On September 7, 2022, the Board of Supervisors took action on your Special Exception on Tax Map Parcel 09200-00-
04500 in the Scottsville District.
The Special Exception was approved by the Board's adoption of the attached Resolution.
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted
above, no uses on the property may lawfully begin until all applicable approvals have been received and
conditions have been met. This includes:
• compliance with the approved SPECIAL EXCEPTION;
• approval of and compliance with a SITE PLAN; and
• approval of a ZONING COMPLIANCE CLEARANCE.

RESOLUTION TO APPROVE
SE2022-000451699 COLLE LANE HOME STAY
WHEREAS, upon consideration of the Memorandum prepared in conjunction with the SE2022-
00045 1699 Colic Lane Homestay Application and the attachments thereto, including staff s supporting
analysis, any comments received, and all of the factors relevant to the special exceptions in Albemarle
County Code §§ 18-5.1.48 and 18-33.9, the Albemarle County Board of Supervisors hereby finds that a
modified regulation would satisfy the purposes of the Zoning Ordinance to at least an equivalent degree as
the applicable requirement, and that the requested special exception:
(i) would not cause adverse impacts to the surrounding neighborhood;
(ii) would not cause adverse impacts to the public health, safety, or welfare;
(iii) would be consistent with the Comprehensive Plan and any applicable master or small -area
plan(s); and
(iv) would be consistent in size and scale with the surrounding neighborhood.
NOW, THEREFORE, BE IT RESOLVED, that in association with the 1699 Colic Lane
Homestay, the Albemarle County Board of Supervisors hereby approves a special exception to permit a
resident manager to fulfill the residency requirements for a lomestay use.
