0.5 acres per dwelling unit. Staff believes that the proposal is generally consistent with the Comprehensive Plan as the application is an amendment to an existing special use permit that has been determined to be in accordance with the goals and objectives of the Comprehensive Plan. C. Additional Comments from Reviewers Planning Comments The following advisory comments related to planning matters are provided by Kevin McCollum, kmccollum@albemarle.org: 1. Should the special use permit be approved, the new use cannot commence without any applicable site plans, building permits, and zoning clearances. Zoning Comments from the Zoning reviewer, Lea Brumfield, Ibrumfield@albemarle.org are pending. Engineering The Deputy County Engineer, Emily Cox, ecox2@albemarle.org, has requested changes. 1. WPO VSMP Plan will be necessary for any proposed disturbance over 10,000 SF. 2. Please show the water protection stream buffer on the western side of the property. 3. Please note that no proposed expansions or grading will be allowed in the WPO stream buffer. 4. Please use the latest FEMA floodplain maps to label the floodplain: https:Hfema.maps. aregis.com/aPps/webappviewer/index.html?id=29f87515702d4845a906419b287e2049 Building Inspections Comments from Building Inspections reviewer, Betty Slough, bslou hghgalbemarle.org, are pending. Fire/Rescue The Fire/Rescue reviewer, Howard Lagomarsino, hlagomarsino@albemarle.org has no objections but has provided the following comments. Fire rescue does not object to the concept of the building additions but the following issues will need to be addressed: 1. Fire apparatus access roads/lanes are required and will need to meet the width requirements based on building height/size (20 feet to 26 feet), provide access to all sides of the ground level within 150 feet of a fire apparatus access road, sufficient surface to support 75,000 lbs. in all weather, not exceed a 10% grade, free from obstructions limiting the width below the code requirement, free from overhead obstructions at or below 13 ft 6 in. 2. Water supply for fire suppression needs to be addressed Virginia Department of Health (VDH) VDH reviewer, Alan Mazurowski, alan.mazurowski@vdh.vir ig nia.gov, has no objections. I have no objection to approval of the special use permit, however, note that at this time our office has not had the opportunity to review or approve sewage disposal system plans for the "proposed location of sewage disposal" to serve the proposed arts center on Sheet C-1.0 of the Concept Plan, dated 7/18/2022. Albemarle County Service Authority (ACSA) ACSA reviewer, Richard Nelson, melson(2serviceauthority.org has no objections. The site is outside of the ACSA jurisdictional area for water and sewer. Virginia Department of Transportation (VDOT) VDOT reviewer John Wilson, john.c.wilson@vdot.vir ie nia.goy, has provided no objection to this proposal. The Department of Transportation, Charlottesville Residency Transportation and Land Use Section has reviewed the Keswick School Art Center SP, dated July 18, 2022 as submitted by B. Clark Gathright, LLC and find the plan generally acceptable. A VDOT Land Use Permit will be required prior to any work within the right-of-way. The owner/developer must contact the VDOT Charlottesville Residency Land Use Section at (434) 422-9399 for information pertaining to this process. If you have further questions, please contact Max Greene at 434-422-9894. Rivanna Water and Sewer Authority (RWSA) RWSA reviewer Dyon Vega, dvega@xivanna.org has provided no objections to this proposal. See below. 1. Capacity issues for sewer that may affect this proposal None Known 2. Requires Rivanna Water and Sewer Authority Capacity Certification Yes X- No 3. Water flow or pressure issues that may affect this proposal None Known 4. "Red Flags" regarding service provision (Use attachments if necessary) None Known Historic Preservation Margaret Maliszewski, mmaliszewski 2albemarle.org, has requested changes. 1. Buildings originally constructed as a dwelling and a barn are considered contributing to the Southwest Mountains National Register Historic District. Revise the plan to identify these structures. Confirm that no changes are proposed to these structures. Architectural Review Board (ARB) Margaret Maliszewski, mmaliszewski 2albemarle.org, has no objections. The new buildings are not expected to be visible from the EC street. D. Additional Information Potential Conditions Below are draft conditions. Please let us know if you object to any of these. The wording of these conditions may change slightly before the Planning Commission, but these draft conditions give you a general idea of the conditions Staff will be recommending to the Planning Commission. 1. Development of the use shall be in general accord with the conceptual plan. To be in general accord with the Conceptual Plan, development shall reflect the following major elements within the development essential to the design of the development. a. Location of buildings and parking areas. b. Location of proposed buildings and future development (once it is shown on the Concept Plan). c. Location of athletic fields. Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance or improve safety. 2. The maximum enrollment shall not exceed thirty-five (35) students. Action after Receipt of Comments Please see the attached document "Action After Receipt of Comment Letter." Within one week (7 days) of receiving this comment letter, please do one of the following: 1. Request deferral, as required by Section 33.11, if you will resubmit. You can request a deferral in writing (by email) which will allow you up to six months to work on revisions to the application. 2. Proceed to Planning Commission public hearing. At this time, you may request that your application proceed to public hearing with the Planning Commission. With this option, no additional documents will be accepted and staff will take your project to the Commission as originally submitted, but without a recommendation of approval. 3. Withdraw your application. If at any time you wish to withdraw your application, please provide your request in writing (by email). Staff recommends option 1, request a deferral so that you can resubmit your application. Once deferred, Staff will work with you to address comments and choose a Planning Commission date for public hearing. Resubmittal If you choose to resubmit, please use the Special Use Permit Resubmittal Form. There is no fee for the first resubmittal. SP200700009 Action Letter DEPARTMENT OF COMMUNITY DEVELOPMENT ACTION AFTER RECEIPT OF COMMENT LETTER FIRST SET OF COMMENTS State Code requires a 90-day review by the Planning Commission unless the applicant requests deferral. As you will read in this comment letter, staff recommends changes to your project to help you achieve approval. Without these changes, staff cannot recommend approval to the Planning Commission. If you need more time to make these changes, and if you prefer to move forward to the Planning Commission with a recommendation for approval, you must request deferral. If you choose not to request deferral, staff will take your project to the Commission as originally submitted, but without a recommendation of approval. Instructions for requesting a deferral are outlined below. Within one week, please do one of the following: (1) Request deferral, as required by Section 33.11, if you will resubmit. (2) Proceed to Planning Commission public hearing. (3) Withdraw your application. (1) Deferral requested To request deferral, you must submit a request in writing to defer action by the Planning Commission and Board of Supervisors. The request may be made by email. Please note that your request for deferral may not be accepted and the County may retain the initial scheduled hearing date. If your request for deferral is accepted the application will be deemed withdrawn if the application is not reactivated within six months of the request for deferral or within 32 months from the time the application was determined or deemed complete. Failure to Respond An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant to subsection 33.11 and fails to provide within 90 days before the end of the deferral period all of the information required to allow the Board to act on the application, or fails to request a deferral as provided in subsection 33.11. This special use permit was approved based on the following conditions 1 Special Use Permit 2007-09 shall be limited to the use of a maximum two (2)-story residential facility the "New Dorm" for students enrolled in the Little Keswick School and for the conversion of the existing 'Barn Dorm to non-residential uses, such as office, recreational storage, meeting area, or other similar uses The "New Dorm" shall be located and developed in general accord with the concept plan, titled, "Little Keswick School, Concept Plan" (Attachment A -copy on file in Clerk's office) dated February 16, 2007 (last revision date) (the "Concept Plan") However, the Zoning Administrator may approve revisions to the Concept Plan to allow compliance with the Zoning Ordinance, 2 Maximum enrcllment of students shall be limited to thirty-five (35) Any increase in enrollment shall require an amendment to this special use permit and may require entrance improvements subject to Virginia Department of Transportation requirements, 3 The existing dorm, labeled "Barn Dorm" on the concept plan (Attachment A) shall be subject to review by the 3uilding Official prior to conversion of the existing use to any other use 4 Construction shall commence within five (5) years of the date of approval of SP-2007-09 5 Along the shared property line of Tax Map 80-118 and TMP 80-114A (the adjacent neighbor), between the soccer field and the fence, a planting material screen of approximately one hundred twenty-four (124) feet in length and seventeen (17) feet in width shall be established and maintained on TMP 80-118 The planting materials shall consist of a minimum of seventeen (17) Leyland Cypress, each a minimum of eight (8) feet in height, and shall be planted approximately six (6) feet on center and 6 Along the shared property line of Tax Map 80-110, TMP 80-110A and TMP 80-114A (the adjacent neighbor), a plant material screen of approximately three hundred forty (340) feet in length and forty (40) feet in width between the existing gym building and TMP 80-110A shall be established and mainrained on TMP 80-110 and a portion of TMP 80-110A. Starting at the gym and proceeding toward TMP 80-110A, the first two hundred sixty (260) feet in length shall be planted with a minimum of forty-five (45) Juniperus Virginiana, each a minimum of eight (8) feet in height, and shall be planted approximately six (6) feet on center The remaining eighty (80) feet in length shall be ,planted with a minimum of thirteen (13) Leyland Cypress, each a minimum of six (6) feet in height, and shall be planted approximately six (6) feet on center Please be advised 1hat although the Albemarle County Board of Supervisors took action on the project noted :above, no uses on the property may lawfully begin until all applicable approvals have been received and conditions have been met. This includes compliance with conditions of the SPECIAL USE PERMIT, approval of amd compliance with a SITE PLAN amendment; and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use+, structure or activity for which this special use permit is issued is not commenced within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated The term "commenced" means 'construction of any structure necessary tc the use of the permit."
