Hi Paul and Chris,
I'm responding regarding the proposed relocation of the access easement off Tillman Road. The
inquiry was evaluated by planning staff and the County Attorneys Office.
The original access easement within TMP 58-65E1 was created through previous property division,
per DB 3361 pages 559 and 560. Relocation of the existing easement would require a property
division application to record the revised easement, whether any property boundaries will be
relocated or not.
Parcel A, TMP 58-65A4, is within an Ag Forest district and is therefore subject to Section 3 202 of the
County Ordinance. 3-302.3.13 prohibits the creation of an access road as "development to a more
intensive use'.
Therefore, the only means of running an access road through TMP 58-65A4 would be to wait until
2024 when the Moorman's River Ag-Forest district is renewed. At that time, the property could be
withdrawn from the district to allow the access easement per the aforementioned process.
Otherwise, relocation of the access easement would require it to be routed through another
property, not within the Ag-Forest program.

As you may know, Rob Rinehart sold another piece of contiguous property and will eventually have
to abandon his current driveway according to zoning regulations. He is hoping to start constructing
his new drive on the private easement that crosses my properties.

RE RELOCATING PRIVATE EASEMENT OFF TILMAN RD
JUNE 9, 2022
Dear Mr. Holt
This note is a request to relocate a previously approved private easement
located on Tilman Rd. This easement will serve as a private driveway for an
adjacent property owned by Rob Rinehart.
The currently approved easement is located on Parcel C on Tilman Rd. We
are asking that part of the easement be shifted slightly east onto Parcel A.
My wife and 1 own both parcels. The entry to the proposed new easement
would remain at its already approved location on Tilman Rd. The proposed
new location of the private easement will run along an already existing fence
on Parcel A along ground that is a bit flatter. We have no intent to develop
Parcel A and change its zoning classification
Moving the easement will create a bit more space and privacy between the
private drive and a home we are planning to build on Parcel C. Parcel A is
classified as an agriculture/forestry zone, but our hope is that the County
would approve this shift about 15 feet east 'for a good and reasonable
cause," as county regulations would suggest would allow.
I will forward a map showing the parcels, the existing approved easement,
and the proposed new location of the private easement.
