HomeMy WebLinkAboutSP200600023 Action Letter o COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, Room 227 Charlottesville, Virginia 22902-4596 Phone (434) 296-5832 Fax (434) 972-4012 November 1, 2006 Ben Thompson PO Box 29682 Richmond, VA 23242 RE: SP 2006-23 Luck Stone Quarry Flood Control Berm (Sign #50) Tax Map 79, Parcel 7 LETTER OF CORRECTION - Original Letter dated October 30, 2006 Correction to approval condition - see underlined, italicized text on page 2 Dear Mr. Thompson: On October 4, 2006, the Albemarle County Board of Supervisors took action on SP 2006-023, Luck Stone Quarry Flood Control Berm, to allow fill in the floodway fringe to allow for a flood control berm on a 127.797 acre parcel, on Tax Map 79 Parcel 7 in the Scottsville Magisterial District. This special use permit was approved based on the following conditions: 1. County Engineer approval of a grading and an erosion and sediment control plan prior to the issuance of a grading permit for activity in the area of the flood control berm; 2. Natural Resources Manager and Design Planner approval of a mitigation plan for the restoration/el1hancement of the stream buffer prior to the issuance of a grading permit for activity in the area of the flood control berm; 3. Applicant shall obtain a Conditional Letter of Map Revision (CLOMR) from the Federal Emergency Management Agency (FEMA) and copy the County Engineer on all correspondence; 4. County Engineer approval of as-built drawings for the completed flood control berm, including geotechnical engineer certification of the adequate compaction of the fill; and 5. Upon completion of the flood control berm the applicant will comply with the conditions identified in the CLOMR issued by FEMA and will copy the County Engineer on all correspondence related to this matter. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully Thompson SP-2006-023 Luck Stone Quarry Flood Control Berm Page 2 of 2 November 1, 2006 begin until all applicable approvals have been received and conditions have been met. This includes: . compliance with conditions of the SPECIAL USE PERMIT; . approval of and compliance with a SITE PLAN amendment; and . approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
