There is no description of the property for which this variance is requested filed in any Deed Book or Plat Book in Albemarle County; hereinafter referred to as "T.L. Beasley's Store." This is because T.L. Beasley's Store was recently severed from a larger property described in a deed at Book 276 Page 105 (1946) and a plat at Book 485 Page 468 (1971) through the lawsuit in Albemarle County captioned R. Keith Goolsby et al v. The Quarries, LLC et al vv •vv a♦ua sys v.a. V11L1\ 1LL Will Vl\.11L .EJ regarding Tax Parcel 126-34 (2002). A copy of the aforementioned deed, plat and quitclaim deed filed in the lawsuit are attached as exhibit 1 for reference. Contact Person, Brenda Moon, obtained a Composite Plat of T.L. Beasley's Store, a copy of which is attached as exhibit 2. 2. Missing from exhibit 2, the Composite Plat of T.L. Beasley's Store, is the dimension of T.L. Beasley's Store building which has been on the property since at least 1946. The dimensions are missing from the Composite Plat because T.L. Beasley's Store building was partially burned sometime between 2000 and 2001 . The footprint of T.L. Beasley's Store building still exists through its foundation. T.L. Beasley's Store building is recognized by the Albemarle County Department of Finance as reflected in the attached Albemarle County tax bill, exhibit 3 . Although the ruins of the burnt building will be removed from the property, the foundation still exists. 3 . Applicant requests the right to rebuild T.L. Beasley's Store building as an antique store with the potential for a future residence. According to P. Massie Saunders, Jr., the surveyor who prepared the Composite Plat in exhibit 2 ("surveyor"), Applicant is allegedly unable to rebuild T. L. Beasley's Store because of zoning "set back" regulations and the shape and size of the property. If this allegation is untrue, please advise Applicant. This application is submitted based solely on surveyor's allegations. 5. Applicant believes this application is justified based on the following: T.L. Beasley's Store existed at least since the 1940's as a gas station and convenience/grocery store. Although the then zoning regulations permitted this structure to be built and used as such, during the 1970's or 1980's the then "owner" T.G. Beasley (a holder of a life estate from T.L. Beasley), stopped providing commercial services and converted the store portion of the building to a residence. Some time during the last half of the 20th Century, applicant believes the zoning regulations changed. Shortly after T.G. Beasley's burned down store and constitutes undue hardship. The current owners and prospective owner (Applicant/Contact Person Brenda Moon) will suffer hardships not shared by other property owners in the zoning district and vicinity since unliM neighbor property owners T.L. Beasley's Store wasVortio4sly burned down by some unknown person. If the building had not burned down, it would not require rebuilding and would not be limited by the zoning rules. Granting Applicant's Variance will not detriment the character of the district.
