The Special Exception was approved by the Board's adoption of the attached Resolution. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property may lawfully begin until all applicable approvals have been received and conditions have been Met. This includes: • compliance with the approved SPECIAL EXCEPTION • approval of and compliance with a SITE PLAN; and • approval of a ZONING COMPLIANCE CLEARANCE. Sincerely, Andy Reitelbach Planning Division Senior Planner 11 Cc: Charlottesville Rio Road Apartments LLC 110 Draper Rd NW Suite B Blacksburg VA 24060 WWW.ALBEMARLE.ORG 401 McIntire Road, North Wing, I Charlottesville, VA 22902-4579 RESOLUTION TO "PROVE, SE 2021-00041 THE HERITAGE ON RIO WHERE AS, upon consideration of the staff reports prepared for SE2021-00041 The Heritage on Rio (in conjunction with ZMA20210001 1) and the attachments thereto, including staffs supporting analysis, any comments received, and all of the factors relevant to the special exception in Albemarle County Code § § 18-4.1,9(5), 18-8.2(b)(3), and 18-33.9, the Albemarle County Board of Supervisors hereby finds that the proposed special exception: (i) would be consistent with the intent and purposes of the planned development district under the particular circumstances, and satisfy all other applicable requirements of Albemarle County Code § 18-8; (ii) would be consistent with planned development design principles; and (iii)would not adversely affect the public health, safety or general welfare NOW, THEREFORE, BE IT RESOLVED that the Albemarle County Board of Supervisors hereby approves a special exception to waive the 15-foot stepback requirement of County Code § 18-4.19 on Parcel lDs 04500-00-00-026A2, 04500-00-00-026B2, 04500-00-00-026B3, 04500-00-00-026B4, and 04500-00-00- 026B5. 1, Claudette K.
