HomeMy WebLinkAboutSE202200061 Correspondence 2022-10-20 (3)DocuSign Envelope ID: E6AOFi D3-0178-43F5-8857-7B971E77113F Landlord Site: Western Albemarle HS Tenant Site: VA72576A Western Albemarle FIRST AMENDMENT TO DEED OF TOWER LEASE AGREEMENT THIS FIRST AMENDMENT TO DEED OF TOWER LEASE AGREEMENT (this "Amendment') is ") is effective the date of the last signature on this Amendment by and between Milestone Tower Limited Partnership - IV, a Delaware limited partnership ("Lessor") and Sprint Spectrum Realty Company, LLC, a Delaware limited liability company ("Lessee"). Recitals A. Lessor and Lessee entered into that certain Deed of Tower Lease Agreement dated February 2812019 (the "Tower Lease") pursuant to which Lessor leased to Lessee space for Lessee's Antenna Facilities on the Premises located at 5941 Rockfish Gap Turnpike, Crozet, VA 22932. (the "Pro a "). B. Lessor and Lessee desire to amend the Tower Lease on the terms and conditions set forth in this Amendment. Agreement NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1. Amendments. (a) Rent Increase: Effective on the earlier to occur of (i) sixty (60) days after the Effective Date, or (ii) the First day of the First calendar month after the Equipment Modification at the Premises commences, the annual rent payable by Lessee to Lessor under the Agreement shall be increased by Five Thousand Forty and no/100 Dollars ($5,040.00) per year, to be paid in equal monthly installments of Four Hundred Twenty and no/100 Dollars ($420.00) per month. The additional annual rent shall be subject to annual rent increases in accordance with Section 3.a of the Agreement. The parties acknowledge and agree that the increased rent payment(s) may not actually be sent by Lessee until thirty (30) days after the rent increase effective date. Lessor and Lessee agree to execute a written acknowledgment confirming the rent increase effective date. (b) Exhibit B to the Tower Lease describes the equipment compromising Lessee's Antenna Facilities on the Premises, and is hereby deleted in its entirety and replaced with Exhibit 13-1 attached hereto. 2. Miscellaneous. Except as set forth in this Amendment, the Tower Lease remains unchanged and is in full force and effect. This Amendment may be signed in counterparts. Capitalized terms used herein and not otherwise defined shall have the respective meanings set forth in the Tower Lease.
