Matthews, Jr. Matthews Development Company, LLC One Boar's Head Pointe Charlottesville, Virginia 22903 RE: Martha Jefferson Hospital at Peter Jefferson Place Approval of Application for Variation from Application Plan ZMA 01-15 with SP 01-56 and SP 01-57 Dear Mr. Matthews, The application form (dated July 2,2007) and supporting materials that you submitted requesting variation to allow a shift of square footage from one area to another in Peter Jefferson Place have been reviewed. These variations may be approved administratively through Section 8.5.5.3 of the Albemarle County Zoning Ordinance. Specifically, your request is to allow transfer of 57,800 square feet from Parcel N to Parcel B as depicted on the approved application plan, Sheet AP-4 dated August 5, 2003, resulting in a maximum of 140,000 square feet of office space in Parcel N and a maximum of 1,227,800 square feet for the healthcare campus in Parcel B. You have noted that the request will preserve the overall allowed density at Peter Jefferson Place by shifting unused office square footage to the healthcare campus, resulting in a benefit to the community. Section 8.5.5.3 (a.2) allows the director to grant a variation of an approved plan for changes to the arrangement of buildings and uses shown on the plan, provided that the major elements shown on the plan and their relationships remain the same. The following are the five criteria used to determine that this variation request is acceptable and the response to each which is further elaborated below: 1) The variation is consistent with the goals and objectives of the comprehensive plan. It is in keeping with the Comprehensive Plan. 2) The variation does not increase the approved development density or intensity of development. The maximum allowable square footage of development in Peter Jefferson Place remains the same. 3) The variation does not adversely affect the timing and phasing of development of any other development in the zoning district. Timing and phasing is not affected by the variation request. It should be noted that the variation will result in a reduced maximum square footage of development in Parcel N. 4) The variation does not require a special use permit. No special use permit is required. 5) The variation is in general accord with the purpose and intent of the approved rezoning application. It is in general accordance with the rezoning application. This request adheres to the five standards of Section 8.5.5.3 (a.2). With the above findings and detail provided in the variation request and attachments, sufficient justification is provided to determine that this request is in keeping with the variation provisions. Therefore, the request for the variation to allow a shift of square footage from one area to another in Peter Jefferson Place is approved. All other provisions of the proffers and Application Plan must be met.
