Good morning,
From what I have been able to find from the Virginia Indoor Clean Air Act, as a retailer of tobacco products, you
may allow smoking. If your business expands to other items not tobacco related or uses other than retail, then the Clean
Air Act will not allow smoking. I would advise getting verification from the landlord to confirm that the existing HVAC
systems do not allow smoking vapors to extend into other spaces. The Virginia Indoor Clean Indoor Air Act provides
requirements on separation from adjoining spaces. Based on the year this building was constructed, you will need to
determine that the separation of the adjoining spaces complies with the Clean Air Act. If they do not comply, then in
order to allow smoking, the walls would need to be brought up to the standards.
I have also cc'd Howard Lagomarsino of Fire/Rescue in case he had additional concerns.
