The Board of Supervisors approved your rezoning application on December 12, 2007. Your
rezoning from LI Light Industrial to PD-SC Planned Development Shopping Center was
approved in accordance the attached proffers dated December 11, 2007 and signed on
December 12, 2007. An application plan/plan of development dated August 15, 2007 was
approved as part of the rezoning. Please refer to these documents for any future applications
and requests on this property.
Please be advised that although the Albemarle County Board of Supervisors took action
on the project noted above, no uses on the property as approved above may lawfully
begin until all applicable approvals have been received and conditions have been met.
This includes:
. compliance with applicable PROFFERS;
. complains with the applicable APPLICATION PLAN;
. approval of and compliance with a SITE PLAN; and
. approval of a ZONING COMPLIANCE CLEARANCE.

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the Owner hereby
voluntary proffers the conditions listed in this Proffer Statement, which shall be applied to
the Property if the rezoning is approved by Albemarle County. These conditions are
proffered as part of the rezoning and it is acknowledged that the conditions are reasonable.
The development of the Property shall be limited to those uses allowed by right under
Section 18-25.2.1 and those uses allowed by special use permit under Section 18-25.2.2 of
the Albemarle County Code, excepting those by right uses delineated in Sections 18-22.2.1,
18-23.2.1 and 18-24.2.1 listed below, as all of those sections are in effect on December 12
2007, copies of which are attached hereto. The following by right commercial and service'
establishments shall not be permitted on the Property:
(1) The Permitted uses of the property, and/or uses authorized by special use permit,

22.1 INTENT, WHERE PERMITTED
C-1 districts are hereby created and may hereafter be established by amendment to the zoning map
to pennit selected retail sales, service and public use establishments which are primarily oriented
to central business concentrations. It is intended that C-1 districts be established only within the
urban area, communities and villages in the comprehensive plan. (Amended 9-9-92)
22.2 PERMITTED USES
22.2. 1 BY RIGHT
The following uses shall be permitted in any C- I district subject to the requirements and
limitations of these regulations. The zoning administrator, after consultation with the director of
planning and other appropriate officials, may pennit as a use by right, a use not specifically
pennitted; provided that such use shall be similar to uses pennitted by right in general character
and more specifically, similar in tenns of locational requirements, operational characteristics,

23.1 INTENT, WHERE PERMITTED
CO districts are hereby created and may hereafter be established by amendment to the zoning map
to permit development of administrative, business and professional offices and supporting
accessory uses and facilities. This district is intended as a transition between residential districts
and other more intensive commercial and industrial districts.
23.2 PERMITTED USES
23.2.1 BY RIGHT
The following uses shall be permitted in any CO district, subject to the requirements and
limitations of these regulations:
1. Administrative and business offices.
2. Professional offices, including medical, dental and optical.
3. Financial institutions.
4. Churches, cemeteries.
5. Libraries, museums.
6. Accessory uses and structures incidental to the principal uses provided herein. Such uses in
combination shall not occupy more that twenty (20) percent of the floor area of buildings on
the site. The following accessory uses shall be permitted:
-Eating establishments;
-Newsstands;
-Establishments for the sale of office supplies and service of office equipment;
-Data processing services;
-Central reproduction and mailing services and the like;

24.1 INTENT, WHERE PERMITTED
HC districts are hereby created and may hereafter be established by amendment to the zoning map
to permit development of commercial establishments, other than shopping centers, primarily
oriented to highway locations rather than to central business concentrations. It is intended that J-Ie
districts be established on major highways within the urban area and communities in the
comprehensive plan. It is further intended that this district shall be for the purpose of limiting
sprawling strip commercial development by providing sites with adequate frontage and depth to
permit controlled access to public streets.
24.2 PERMITTED USES
24.2.1 BY RIGHT
The following uses shall be permitted in any HC district subject to the requirements and
limitations of these regulations. The zoning administrator, after consultation with the director of
planning and other appropriate officials, may permit, as a use by right, a use not specifically
permitted; provided that such use shall be similar to uses pennitted by right in general character,
and more specifically, similar in terms of locational requirements, operational characteristics
visual impact and traffic generation. Appeals from the zoning administrator's decision shall be a~
generally provided in section 34.0.

25.1 INTENT, WHERE PERMITTED
PD-SC districts are hereby created and may hereafter be established by amendment of the zoning
map to permit the development of neighborhood, community and regional shopping centers in
accordance with standards set forth in the comprehensive plan. PD-SC districts are intended to
serve areas not conveniently and adequately provided with a broad range of commercial and
service facilities. Regulations provided are intended to encourage plmmed commercial centers
with carefully organized buildings, service areas, parking areas and landscaped areas.
PD-SC districts shall be located in areas served by both public water and sewer systems; provided
that neighborhood shopping centers may be pennitted in areas not served by public water and/or
public sewer systems where adequate alternative water supply and/or sewerage disposal systems
are available. PD-SC districts shall have direct access to public streets adequate to accommodate
traffic generated by the development.
25.2 PERMITTED USES
25.2.1 BY RIGHT
1. Uses permitted by right shall include commercial and service establishments permitted by
right in the C-1, CO and He districts. Outdoor storage, sales or display shall be permitted
only when enclosed by appropriate visual screening.
2. Electric, gas, oil and communication facilities excluding tower structures and including poles,
lines, transformers, pipes, meters and related facilities for distribution of local service and
owned and operated by a public utility. Water distribution and sewerage collection lines,

25.4 SITE PLANNING - EXTERNAL RELATIONSHIPS
25.4.1 VEHICULAR ACCESS
Vehicular access points shall be designed to encourage smooth traffic flow with controlled turning
movements and minimum hazards to vehicular and pedestrian traffic. Pavement widths and
strengths of both internal and external roads shall be adequate to accommodate projected traffic
generated from the district.
Primary access shall be provided from roads of adequate available capacity to accommodate
projected traffic, Vehicular access from minor streets through residential neighborhoods shall be
generally discouraged and where pennitted shall be primarily for the convenience of residential
