A Zoning Clearance is verification from Albemarle County that a proposed use, whether it is a new business or other activity (see Zoning definition of "Use"), satisfies all requirements of the Albemarle County Zoning Ordinance and ensures public health and safety. A Zoning Clearance Application is reviewed by the Zoning Department, Building Inspections Department, as well as any other applicable departments or agencies. A Zoning Clearance is Required in the Following Circumstances • Opening a new business • Changing or expanding an existing business • Buying an existing business • Moving a business to a new location or changing its name • Before natural resource extraction • Any uses listed in Section 5 of the Albemarle County Zoning Ordinance as requiring a Zoning Clearance Items Required to Apply for a Zoning Clearance Before filling out a Zoning Clearance Application ensure you have or have done the following: Tax Map and Parcel number or Address of the property. Include suite/unit/floor number, if applicable. Description of the proposed business/use. Include any and all relevant information such as a description of the business, the number of employees, number of shifts, availability of parking, etc. A Floor Plan. A sketch or an architectural drawing of the total square footage of the use. If using less than the entire structure, note the location within the structure. Note the square footage of and use of each room. Provide notice to the owner if the applicant is not the owner. Within ten days of applying for a zoning clearance, the applicant, if they are not the owner of the parcel and/or structure, shall inform the owner that they have applied for a Zoning Clearance. Please fill out the form on page 3. • Other Approvals/Documents if applicable. • A Certified Engineer's Revort is required if the parcel is zoned Industrial (LI, HI, or PDIP). • Health Department approval is required for food preparation or if the parcel is on private well or septic. • Bakeries require USDA approval. • Any additional approvals the Zoning Administrator may require including Department of Social Services and Fire + Rescue. • If you have any questions feel free to contact Staff at (434) 296-5832 Submitting an Application Once you have all the required information provided above: 1. At this time, the second floor offices are currently being programmed as a the last to be occupied, so that is the area they wish to segregate as required. If the owner can agree to use just a portion of the space, which only necessitates required parking in the amount already currently available on -site, we could approve the zoning clearance to operate, utilizingjust that space, however much it turns out to be. Then, in the future, once the SEs and Site Plan are finalized and more parking is available, we would ask that the submit another zoning clearance that would supersede this one, to reflect the larger square footage for the use and thus, increase in parking requirement. If this is the chosen route, please provide us with an update floor plan to highlight the area to be utilized and please indicate the square footage. If not mistaken, somewhere around 1,850 sq.ft would be around the max square footage that would necessitate just 7 parking spaces (we round down to the nearest number for required parking spaces. We agree that the current parking on the site does not meet the minimum spaces required by standard application of the Code. There is an approved site plan for the parcel (SDP198500003) and that site plan illustrates 7 approved parking spaces on -site. The proposed use at the time of the approved plan was for additional retail space. The owner of the property has recently completed interior renovations to the existing structure and would like to begin using the space for office use imminently. There is a site plan underdevelopment for the parcel, however, the application was deferred and no current site plan is being proposed at present. The owner does intend to present a new site plan for additional parking soon, but they would like to request a limited use of the existing building now to allow for office space until such time that a new site plan can be approved. Due to the layout of the site, special exceptions will be required for site redevelopment, so we anticipate the new site plan process will take 8-12 months to complete. The owners would not oppose a cap on occupants during this transitional period. Is there a path forward for the owner to use the existing building presently for office use, at least on a limited basis? An office of this size will require 9 parking spaces (2,343sf x 0.8 = 1,874.4sf / 200 = 9.37 spaces). My understanding is that there is currently a Site Plan (SDP2022-3) which provides the additional parking that is necessary to achieve the required number of spaces pending the approval of several Special Exceptions (SE2022-2, -3, -4, & -5). Once the site plan and special exceptions are approved, confirming the total number of parking spaces, we can continue our clearance review process. The one (1) acre site is located at 3447 Ivy Road in Albemarle County, is zoned Commercial (C1) and is located in the Samuel Miller magisterial district. The Halifax House was built in the late 1790's and was moved to the current location and professionally reconstructed in 1984. The Halifax House is located directly adjacent to the DS Tavern at 3449 Ivy Road and both parcels are owned by the same entity. The recent site plan amendment to the DS Tavern notes a shared parking agreement and approach to the DS Tavern and the Halifax House. A total of two parking spaces required to support the DS Tavern site are located on the Halifax House parcel and that agreement is in process for recordation by deed and plat. The interior renovation to the Halifax House does not propose to notably change the building's floor area. The Albemarle County GIS database states that the gross floor area for the Halifax House is 2,343 sf. Eighty percent of this gross area supports a minimum required total of 9 parking spaces by County Code Chapter 18, Section 4.12.6. When we include the 2 additional parking spaces to support the DS Tavem, the total number of obligatory parking spaces for office use is 11 spaces. The maximum number of parking spaces allowed by Code is 120% of the minimum number of required spaces, and that calculated total of I 1 parking spaces would not be exceeded at this time. Attached to the end of this memo are several exhibits. The first exhibit illustrates the existing site area of the Halifax House that is currently available for surface parking. The plan exhibit titled "Parking Exhibit A" illustrates six existing parking spaces in a gravel lot adjacent to the Halifax House and five parking spaces in a fairly flat grassed area adjacent to the existing driveway. In the current site condition, the Halifax House can support the necessary 11 parking spaces for office use. A photograph of the grass area acting as temporary parking, as it has in the past, is included at the end of this memo. The attached aerial photographs from the County GIS database indicate that the entire lower area of the site was once a gravel parking lot. An aerial photograph provided by the previous owners of the property shows the previous gravel parking lot in higher resolution that supported many more than five parking spaces. At present, we are preparing a site plan to further improve the Halifax House property. This new site plan would address the parking by providing a surface that would meet the County's approval and expand the total number of combined spaces for both the Halifax House and the DS Tavern. We estimate that the new site plan will be submitted to the County for review and approval in about one month. I hope that this narrative, in combination with the attached exhibits have provided adequate information to support the parking requirements for the Zoning Clearance of the Halifax House.
