I have no idea what SUB2018-38 refers to, this was the number put on the email chain by Carla Harris when she writes
to you on 3/15.There should have been two refunds, one to Lodestone Build LLC for a building application and one to
Lick Mountain LLC for a refund of a VSMP application both refunds relate to TM18-34. As of today there has been no
application to subdivide this property in the last 18 months.To date we have received one check made out to Lodestone
Build LLC for$892.

Jen there has been no application for sub division of TM18-34F that I am aware of,we have applied for a subdivision of
another property(TM 41-9B) but that is unrelated and we are still waiting for approval of that subdivision.
Frank Pohl indicated that we could get a refund for the VSMP application for TM18-34F which was a fee of$1350 paid by
Lick Mountain LLC on 11/6/2018 check number 1142. We had also lodged a building application and in rereading
through the emails(below) I am now totally confused about what has transpired. We received $892 from the County
which I assumed was for the building application as it was made out to Lodestone Build LLC who applied for the building
application, I wrote to you on 4/30 asking about the VSMP refund. Your response to my email on the same day indicated
we were still owed $936 and that it would be sent out shortly.

The $32 zoning fee is under the Lodestone Build refund. I cannot have it change to Lick Mountain as it was paid under
the once check for the building permit.The check number was 1184 and the amount paid was$1,129.03. Now if you are
talking about the $936 refund for the SUB2018-38 that's the subdivision application and I am checking on that refund.

I received one check for$892 which looks to have been the building application (paid $1184) in the name of Lodestone
Build LLC. The zoning fee was paid for by Lick Mountain LLC. Can I have the zoning fee check replaced and can you
please confirm the address is PO Box 31 Free Union VA 22940?

The amount for the refund on the building permit is 80% building fees and 100%of the zoning fee as there were reviews
done and the 2%state surcharge is not refunded.
The refund for the$936 is in the process and should be sent out soon.

Hi Jennifer,
We have received a check from the County made out to Lodestone Build which I believe pertains to the building permit
refund B2019-322SF however the amount differs from the original payment. Our check to the County dated 2/13/2019
was for$1184 but we only received $892 as a refund.
The VESMP plan refund to Lick Mountain LLC that Frank Pohl authorized (see below) has not been received at this point.
Would you mind please following up and letting me know the reason for the amount discrepancy and also confirming
that the Lick Mountain check is still in the system?

STOP WORK ORDER
Owner:
The Department made an inspection of the above noted site based on a complaint we received and found that an area
larger than 10,000 square feet had been disturbed without obtaining a land disturbing permit.
The Department will work with you and your Engineer to obtain the required permits.
Therefore,under§17-902 of the Albemarle County Code,you are hereby notified to immediately cease all land
disturbing activities on the above referenced property(STOP WORK)with the exception of work to address the
installation of erosion control measures,soil stabilization,and any necessary drainage corrections as approved by the
County. A sworn complaint has been made by the Inspector,Jonney Otto,who indicates that grading has taken
place on the above referenced property without obtaining the appropriate permits. This STOP WORK ORDER shall
remain in place for seven(7)days from the date of receipt. If satisfactory repairs have not been made within seven
(7)days,the County may elect to issue another Stop Work Order,and/or petition the Circuit Court for penalties and
relief with regard to this violation.
Required Correction(s):
1. You are hereby required to submit an Ero*on and Sediment Control Plan with Narrative,obtain a VSMP
permit,and Water Protection Application with appropriate fees,to the Albemarle County Department of
Community Development. The plan must be reviewed,approved,performance bond posted in the amount
determined by the plan approving authority,and a Certified Responsible Land Disturber(RLD)named prior to
the Grading Permit being issued.
If you have any questions or concerns with steps necessary to correct this violation,please contact Frank Pohl or
Jonney Otto at 434-296-5832.

Mark,
It was great meeting you today and again my apologies for the sediment flow on to the home owners property.
I'm going to immediately organize to have a land management firm I have worked with to do further work on stopping
the possibility any further sediment flow.To that end I would have them clear out the 30' sediment trail through the
woods on the ISHO property, seed and straw mat the intermittent stream. On my property I will seed and straw the
northern side of the loggers access road, stabilize and reinstate the silt fencing, clear out the other two sediment flows
and seed/straw mat areas.The fact that the intermittent stream was flowing clear today after all the rain we had last
night is encouraging, hopefully we are headed in the right direction. Please feel free to contact me if you have any
further concerns and I'll do my best to address them promptly (my cell 434-2490565).
The or' ' I opersAlity Chisolm, had a plan to divide my property into 6 lots(see attached), with 4 x 2 acre lots
acin pon ea,the original house on 4 acres and then a larger 21 acre parcel. This development would have
involved a commercial road, major storm water planning/implementation etc. with the property becoming a small
subdivision.
My hope is to place the majority of the property under conservation easement, the existing house is under contract and
the remaining property would be split into a 3 acre parcel on Markwood Rd in the North West corner( existing pasture
field) and the remaining 27 acres going under conservation easement such the remaining subdivision rights would be
extinguished in perpetuity. I have placed two other farms of over 100 acres in Free Union into conservation easement in
the last 4 years, extinguishing 13 division rights, I'd like to see the County retain its existing rural nature going forward. I
see the 27 acre property as a horse farm,with perhaps 10 acres under pasture with the remaining area being wooded to
provide a buffer between the existing house and the shed. I'm also giving consideration to leaving a 100' wide buffer of
trees, from the loggers access road down to the ISHO property on the Northern side to further screen the 27 acre parcel
from Markwood rd.
As I indicated to you, we have loggers booked to come in shortly to log an area of between 15 and 20 acres on the north
and eastern sides of the property, unfortunately this is a pretty messy process that will go on for perhaps 2 months.
Once the loggers have finished, the laps will be mulched, the stumps will remain in the ground with the top

soil/vegetation undisturbed and I have contracted to have a firm bring in forestry mulching machines that will grind
down the stumps that will cover the area in wood chips prior to seeding the land ( hopefully around October of this
year).
