Perez Subject: Revised Covenants and Restrictions Document_Whittington Subdivision Greg, I received a call from Alex Perez of Whittington Subdivision seeking a status update of the revised Covenants and Restrictions document. We received the revised Covenants and Restrictions document via email from Pete on October 3rd, I provided some additional minor comments to you on October 4 (see below). Per all my records it does not appear that I have received County Attorney approval on this document. Please provide a status update when you get a chance. Thanks Christopher P. Upon a brief review by planning staff it appears sections of the document do not coincides with the i table of contents,page numbers are oft as are sections missing...etc For example: 1) Exhibit C is not listed in the table of contents; however, it is a part of the document (page 38) 2) Section 11 Successor Declarant, is missing from the table of contents; it is a part of the document(page 32) 3) Exhibit B is listed in the table of contents as page 36; however, in the document it's truly found on page 37. 4) Exhibit A is listed in the table of contents as page 35; however, in the document it's truly found on page 36. There may be more errors, I did not do a thorough review of that aspect of this document. Chris noted in his final review of the declaration a couple of discrepancies between the declaration and the plat which I am passing on to you: 1. Page 1,under Recitals A , the declaration lists the plat as: "A. The Declarant is the owner of certain real property...known as Lots 1 through 4, 48 through 59, and 86 inclusive, Whittington Subdivision (the "Declarant Property'), as shown on and created by the subdivision plat dated April 23, 2013, attached hereto as Exhibit A, entitled "Subdivision and Consolidation Plat of Whittington Subdivision, Phase A, TMP 90 Parcels 3, 45, 46, 47, 48 and TMP 89 Parcel 95, " and prepared by Dominion Engineering (the "Subdivision Plat") and recorded herewith among the land records of Albemarle County, Virginia (the "Land Records'). " Also, page 5, Article II, under Section 1. refers to "Lots 1 through 4, 48 through 59, and 86, inclusive" Please note that the plat only sets to record Lots 1 —4, 48— 50, and lots 77—86. 2.
