Kim,
This is very much in keeping with our discussion. It divides project into principal grading-Kafka path (phase 1), and
distinct separate bench -landscape plantings with minor (negligible) grading to site contemplative benches. There is a
distinction, which Engineering recognizes. We anticipate that existing gravel path or new Kafka path (either is fine) will
provide access and whatever equipment -material staging may be needed to situate benches into the landscape, and
that construction monitoring will help ensure that work proceeds per Exhibit LOD. I am glad TG opts for this approach,
which we accept. We discussed that Monticello is not a common plan of development.
With permission, I will update CV with review status 'Application withdrawn: Land disturbance (not part of a common
plan of development) less than 10,000 square feet is not subject to the VESCP, or VSMP. A SWPPP is not
required. Inspection by Albemarle is not required. Project does not require registration, or bond. We maintain record
of LOD exhibit for reference in the project digital file, along with this correspondence. Thanks very much for clear,
thoughtful coordination. Good luck with this project.

Monticello is a World Heritage Site; is listed on the National Register of Historic Places ( Oct. 15, 1966, NRHP Ref. Number
66000826); is a Virginia Historic Landmark (9/9/69, VLR 002-0050), and is residential estate of an 18t' century (-quote
Wikipedia) "diplomat, lawyer, architect, philosopher, and Founding Father." I say this to counter any argument that this `site'
is a `common plan of development' within context of state stormwater management regulations, especially given relatively
recent DEQ guidance concerning lots in existence prior to 7/1/2004, which are not to be considered subject to `common plan of
development' requirements. Land disturbance at Monticello (World Heritage — National Historic - State Landmark) site, f<
10,000 sf is not subject to the VESCP (17-300 ,and, since the contemplative site is likewise not within a `common plan of
development' (within context of regulatory framework of VA state stormwater regulations), land disturbance associated with
the contemplative site is exempt from the VSMP jfLOD <10,000 sf, 17-303.D.

I hope to send MIA review comments (SDP202200050) to Andy Reitelbach a bit later today, and while reviewing MIA
landscaping plan, want to circle back to thought that this seems perhaps more involved than it may need to be. I only suggest
TG think it over, and see if smaller limit of disturbance is possible. And if so, whether WPO plan requirements might become
more manageable.

If deduct lightly -graded interior of LOD (7,082ft2 ), revise linework /labels /set aside superficial landscape and bench area
leveling (surface prep) with immediate landscaping + bench installation to follow, then county can consider LOD for path
/storm pipes separately from far less intensive superficial grading required to prep bench areas. L6.00 (incl. with MIA but not
WPO) shows landscaping in bench areas intercepts overland runoff in post-dev condition, similar to a filter strip, and that
proposed grading affects not more than one, 2' contour over 50' in five or fewer locations to install contemplative benches. The
level of disturbance proposed is minimum necessary to level pads for benches, with the remainder densely -landscaped. A
portion of LOD estimated at 7,082 ft2 may, for this project in this instance, be reviewed distinct from typical grading that
precedes land development, and is, to a large degree, landscape planting with mulch stabilization. What remains, if <10,000 112,
is not subject or is exempt from VESCP NSW requirements. TG /Thomas Jefferson Foundation are encouraged to consider
ESC-SWM practices /measures to protect downslope areas from erosion during and after construction, since addition of
impervious Kafka path will increase runoff at several points, may concentrate runoff at several points, and may pose
problematic maintenance issues for TJF, absent care in design, or temporary ESC measures and permanent storm conveyance
(pipe /inlet /ELS) measures. Please discuss, and let us know if this approach appeals to Timmons (design standpoint), or to TJF
(long-term operational performance ; site/construction scheduling standpoint). If we take this approach, it would not do for a
site visit to reveal LOD> 10,000 ft2 at one time; limits can be managed with silt fence that separates Kafka path from bench
/landscape areas. Note: Once Kafka path is installed /stabilized, a site visit would no longer consider areas beneath path
disturbed, if in fact stabilized. So —design revision, reduced LOD, scheduling, care in construction, ESC-SWM measures
recommended, whether required or not.
This approach reflects effort to balance proposed development and ordinance requirements. Thank you, best, J. Anderson
