Wayne Cilimberg, Director of Planning and Community 6/ Development DATE: June 30, 1993 RE: Albemarle County Service Authority (ACSA) Jurisdictional Area Amendment for Gordon T. Ford - Tax Map 59 , Parcels 80 and 80C This item will be before you as a public hearing on July 7, 1993 . Enclosed is the original report (Attachment A) on this matter and subsequent information regarding the request. Water is requested for existing structures only on the two parcels (house and cottage on Parcel 80 and tenant house on Parcel 80C) . The Albemarle County Service Authority has commented on the availability of public water. ( see Attachment B) The Department of Engineering has commented on the reliability of the current water source and the corresponding level of maintenance necessary. ( see Attachment C) Staff offers two alternatives in response to the request: 1 . Delay amending the jurisdictional area until the current system is no longer acceptable from a quality/quantity standpoint. This will necessitate continued (and likely expensive) maintenance of the system; or 2 . Amend the jurisdictional area to allow public water to existing structures only on Parcels 80 and 80C. Staff believes the effect of amendment to the jurisdictional area on the intent of the Comprehensive Plan is minimal. No additional development will result from such a change and, in fact, Parcel 80C is under a conservation easement with the Albemarle County Board of Supervisors June 30, 1993 Page 2 Virginia Outdoors Foundation. (see Attachment D) Based on the comments of the Department of Engineering and the practicality of maintaining the existing system, staff recommends approval of this jurisdictional area request (water only to existing house and cottage on Parcel 80 and water only to the existing tenant house on Parcel 80C) . Ford Tax Map 59 Parcels 80 & 80C The applicant, Gordon T. Ford, requests Jurisdictional Area designation for water only to existing structures . The request is for service to three units - the main house, a cottage and a tenant house - on Tax Map 59 , Parcels 80 and 80C ( the Knickerbocker Estate) . The applicant sites a history of quantity and quality problems and numerous attempts to deal with the problem which have been and continue to be expensive. Documentation has been provided by the applicant to verify these problems . There have been recent problems with high iron content, coliform bacteria and pump break-downs which have been addressed. The applicant' s concern and basis for request is questionable long term reliability of the supply (both for quantity and quality) and continuing maintenance costs. Public Water is available along U. S. Route 250 West (adjacent to this property) out to the Christian Aid Mission. Numerous parcels in this area, both within and outside of the Urban Area, have jurisdictional area designation for water service. Some properties , such as The Kearsarge subdivision to the west, were granted jurisdictional area designation for water only due to significant water quantity problems. According to the applicant, the subject property is under a Conservation Easement to the Virginia Outdoor ' s Foundation and is not intended for further development. Staff has found that Parcel 80C only is under such an easement. I Albemarle County Board of Supervisors Page 2 May 26 , 1993 COMPREHENSIVE PLAN This parcel is located in the Rural Areas as designated by the Comprehensive Plan. Regarding provisions of public utilities , the Comprehensive Plan is intentionally specific in objective and strategies as to where and under what circumstances public utilities should be made available (p. 146 ) : OBJECTIVE: Provide public water and sewer services to the Urban Area and Communities . STRATEGIES: • Follow the boundaries of the designated Growth Areas in delineating jurisdictional areas . • Only allow changes in jurisdictional areas outside of designated Growth Area boundaries in cases where the property is : ( 1 ) adjacent to existing lines ; and ( 2 ) public health or safety is endangered. Further , the Comprehensive Plan warns that "such utilities are not to be extended to the Rural Areas as these services can increase development pressures" (p. 146 ) . This request appears to be most closely related to the second strategy listed above . The applicants have indicated quantity and quality problems, and the associated efforts and costs in addressing these problems , in supporting documentation. RECOMMENDATION As a general policy, staff has advised that public utility capacities should be reserved to support development of designated growth areas . Past actions by the Board have typically been to limit utility service outside the designated growth areas . However, where properties have experienced quality/quantity problems and are adjacent to existing lines , the Board has in certain circumstances granted jurisdictional area designation for water only to existing structures . Staff would recommend proceeding to public hearing for water only to existing structures for Tax Map 59 , Parcels 80 and 80C based on the documented problems. Planning staff will verify facts and have the Engineering Department review technical documentation for any comment regarding its content before the public hearing. VWC/blb cc: Gordon T. Ford Bill Brent Jack Kelsey • 3098 Ivy Road Charlottesville, VA 22903 May 4, 1993 Mr. Wayne Cilimberg 401 McIntire Road Charlottesville, VA 22901 Dear Mr. Cilimberg: This letter is in reference to our conversation in which I stated a need for approval in hooking up to the public water system. In 1958 the Knickerbockers had Sydnor Hydrodynamics of Richmond attempt to drill a well at Windsor Hill on the top on the hill somewhere near the main house. As you can see from the attached well report the well was 357.5 feet deep and was dry. At this time it was determined that the next best location for a well was at the bottom of the hill. In 1990 C.R. Moore drilled a new well for us because the old one ran dry. This was at a cost of $5,736.04. There is a difference of 110 feet elevation between the house and the location of the well. This has caused many of the problems we deal with on a regular basis. In addition, the water has a very high iron content which required the installation of a filtering system, water softener and an air injection system. Due to the elevation difference these had to be an industrial grade, to support the pressure required to operate the houses, making them quite costly($8,743.45). In addition we had to pay a plumber to install this. In 1991 we discovered that coliform bacteria had entered the system and was at unsafe levels. The system, which also consists of a 30,000 gallon reservoir had to be drained, sanitized and repaired in hopes that this would stop the invasion of the bacteria. The cost of this was $8,096.00. The system is so far from the houses that 2, 19 gallon a minute, 3HP pumps are required to feed the system. These were replaced at a cost of approximately $1,400 each by C.R. Moore around 1987 and in 1990 one of these had to be replaced. (I was unable to acquire a copy of a statement for this.) This is only a brief accounting of the upkeep and problems we constantly deal with. As you can see from what I have outlined above, costs for upkeep on this system have been exorbitant. Currently we are faced with another bill for repairs of $1,198. We were able to reduce this charge by buying the parts and using a local plumber. This is not always possible since this is an industrial system. We have no indication that the cost of upkeep will ever decrease. We are always worried about the bacteria content , and iron levels in the water and the health risk they pose for us and the tenants of the property. The system is not very dependable. We have found ourselves out of water due to pump malfunctions, filter malfunctions, power outages etc. We have even had the saline in the water softener back up into the drinking system, once being on Christmas when the home was FULL of guests and a day when repairmen are hard to come by. Most importantly the water source for the main house and the cottage are not located on the 9 .25 acre property which is owned by G. T. Ford. The well we have been discussing, here within, is located on property still owned by K. K. Knickerbocker. This could pose problems in the future. We would like to also request the tenant house on V T Mr. Knickerbocker's property be included in this request for hookup to the public system. That house is also fed by the same system and faces the same problems and health concerns. Attached you will find all available copies of bills for repairs for the system as proof of the information I have given in this letter. I am enclosing these from 1985 to current. I am doing this because these are the ones I have dealt with during my employment with the Knickerbockers and I would be able to best explain these to you. I am quite sure there are many before the dates I am including. The amounts I quoted in this letter are approximate and you can see the actual amounts on the actual bills. Kelsey, PE - Civil Engineer II" DATE: June 25, 1993 RE: ACSA Jurisdictional Area Amendment Request; Tax Map 59 - 80 & 80C The intent of the above referenced jurisdictional amendment is to provide public water service only to the three connections to the existing central well. As requested, this Department has reviewed the technical documentation of the amendment. This water system is not the "typical or standard" system one would expect to serve three connections. The depth of the well and elevation difference, between the well and the connections, required the installation of larger than normal pumps that provide a higher working pressure and more stress on the system. In addition, the nature of the groundwater source required the installation of filtering, air injection, and water softening systems to provide water of acceptable quality. Domestic well water systems, such as these, are closed systems. Once disinfected, these systems will remain clean, as long as the source is not contaminated and the system remains closed. Each time the systems are opened to conduct repairs, they are exposed to potential contamination. Central water systems require routine inspection, periodic maintenance, and a certain amount of operation costs are expected. However, the frequency and extent of the maintenance that has been required on this system, makes this Department question the reliability of this system to operate and provide water of acceptable quality. According to the apllicant's documentation, the first well attempted at this site turned up dry. The second well was productive, but eventually went dry. Based on this information, this Department questions the ability of the present well to provide an adequate source of water in the future. This Department is satisfied that the unreliability of the present well system, to provide water of acceptable quantity and quality, has been demonstrated. Since the interest of public health and safety would be best served by connecting these three dwellings to public water, the Engineering Department recommends approval of this jurisdictional amendment. The single family dwelling shall be located at least 500 feet south of the stream and pond and at least 500 feet wast of Parcel B. No other buildings or related structures shall be located outside such area, except for existing buildings and structures and structures which are necessary to support and maintain farming as contemplated in paragraph 2(d) above. Access to this area for a single family dwelling shall be limited, to the extent practical, to the existing farm road lying to the west and south of Parcel C. This existing farm road currently provides access to U.S. Route 250 for the farm tenant dwelling. At the time the single family dwelling is constructed, the farm road shall be extended in a southerly direction at or about a point just west of the Water line, as shown on the Plat, so that the farm road branches off and runs in a southerly direction across the stream, toward the single family dwelling. This branch of the farm road shall be of a similar type and width as the existing farm road, shall at no point be closer than 500 feet to Parcel B, and shall be laid out in such a way so as to minimize its impact on the conservation values of the Property. Any bridge which may need to be constructed over the stream shall, to the extent practical, be designed and constructed in such a manner so as to minimize its impact on the conservation values of the Property. To accomplish the purpose of this Easement the following rights are conveyed to Grantee: (a) Grantee may prevent any activity on or use of the Property that is inconsistent with the purpose of this Easement and to require the restoration of such areas or features of the Property that may be eamaged by any inconsistent activity or use. (b) Representatives of the Grantee may enter the Property from time to time for the purpose of inspection and enforcement of the terms of this Easement but only following receipt of permission from or after reasonable notice to Grantors • (or to such other person as Grantors may designate in writing to Grantee) of the intended entry. 5. Access. Although this easement in gross will benefit the public in the ways recited above by encouraging and requiring elements of good land management, nothing herein shall be construed to convey a right to the public of access or use of the Property, and the Grantors, their heirs, successors and assigns shall retain exclusive right to access and use. 6. Acceptance. Acceptance of this conveyance by Grantee is authorized by Section 10.1-1801 of the Code of Virginia (1950) , as amended, and is evidenced by the signature of its authorized representative to this Easement. Grantee acknowledges receipt of all data provided by Grantors to establish the condition of the Property at the time of the conveyance. Grantee, by acceptance ' • of this Easement has agreed to become the custodian of such data. 7. Extinguishment. If circumstances arise in the future • such as render the purpose of this Easement impossible to accomplish, this Easement can only be terminated or extinguished, whether in whole or in part, by judicial proceedings in a court of competent jurisdiction, and the amount of the proceeds to which Grantee shall be entitled, after the satisfaction of prior claims, fro■ any sale, exchange, or involuntary conversion of all or any portion of the Property subsequent to such termination or extinguishment, shall be determined, unless otherwise provided by Virginia la', at the time, in accordance with paragraph 7. 1. Grantee shall use all such proceeds in a manner consistent with the conservation purposes of this grant. 7. 1 proceeds. This Easement constitutes a real rroperty interest immediately vested in Grantee, which, for the -4- . . , CIO purpose of paragraph 7, the parties stipulate to have a fair market value determined by multiplying the fair market value of the Property unencumbered by the Easement (minus any increase in value after the date of this grant attributable to improvements) by the ratio of the value of the Easement at the time of this grant to the value of the Property, without deduction for the value of the Easement, at the time of this grant. The values at the time of this grant shall be those values used to calculate the deduction for federal income tax purposes allowable by reason of this grant, pursuant to Section 170(h) of the Internal Revenue Code of 1954, as in effect at the time of this grant. 8. 8.0sianment. This Easement is transferable, but Grantee may assign its rights and obligations under this Easement only to an organization that is a qualified organization at the time of transfer under Section 170(h) of the Internal Revenue Code of 1954 , as amended (or any successor provision then applicable) , and the applicable regulations promulgated thereunder, and authorized to acquire and hold conservation easements under Section 10. 1-1702 of the Code of Virginia (or any successor provision then applicable) . As a condition of such transfer, Grantee shall require that the conservation purposes that this grant is intended to advance continue to be carried out. 9. subsequent Transfers. Grantors agree to incorporate the terms of this Easement in any deed or other legal instrument by which they divest themselves of any interest in all or a porticn of the Property, including, without limitation, a leasehold interest. The failure of Grantors to perform any act required by this paragraph shall not impair the validity of this Easement or limit its enforceability in any way. 10. General Provisions. (a) Controlling Law. The interpretation and performance of this Easement shall be governed by the laws of the Commonwealth of Virginia. (b) Liberal Construction. Any general rule of construction to the contrary notwithstanding, this Easement shall be liberally construed in favor of the Grantor to effect the purpose of this Easement and the policy and purpoce of The Open Space Land Act of 1966. If any provision in this instrument is found to be ambiguous, an interpretation consistent with the purpose of this Easement that would render the provision valid shall be favored over any interpretation that would render it invalid. (c) Severability. If any provision of this Easement, or the application thereof to any person or circumstance, is found to be invalid, the remainder of the provisions of this Easement, or the application of such provision to persons or -5- s c, circumstances other than those as to which it is found to be invalid, as the case may be, shall not be affected thereby. (d) Entire Agreement. This instrument sets forth the entire agreement of the parties with respect to the Easement and supersedes all prior discussions, negotiations, understandings, or agreements relating to the Easement, all of which are merged herein. (e) No Forfeiture. Nothing contained herein will result in a forfeiture or reversion of Grantors' title in any respect. (f) ,joint Obligation. The obligations imposed by this Easement upon Grantors shall be joint and several. (g) Successors. The covenants, terms, conditions, and • restrictions of this Easement shall be binding upon, and inure to • the benefit of, the parties hereto and their respective personal . ' representatives, heirs, successors, and assigns and shall continue as a servitude running in perpetuity with the Property. (h) Captions. The captions in this instrument have been inserted solely for convenience of reference and are not a part of this instrument and shall have no effect upon construction or interpretation. (i) Notice.
