HomeMy WebLinkAboutVA200300010 Application 2003-09-25 • MEMORANDUM TO: Members of the Board of Zoning Appeals 7{e-----` FROM: John Shepherd, Manager of Zoning Administration DATE: September 25, 2003 RE: VA-2003-10 Motion for Rehearing Background: On September 2, 2003 the BZA approved this variance with conditions. The variance permitted the demolition of the former Advance Mills Store and the construction of a dwelling in its place. The application included, but the BZA denied, a request to cantilever the northern portion of the proposed building three feet beyond the existing foundation. The applicant has requested the granting of a motion to rehear the request for this three-foot extension. The request and justification is contained in the attached letter from Palmer Burch. The Rules of Procedure adopted on November 15, 2002 by the BZA establish the following criteria for the approval such a request: Motion for Rehearing. Any decision made by the BZA may be reheard upon the granting of a motion for rehearing approved by at least three affirmative votes. 40 A 'j oVGD The motion may be made only after consideration of a written application by the 661 u r ,f.,p pGpGRperson requesting rehearing, which shall be filed within thirty (30) days after the _ date of the BZA's original final decision. The BZA may grant the motion if it 11+0 7b "r finds that the decision has not already been appealed to the Circuit Court and: (1) ab_ 21 2,en>3 new evidence can be presented that, in the opinion of the BZA, is relevant and pecGm material to the decision but could not have been presented at the original hearing; ti evil144G, 4'0 or(2) in the opinion of the BZA, one or more relevant and material conditions or // e1 gyt�j/ situations have changed so as to bear on the BZA's original decision. If the BZA ' i ehi Kie-14"- grants the motion, it shall set the date for rehearing. Notice of the rehearing shall t iNO3 be provided as otherwise required for the matter being reheard. Staff Comment: It is staff opinion that this request should be denied because neither criterion has been met. No new evidence has been presented that could not have been presented at the original hearing. No conditions or situations have changed so as to bear on the original decision. This approval is subject to the following conditions: 1 . Applicant shall provide a measured drawing showing the existing foundation including the wall between the garage bay and the feed room and the limits of the front porch prior to the demolition of the building. 2. This approval is for a new dwelling, comparable to that described in the application, with the following conditions: a) The new dwelling may be constructed on the existing foundation or within the same location as the existing foundation of the store, restroom, garage and feed room. b) A new deck and walkway may be constructed at the northwest corner of the building. The deck shall project no more than three feet beyond the northern foundation wall and no more than five feet beyond the western foundation wall. To clarify the modifications made at the meeting, you would be permitted to construct a second floor above the existing garage and feed room on the existing foundation.
