County Code section 17 -410 and Virginia Code §62.1- 44.15:34 require the VSMP authority to act on any
VSMP permit application by issuing project approval or denial. This project is approved, with rationale
explained below. VSMP application content requirements can be found in County Code section 17 -401.
A. Stormwater Pollution Prevention Plan ( SWPPP)
The SWPPP content requirements can be found in County Code section 17 -405. A SWPPP must contain
(1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary.

B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17 -404.

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25- 870 -108 requires the VSMP authority to approve or disapprove a SWMP.
This plan was initially compared against VSMP requirements, yet proposes a sequence that converts a basin
into SWM wetland cells. The project creates a natural phosphorus- removing aquatic complex of 4 wetland
cells, with no deficit /unmet SWM needs. As such, as this project creates a SWM BMP, though not strictly
exempt from VSMP requirements, there is no point of application for such requirements. Project
characteristics are reasonably sufficient response to SWPPP/PPP requirements that would otherwise apply.
Stormwater management plan content requirements can be found in County Code section 17 -403.

D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1- 44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is approved. The erosion control plan content requirements can be found in County Code section 17 -402.
Silt fence will not keep sediment laden waters from going downstream when the basin fills. A dewatering
strategy is needed, along with a temporary riser on the culvert structure. It appears the entire area will act as a
sediment basin. (Rev. 1) Comment addressed; stream bypass dewatering detail provided.
Increase the limits to include work noted outside the limits on the plan. (Rev. 1) Comment addressed.
Draw realistic limits of disturbance. The hard corners are not realistic, and room is needed to work outside the
wetlands. (Rev. 1) Comment addressed.
The CE is shown over a steep slope, with a turn. Show grading to accomplish this. (Rev. 1) Comment
addressed.
Process:
County - owned, the project will not be bonded. The County will maintain this stormwater management facility,
which is the project. A General VPDES Construction Permit is not required, but project may be subject to data
reporting requirements. ACCD /Engineering encourages OFD to coordinate potential DEQ- related reporting with
General Services, Water Resources Manager, Greg Harper. Wetland complex may earn pollutant removal credits.
Applicant (Albemarle County /OFD) will need to complete a request for a pre - construction conference form. The
form identifies the contractor and responsible land disturber. This will be checked by county staff. Upon approval, a
pre - construction conference will be scheduled with a County inspector. At the pre - construction conference, should
everything proceed satisfactorily, a grading permit will be issued to Albemarle County Office of Facilities
Development (or its designate) so that work may begin.
