The issue of division will be one for the Planning Commission to act on. They will need to approve the private streets and a modification to allow some of the lots to use Catlin and some to use Yellow Wood. The real issue is going to be the need to upgrade the streets to meet the minimum design standards. I don't know about the easements themselves and if TMP 43-18D has or can obtain the 10 necessary permission from the property owners to use either or both streets. I hope this helps. My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X) for access to the subdivision of TMP 43-18D. There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one that happened was on 5/7/18. Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement and Bill because of your history. So, I just wanted to see if there is any more recent info either of you might have that I don't. I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication you may have had with Mr. Hughes please don't assume I already have it. FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't need the information ASAP. If you could just let me know once you have a moment to look into it. First, since you are showing a private street on the preliminary plat the private street request and justification must be submitted with the preliminary plat. We do not seem to have received either the request or the justification. We will need to receive these items prior to 12Noon on Friday in order to process this application in the current Site Review Committee (SRC) time frame. If we receive them after then the submission will be put on the schedule based on the date you submit the missing documents. Second, I've attached a previous request letter and justification as examples for your reference. This submission is different from yours, but it may give you an idea of the level of detail that is required. Also, please note the subdivision code references in the letter of 14-232 & 14-234 which dictate when private streets may be authorized and the procedures. Third, below I've included some of the emails that took place last February in reference to the proposed subdivision and some of the private street questions/discussion. Please note that it will be important in your request letter and justification to specify if you have requested the VDOT waiver (as discussed below) or not, and if it was granted or not. As previously discussed, this will have some barring on whether County Staff will be able to support your request or not. But, even if we submit the waiver, and VDOT approves it to allow the road to stop in the middle of the site, we'd still be able to demonstrate the 30% additional impact with a public road and would still request permission to building a private gravel roadway... As mentioned, if you do not request the waiver from VDOT, and it is unknown whether VDOT would have granted or denied the waiver request, it is very likely that staff will not support the request. In our initial comparison (attached), we're seeing that there is 35% more earthwork is required for the public road compared to a private road of the same alignment. It is our understanding that this satisfies the justification for a private street in lieu of public, per ZO 14-232 A.1.a (30% additional earthwork). 20 The public road is slightly wider (even under minimum widths allowed) and requires more gradual vertical curves, with a larger cul-de-sac radius. These conditions contribute to the additional earthwork and land area disturbance that we've calculated on the attached sheet (bottom right). We can still process the VDOT waiver if required, but this analysis demonstrates that, even with an approval from VDOT, the additional disturbance justifies the ZO condition for a private street — based on my understanding. You need to compare oranges to oranges. So the exhibits and analysis you need to generate are for the following: 1. VDOT road, ending in a cul-de-sac, assuming you have been given the waiver (not required to extend the road to the edge of the property). 2. Private road, ending in a cul-de-sac at the same location, and meeting the private street requirements and design standards in the County Code for the number of lots the private street is serving. So, it is just that one scenario with those two exhibits supporting the scenario and analysis. As far as percentage of environmental impact, I would refer you to the criteria we supplied to the applicant and/or to engineering. As I understand it, we need to determine if there is 30% greater environmental impact with a public roadway so the County will allow a Private Street. To get there, the County is asking for the following steps: 1. Apply for a VDOT waiver for interconnectivity to see if VDOT will allow the road to end prior to the edge of the property line. a. If they don't approve the waiver, it's easy to justify the additional 30% impact based on road length. b. If they do approve the waiver, you have to move on... 2. The County requires two different plans to compare the land disturbance with a private road vs. public road. Using the reduced road length, they want to see the difference with each road design on environmental impacts. a. To start, the public road is required to be wider, so there's some impact that's easy to demonstrate there. b. The other item that would show greater impact is VDOT requirements for road geometry, and how that would likely require additional grading and earthwork In the interest of time, I'm wondering if we can proceed with #2 above (assume the lengths are the same to check difference in disturbance) while we also begin work on #1. We need to run the analysis on our side, but I assume if we determine the VDOT standards require 30% more impact under the same alignment it would be accepted without the need for the waiver refusal.
