I don't think this is what Bill was talking about, because it is about the validity period for another subdivision.
However, it was another email Bill had given me (I think in hard copy) when we had the Pre-App meeting.

Mr. Albro,
Thank you for your interest in the SUB2019-42 Lots D1-D7 Subdivision preliminary plat review.
As mentioned below, although the preliminary plat review is currently deferred the applicant is preparing some of the
items that are required to move forward.
In that process I have just sent them an UPDATED but still draft version of the comments. The comments will not be
finalized until we get closer to the end of the preliminary plat review process that is currently deferred.
Attached please see those updated draft comments.
Also, in my email below I mentioned that the applicant was debating a private versus public street.
I had misinterpreted their question.
They were just referring to a private street that must meet public/VDOT standards.
They are still planning on submitting a private street request for this project.
I will continue to update you as items are submitted, but please let me know if you have any questions.
If any of the emails above appear to be wrong please let me know.
These were from the handwritten contact information sheet I passed out the day of the SRC meeting.
I am uncertain if I interpreted all of the email addressed correctly.

At the May ACEA meeting, I presented an informational item for the Authority about SUB201900029 (since
renumbered), which involved a proposed road that would use a right-of-way through a preservation tract of the Far Hills
RPD. As the right-of-way pre -dates the RPD easement, the ACEA had no legal right to prevent or regulate the use of the
right-of-way. Therefore, no action was needed or taken.
Paty, who is the subdivision reviewer for this project, now needs my comments on this issue, as the plat review is active
again.
Unfortunately, I left this item out of the "New Business" section of the minutes for that meeting, so I would appreciate it
if you both could confirm that my recall of the meeting ("no action need or taken") is correct. Andy, you will recall that
we discussed this by e-mail before the meeting.
Here is the comment on the matter that I propose to send to Paty:
`The Albemarle Conservation Easement Authority holds an open -space easement on TMP 59-27X, which is
crossed by the existing 50-foot right-of-way to be used for this project. As the right-of-way pre -dates the open -
space easement, no Authority approval is needed, provided that all work remains within the limits of the
recorded 50-foot right-of-way. Any expansion outside that right-of-way would require approval by the Authority,
which might or might not be issued, and any approval would very likely require significant mitigation measures.
Staff recommends that all proposed work remain within the 50-foot right-of-way."

I recently did a report (in May) for the sidewalk and planting strip exception request for ZMA2018-00019, 3226 Proffit
Road; however, looking at my findings for the exception request, I only looked at and analyzed 14-422. The only time I
mentioned 14-203.1 was in stating that 203.1 allows the Commission to vary or except these elements of a site.

The County Attorney provided feedback on the Montgomery Ridge staff report (see below) in which he is requesting that staff make
the findings listed in Section 14-203.1 when the applicant resubmits and I write an updated report, however, this is not our standard
practice when reviewing sidewalk and landscape strip variations. Truly we never make these findings on any of these requests but
instead only make reference to Section 14-203.1, our true analysis comes from Section 14-422 related to the request. This has come up
numerous times in the past with new planners, however, we merely tell the reviewers to stick with our standard practice. I believe I
can make the finding for a variation under § 14-203.1(Bp)(2) with this proposal, but this would be a change in how we process these
requests. How do you want me to proceed moving forward & on future requests like this?

finding that because of an unusual situation, the subdivider's substitution of a technique, design or materials of comparable quality from that required by the applicable
regulation results in an improvement that substantially satisfies the overall purposes of this chapter in a manner equal to or exceeding the desired effects of the
requirement in the applicable regulation.
§ 14-203.1 in X3) Findings required for an exception. The agent or the commission may approve a request for an exception from any requirement of the applicable
regulation upon finding that: (i) because of an unusual situation, including but not limited to, the unusual size, topography, shape of the site or the location ofthe site; or
(ii) when strict adherence to the requirements would result in substantial injustice or hardship by, including but not limited to, resulting in the significant degradation of
the site or to adjacent properties, causing a detriment to the public health, safety or welfare, or by inhibiting the orderly development of the area or the application of
sound engineering practices.

Before this proposal comes back to the Planning Conmrission, I'd suggest that staff address:
1. Whether this is a "variation" or an "exception" and why. Each requires different findings.
2. Whether this proposal can support the required findings of County Code S 14-203.10(2) (if a variation)
or $ 14-203.1(B) (3) (if an exception). Though certain findings are required, I didn't see them addressed in
the current staff report

or $ 1.1-203.1(B) (3) (if an exception). Though certain findings are required, I didn't see them addressed in
the current staff report

The County Attorney provided feedback on the Montgomery Ridge staff report (see below) in which he is requesting that staff make
the findings listed in Section 14-203.1 when the applicant resubmits and I write an updated report, however, this is not our standard
practice when reviewing sidewalk and landscape strip variations. Truly we never make these findings on any of these requests but
instead only make reference to Section 14-203.1, our true analysis comes from Section 14-422 related to the request. This has come up
numerous times in the past with new planners, however, we merely tell the reviewers to stick with our standard practice. I believe I
can make the fmding for a variation under l$ 14-203. 1 (B)(2) with this proposal, but this would be a change in how we process these
requests. How do you want me to proceed moving forward & on future requests like this?

finding that because of an unusual situation, the subdivider's substitution of a technique, design or materials of comparable quality from that required by the applicable
regulation results in an improvement that substantially satisfies the overall purposes of this chapter in a manner equal to or exceeding the desired effects of the
requirement in the applicable regulation.
§ 14-203 413)(3) Findings required for an exception. The agent or the commission may approve a request for an exception from any requirement of the applicable
regulation upon finding that (it because of an unusual situation, including but not limited to, the unusual size, topography, shape of the site or the location ofthe site; or

I'm going to throw in this section to the PVT review:
14-410 F. Principal means of access to subdivision. The principal means of access to a subdivision shall be either a public
street or a private street. The principal means of access shall conform, in the case of a public street, to Virginia
Department of Transportation standards, or, in the case of a private street, to the standards of the county as set forth in
section 14-412, throughout the street's length, including any distance between the boundary of the subdivision and any
existing public street. If discharge water of a twenty-five (25) year storm could be reasonably anticipated to inundate,
block, destroy or otherwise obstruct a principal means of access to a residential subdivision, the following shall also
apply: 1. The principal means of access shall be designed and constructed so as to provide unobstructed access at the
time of flooding; and/or 2. An alternative means of access which is not subject to inundation, blockage, destruction or
obstruction, and which is accessible from each lot within the subdivision shall be constructed.

I apologize, but the DRAFT comments are not ready today and I am uncertain exactly when they will be available.
However, once they are available I can email you a copy.
On rare occasions the draft comments are not ready until the day of the Site Review Committee (SRC) meeting. In
those cases I then bring copies of the comment to the meeting for interested attendees.
We do not need to know the names of those who wish to attend ahead of time. However, I will have a sign in sheet at
the meeting for those people who would like to be kept in the communication loop on the project.
The SRC meetings are an informal meeting. No minutes are taken, and no official records is kept.
It is instead a chance for the applicant to ask the reviewer questions about the DRAFT comments, prior to them being
finalized.
During the meeting, after the applicant and reviewers have asked any questions they have, there will be an opportunity
for informal questions from members of the community.
Depending on the number of community members who attend there may not be sufficient time for each community
member to speak. So, if you think there may be enough neighbors who will be interested in asking questions, or making
statements, it might be helpful to have one person designated to ask those questions.
I've attached the agenda for the meeting. You will see that there are 4 other projects listed to discussion, and
SUB2019-42 is the last on the agenda.
Prior to receiving any of the draft comments (mentioned above), do you have any questions you would like to forward
to me?
I will likely not be able to answer them before the meeting, but it will give me an opportunity to research them just in
case they are circumstances/conditions that I would normally not be reviewing.

However, before reaching a final conclusion, I'm curious: What led last year's preapp conference to

Paty is awaiting a plat from an applicant who is planning to show access through TMP 59-27X. That parcel is
"Preservation Tract 1" of the "Far Hills" RPD, which dates back to 1993.
The original plat for this subdivision (see Deed Book 1372 Pg 320) shows a 50-foot access easement through this
preservation tract, but does not give a deed reference to suggest that it pre -dated this plat. I'm assuming that that
means the easement was established by this plat and the associated documents. (The RPD conservation easement was
recorded immediately *after* the plat.) As this was an RPD, Planning Commission approval of the design was required,
and the access easement over this preservation tract was shown on the plat approved by the PC.
The most recent deed for this property (attached; amended for a reason appearing to have nothing to do with this road)
does not permit dwellings, and so does not mention whether improvements typically allowed for residential
development (for this property or otherwise) are permitted. However, it exempts "Construction of permitted buildings
and connecting private roads" from the restrictions on grading, blasting, etc. I just talked to Bill, who was the planner on
this project 26 years ago, and he recalls that the expectation was that the road through the tract would eventually be

used to connect to adjacent properties. There's no documentation in the easement file of any discussion of this or any
other specific restriction in the deed.
(As an aside, and as I discussed with Bill, while splitting a preservation tract with a road is something we probably
wouldn't support today, there are a few older RPDs out there that are designed like this.)
So — while the easement language isn't as detailed as we might like, my understanding is that:
1. An access easement through this preservation tract was approved by the PC as part of the RPD design.
2. The deed permits grading and earth -moving for "connecting private roads."
3. So, as long as the proposed road is a private road, and as long as it stays within the 50-foot easement shown in
the design approved by the PC, it is permitted under the deed.
4. (As an aside, this only affects the preservation tract, and says nothing about any other lots in Far Hills affected
by the new road.)
If you could confirm that this sounds correct, or let me know if you need more information, I'd appreciate it.

I didn't think so, but I wanted to make sure.
He thinks he can use the road through the adjoining parcel with the conservation easement (TMP59-27X) as access to
the new lots he is proposing.
When he resubmits under the correct submission type I will likely pull you into the review (unless you don't see it as
needed/appropriate) because it was my recollection the use of that road (Yellowwood Drive) for new lots was a problem
because of the conservation easement.
However, the preapp where that discussion happened was almost a year ago. I thought we left it off that the County
thought he couldn't do it and he was going to get with his lawyers to try to show that we were incorrect. I have no
record of it going beyond that. Now he is submitting plats using that road as if it is not a problem.

Your answer may very well be "No" to this, but have you had any communication with Kirk Hughes since 5/7/2018 in
reference to TMP 43-18D (off of Catlin Road and Yellow Wood Drive)?
My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they
could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X)
for access to the subdivision of TMP 43-18D.
There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one
that happened was on 5/7/18.
Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement
and Bill because of your history.
So, I just wanted to see if there is any more recent info either of you might have that I don't.
I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication
you may have had with Mr. Hughes please don't assume I already have it.
FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't
need the information ASAP. If you could just let me know once you have a moment to look into it.

Paty is awaiting a plat from an applicant who is planning to show access through TMP 59-27X. That parcel is
"Preservation Tract 1" of the "Far Hills" RPD, which dates back to 1993.
The original plat for this subdivision (see Deed Book 1372 Pg 320) shows a 50-foot access easement through this
preservation tract, but does not give a deed reference to suggest that it pre -dated this plat. I'm assuming that that
means the easement was established by this plat and the associated documents. (The RPD conservation easement was
recorded immediately *after* the plat.) As this was an RPD, Planning Commission approval of the design was required,
and the access easement over this preservation tract was shown on the plat approved by the PC.
The most recent deed for this property (attached; amended for a reason appearing to have nothing to do with this road)
does not permit dwellings, and so does not mention whether improvements typically allowed for residential
development (for this property or otherwise) are permitted. However, it exempts "Construction of permitted buildings
and connecting private roads" from the restrictions on grading, blasting, etc. I just talked to Bill, who was the planner on
this project 26 years ago, and he recalls that the expectation was that the road through the tract would eventually be
used to connect to adjacent properties. There's no documentation in the easement file of any discussion of this or any
other specific restriction in the deed.
(As an aside, and as I discussed with Bill, while splitting a preservation tract with a road is something we probably
wouldn't support today, there are a few older RPDs out there that are designed like this.)
So — while the easement language isn't as detailed as we might like, my understanding is that:
1. An access easement through this preservation tract was approved by the PC as part of the RPD design.
2. The deed permits grading and earth -moving for "connecting private roads."
3. So, as long as the proposed road is a private road, and as long as it stays within the 50-foot easement shown in
the design approved by the PC, it is permitted under the deed.
4. (As an aside, this only affects the preservation tract, and says nothing about any other lots in Far Hills affected
by the new road.)

I didn't think so, but I wanted to make sure.
He thinks he can use the road through the adjoining parcel with the conservation easement (TMP59-27X) as access to
the new lots he is proposing.
When he resubmits under the correct submission type I will likely pull you into the review (unless you don't see it as
needed/appropriate) because it was my recollection the use of that road (Yellowwood Drive) for new lots was a problem
because of the conservation easement.

However, the preapp where that discussion happened was almost a year ago. I thought we left it off that the County
thought he couldn't do it and he was going to get with his lawyers to try to show that we were incorrect. I have no
record of it going beyond that. Now he is submitting plats using that road as if it is not a problem.

Your answer may very well be "No" to this, but have you had any communication with Kirk Hughes since 5/7/2018 in

My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they
could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X)
for access to the subdivision of TMP 43-18D.
There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one
that happened was on 5/7/18.
Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement
and Bill because of your history.
So, I just wanted to see if there is any more recent info either of you might have that I don't.
I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication
you may have had with Mr. Hughes please don't assume I already have it.
FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't
need the information ASAP. If you could just let me know once you have a moment to look into it.

I agree with your four conclusions below. I think it particularly significant that the Far Hills declaration
and plat (at DB 1372/285) precedes the initial RPD deed of easement (at DB 1372/323). Therefore, unless
provided otherwise elsewhere, the RPD easement is generally subject to the prior recorded plat.
However, before reaching a final conclusion, I'm curious: What led last year's preapp conference to
conclude that "he couldn't do it"? Am I mussing something? Thanks.

I agree with your four conclusions below. I think it particularly significant that the Far Hills declaration
and plat (at DB 1372/285) precedes the initial RPD deed of easement (at DB 1372/323). Therefore, unless
provided otherwise elsewhere, the RPD easement is generally subject to the prior recorded plat.
However, before reaching a final conclusion, I'm curious: What led last year's preapp conference to
conclude that "he couldn't do it"? Am I mussing something? Thanks.

Paty is awaiting a plat from an applicant who is planning to show access through TMP 59-27X. That parcel is
"Preservation Tract 1" of the "Far Hills" RPD, which dates back to 1993.
The original plat for this subdivision (see Deed Book 1372 Pg 320) shows a 50-foot access easement through this
preservation tract, but does not give a deed reference to suggest that it pre -dated this plat. I'm assuming that that
means the easement was established by this plat and the associated documents. (The RPD conservation easement was
recorded immediately *after* the plat.) As this was an RPD, Planning Commission approval of the design was required,
and the access easement over this preservation tract was shown on the plat approved by the PC.
The most recent deed for this property (attached; amended for a reason appearing to have nothing to do with this road)
does not permit dwellings, and so does not mention whether improvements typically allowed for residential
development (for this property or otherwise) are permitted. However, it exempts "Construction of permitted buildings
and connecting private roads" from the restrictions on grading, blasting, etc. I just talked to Bill, who was the planner on
this project 26 years ago, and he recalls that the expectation was that the road through the tract would eventually be
used to connect to adjacent properties. There's no documentation in the easement file of any discussion of this or any
other specific restriction in the deed.

(As an aside, and as I discussed with Bill, while splitting a preservation tract with a road is something we probably
wouldn't support today, there are a few older RPDs out there that are designed like this.)
So — while the easement language isn't as detailed as we might like, my understanding is that:
1. An access easement through this preservation tract was approved by the PC as part of the RPD design.
2. The deed permits grading and earth -moving for "connecting private roads."

I didn't think so, but I wanted to make sure.
He thinks he can use the road through the adjoining parcel with the conservation easement (TMP59-27X) as access to
the new lots he is proposing.
When he resubmits under the correct submission type I will likely pull you into the review (unless you don't see it as
needed/appropriate) because it was my recollection the use of that road (Yellowwood Drive) for new lots was a problem
because of the conservation easement.
However, the preapp where that discussion happened was almost a year ago. I thought we left it off that the County
thought he couldn't do it and he was going to get with his lawyers to try to show that we were incorrect. I have no
record of it going beyond that. Now he is submitting plats using that road as if it is not a problem.

My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they
could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X)
for access to the subdivision of TMP 43-18D.
There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one
that happened was on 5/7/18.
Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement
and Bill because of your history.
So, I just wanted to see if there is any more recent info either of you might have that I don't.
I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication
you may have had with Mr. Hughes please don't assume I already have it.
FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't
need the information ASAP. If you could just let me know once you have a moment to look into it.

Here is some information in reference to your future submission:
• There is no fee for a private street request when it is filed with a subdivision plat, which you are doing. So you
have no fee for that part of your submission. As mentioned in a previous email, later on in the process
engineering will require a "road plan" and that does have its own fee and a separate submission.
• I've chatted with the other planners and they also confirmed that in the specific circumstance of this lot that
seeing if VDOT would grant a waiver for interconnectivity, so a public street could be built without connecting
through the parcel, was not a necessary step in County staff determining if we can support a private street. So,
my previous question about any communication you or you client has had with VDOT is no longer needed. This
is a special case. However, please note that if your justification is a reduced degradation to the environment,
because of the difference between a private and public street, then public and private road exhibits showing the
difference is necessary.
• Staff support will be determined after you submit the request, justification, and required material on the road
itself. With this in mind I've attached two examples of private street requests submitted in the past. Please
note that the one that does not show the road design, the information that was required for the road design
was part of the preliminary plat, including the proposed grading.
• It appears from your last submission (rural) that Lot D-2 would have no access or frontage. Please ensure that
all lots will meet all requirements.
• Please note that "building sites must be rectangular" as specified in the subdivision ordinance. Please ensure
you go other that section about the requirements of the building sites.
• As you probably know more information is required is a "subdivision" plat versus a "rural subdivision" plat. So
please ensure the plat is revised as necessary to include all of the required information for the new submission.

My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they
could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X)
for access to the subdivision of TMP 43-18D.
There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one
that happened was on 5/7/18.
Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement
and Bill because of your history.
So, I just wanted to see if there is any more recent info either of you might have that I don't.
I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication
you may have had with Mr. Hughes please don't assume I already have it.
FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't
need the information ASAP. If you could just let me know once you have a moment to look into it.

I didn't think so, but I wanted to make sure.
He thinks he can use the road through the adjoining parcel with the conservation easement (TMP59-27X) as access to
the new lots he is proposing.
When he resubmits under the correct submission type I will likely pull you into the review (unless you don't see it as
needed/appropriate) because it was my recollection the use of that road (Yellowwood Drive) for new lots was a problem
because of the conservation easement.
However, the preapp where that discussion happened was almost a year ago. I thought we left it off that the County
thought he couldn't do it and he was going to get with his lawyers to try to show that we were incorrect. I have no
record of it going beyond that. Now he is submitting plats using that road as if it is not a problem.

Paty is awaiting a plat from an applicant who is planning to show access through TMP 59-27X. That parcel is
"Preservation Tract 1" of the "Far Hills" RPD, which dates back to 1993.
The original plat for this subdivision (see Deed Book 1372 Pg 320) shows a 50-foot access easement through this
preservation tract, but does not give a deed reference to suggest that it pre -dated this plat. I'm assuming that that
means the easement was established by this plat and the associated documents. (The RPD conservation easement was
recorded immediately *after* the plat.) As this was an RPD, Planning Commission approval of the design was required,
and the access easement over this preservation tract was shown on the plat approved by the PC.
The most recent deed for this property (attached; amended for a reason appearing to have nothing to do with this road)
does not permit dwellings, and so does not mention whether improvements typically allowed for residential
development (for this property or otherwise) are permitted. However, it exempts "Construction of permitted buildings
and connecting private roads" from the restrictions on grading, blasting, etc. I just talked to Bill, who was the planner on
this project 26 years ago, and he recalls that the expectation was that the road through the tract would eventually be
used to connect to adjacent properties. There's no documentation in the easement file of any discussion of this or any
other specific restriction in the deed.
(As an aside, and as I discussed with Bill, while splitting a preservation tract with a road is something we probably
wouldn't support today, there are a few older RPDs out there that are designed like this.)
So — while the easement language isn't as detailed as we might like, my understanding is that:
1. An access easement through this preservation tract was approved by the PC as part of the RPD design.
2. The deed permits grading and earth -moving for "connecting private roads."
3. So, as long as the proposed road is a private road, and as long as it stays within the 50-foot easement shown in

Your answer may very well be "No" to this, but have you had any communication with Kirk Hughes since 5/7/2018 in
reference to TMP 43-18D (off of Catlin Road and Yellow Wood Drive)?
My recollection from the Preapplication meeting (Preapp2018-58) all the way back in May was that "we" thought they
could not use the road (Yellow Wood Drive) through the property with the conservation easement on it (TMP 59-27X)
for access to the subdivision of TMP 43-18D.
There was also a preapp scheduled in 12/2018, but it was canceled because of sickness of applicant. So the only one
that happened was on 5/7/18.
Mr. Hughes may have communicated with one or both of you individually, Scott because of the conservation easement
and Bill because of your history.
So, I just wanted to see if there is any more recent info either of you might have that I don't.
I'm also having trouble finding any email trails I might have had no it myself. So if I was copied on any communication
you may have had with Mr. Hughes please don't assume I already have it.
FYI, his current application (SUB2019-29) is being withdrawn because it is the wrong type of application. So I don't
need the information ASAP. If you could just let me know once you have a moment to look into it.

I didn't think so, but I wanted to make sure.
He thinks he can use the road through the adjoining parcel with the conservation easement (TMP59-27X) as access to
the new lots he is proposing.

When he resubmits under the correct submission type I will likely pull you into the review (unless you don't see it as
needed/appropriate) because it was my recollection the use of that road (Yellowwood Drive) for new lots was a problem
because of the conservation easement.
However, the preapp where that discussion happened was almost a year ago. I thought we left it off that the County
thought he couldn't do it and he was going to get with his lawyers to try to show that we were incorrect. I have no
record of it going beyond that. Now he is submitting plats using that road as if it is not a problem.

and here is where it gets a little fuzzy. For the Private Street (Road Plans) I think there is a fee of $430.
Now with that part of Yellow Wood Road that runs through the Preservation Tract is there a fee
associated with the design variations since it is an existing road?
And finally so I can note it in my file, what date was the pre-app meeting held?

I took a look at the last action the PC took. The issue of division will be one for the Planning Commission to act
on. They will need to approve the private streets and a modification to allow some of the lots to use Catlin and
some to use Yellow Wood. The real issue is going to be the need to upgrade the streets to meet the minimum
design standards. I don't know about the easements themselves and if TMP 43-18D has or can obtain the
necessary permission from the property owners to use either or both streets. I hope this helps. Call me if you
have additional questions.
