The Planning Commission staff report, action letter, and minutes are attached (Attachments A, B, and C). DISCUSSION: The Planning Commission raised no objections to SP202100015, but asked questions about the possibility of co -location of personal wireless service facilities on the new transmission poles. (These facilities were not designed for such co -locations.) No members of the public spoke at the public hearing on this proposal. The County Attorney's Office has prepared the attached Resolution to approve the special use permit. RECOMMENDATIONS: Staff recommends that the Board adopt the attached Resolution (Attachment D) to approve SP202100015, subject to the condition contained therein. CHARACTER OF SURROUNDING AREA The surrounding area includes a variety of large forested parcels, open grazing land, and rural residential parcels. PLANNING AND ZONING HISTORY No relevant history. The current utility facility is an existing non -conforming use and requires a special use permit for the proposed upgrade. DETAILS OF THE PROPOSAL The proposed project is a portion of a planned upgrade of an existing electrical transmission line that connects the Midway substation to the Martin's Store substation in Nelson County. The existing wooden H-poles (60 to 70 feet in height) are nearing the end of their useful life, and would be replaced with steel monopoles (70 to 95 feet in height) within the same right-of-way. The portion proposed on this application extends southward from the Midway substation, along the existing right-of-way. While the current proposal does not extend along the entire length of the right-of-way, stopping at the southern end of the property where the Midway Solar utility -scale solar -generating use was recently approved (SP202100001), future phases will continue to the far end of the right-of-way (as the applicant's funding permits). (The output from the Midway Solar facility will not use the transmission lines proposed in this permit request, but will connect directly to by -right local distribution lines.) See Attachment 2 for the application narrative and pole illustrations. See Attachment 3 for the conceptual plan. One nearby family attended the meeting No significant concerns or objections were expressed. A video recording of the community meeting can be found by clicking HERE. ANALYSIS OF THE SPECIAL USE PERMIT REQUEST This special use permit, and all special use permits, are evaluated for compliance with the provisions of Chapter 18, Section 33.40b of the Code of Albemarle. Each provision of that section is addressed below. The provisions of the ordinance are in bold font and underlined. No substantial detriment. The proposed special use will not be a substantial detriment to adjacent lots. The replacement of H-poles with taller monopoles within the existing right-of-way is not expected to cause a substantial detriment. Construction impacts will be limited and temporary, as the monopoles are the only structures needed. Staff opinion is that the proposed use would not be a substantial detriment to adjacent parcels. Character of the nearby area is unchanged Whether the character of the adjacent parcels and the nearby area will be changed by the proposed special use. A utility corridor with H-poles and power lines already exists in this area. New monopoles in the same corridor are not expected to change the character of the area. Three parcels along the right-of-way (Tax Map 71 Parcel 26; Tax Map 85 Parcel 21, 21D1, 22B) are under a conservation easement. This is an ACE easement held by the County and by the Albemarle Conservation Easement Authority. However, the utility right-of-way predates those conservation easements, and the utility has the right to maintain and upgrade its facilities within that right-of-way. Seven parcels along the right-of-way (Tax Map 71 Parcels 26, 26C, 27A, 29H, 29I; Tax Map 85 Parcels 21, 22B) are enrolled in the Batesville Agricultural -Forestal District. Given the fact that the utility right- of-way predates that district, and that the replacement of existing poles on those parcels is not expected to reduce access to land for agricultural purposes or impact agricultural resources, staff does not anticipate any impacts to the District. Staff consulted with the Chairman of the Agricultural -Forestal Districts Committee, who agreed that the impacts on the District of a pole -replacement project were not significant. Harmony, Whether the proposed special use will be in harmony with the purpose and intent of this chapter, Section 1.4(D) of the Zoning Ordinance states that one of the purposes of the Ordinance is to: "Facilitate providing adequate police and fire protection, disaster evacuation, civil defense, transportation, water, sewerage, flood protection, schools, parks, forests, playgrounds, recreational facilities, airports and other public requirements; " The applicant has stated that the "existing 115 kV transmission line is 40+ years of age and needs to be replaced due to deterioration of the wood poles and wood cross -arms. The transmission line is a radial feed to four other substations serving almost 6,750 customers, including the Wintergreen Resort area. CVEC has had several outages within the past three years which affected all 6,750 customers. Harmony, ...with the uses permitted by right in the district Public utilities are in harmony with and supportive of agricultural and residential uses in the district. Harmonp....with the regulations provided in section 5 as applicable, 5.1.12 PUBLIC UTILITY STRUCTURESMSES a. The proposed use at the location selected will not endanger the health and safety of workers and/or residents in the community and will not impair or prove detrimental to neighboring properties or the development of same; The proposed replacement poles are within the existing transmission corridor. No new use is proposed. b. Public utility buildings and structures in any residential zone shall, wherever practical, have the exterior appearance of residential buildings and shall have landscaping, screen planting and/or fencing, whenever these are deemed necessary by the commission; In addition, trespass fencing and other safety measures may be required as deemed necessary to reasonably protect the public welfare; In cases of earth -disturbing activity, immediate erosion control and reseeding shall be required to the satisfaction of the zoning administrator; These measures are not necessary, as no buildings or structures other than the replacement monopoles are proposed. Earth -disturbing activity will be minimal, as only pole bases will be required. c. Such structures as towers, transmission lines, transformers, etc., which are abandoned, damaged or otherwise in a state of disrepair, which in the opinion of the zoning administrator pose a hazard to the public safety, shall be repaired/removed to the satisfaction of the zoning administrator within a reasonable time prescribed by the zoning administrator; The existing poles will be removed as part of the replacement process. d. In approval of a public utility use, the commission shall be mindful of the desirability of use by more than one utility company of such features as utility easements and river crossings, particularly in areas of historic, visual or scenic value, and it shall, insofar as practical, condition such approvals so as to minimize the proliferation of such easements or crossings, as described by the comprehensive plan. No new stream crossings are proposed, as the new poles would remain within the existing corridor. In some cases, construction access to the pole locations will require temporary stream crossings within the existing corridor. The proposed crossings would be temporary and would use bridge mats that rest on the stream banks and keep vehicles and equipment out of the streams themselves. Provision of upgraded power -transmission lines can increase general welfare by ensuring more consistent service during periods of high demand. Consistencv with the Comprehensive Plan. The use will be consistent with the Comurehensive Plan. The Rural Area chapter of the Comprehensive Plan includes goals for protecting agricultural and forestal economies, as well as natural resources. As this proposal involves an existing utility corridor that would not change or expand, the availability of the corridor for grazing is unchanged. (Forestry is not possible in electric corridors, because vegetation below the lines must remain low enough not to interfere with the lines.) Also, because the decades -old corridor is not expanding, the natural -resource impacts are limited to temporary construction work. Staff feels that the proposal does not conflict with the Comprehensive Plan. SUMMARY Staff has identified the following factors favorable to this proposal: 1. The utility -line upgrade would increase electrical -service reliability without increasing physical impacts or widening the existing utility corridor. Staff has identified no unfavorable factors for this proposal: RECOMMENDED ACTION for SP Based on the findings contained in this staff report, staff recommends approval of SP202100015 Midway - Martin's Store 115 kV Transmission Line with the following condition. 1. This upgrade will increase the reliability of the CVEC system. The transmission line is a radial feed to four other substations serving almost 6,750 customers, including the Wintergreen Resort area. CVEC has had several outages within the past three years which affected all 6,750 customers. • How the special use will not be a substantial detriment to adjacent lots CVEC will be rebuilding an existing 115 kV Transmission Line from the CVEC Midway Substation southwest approximately 3.85 miles with using approved entrances. No impacts to adjacent lots will occur. • How the character of the zoning district will not be changed by the proposed special use, and how the special use will be in harmony with the following; o The purpose and intent of the Zoning Ordinance, o the uses permitted by right in the zoning district The transmission line falls within the Rural Areas zoning classification and within the "Rural Area 3 " of the Comprehensive Plan per the httns://gisweb.albemarle.org website. The utility is a permitted use by right in the zoning district and the rebuild project will be in harmony with the intent of the Ordinance. o the regulations provided in Section 5 of the Zoning Ordinance as applicable Chapter 5 Building Regulations of the Albemarle County Code of Ordinances does not apply to this project. Please see "Consistency with Comprehensive Plan" section below.. o the public health, safety and general welfare. Per the USDA's RUS website, "providing reliable ... electricity is essential to sustaining the economic well-being and quality of life for all the nation's rural residents. " Replacing a deteriorated line protects the public by avoiding downed powerlines and dangerous accidents as well as keeping the power on to the homes 11 P a g e * Booth & Associates and businesses whose residents need reliable electricity to ensure their safety and comfort in day-to-day life. Consistency with the Comprehensive Plan This rebuild project falls in line with the spirit of the Comprehensive Plan which discusses the future of the county zoning and planning efforts. Objective 10, Strategy l0a (ACP, 5-53) of the Comprehensive Plan ensures the "adequate provision of electricity... to support existing and anticipated development in the County through coordination with utility companies. " Strategy 8c (ACP, 5.19) outlines corridor guidelines for utilities, however a transmission line Right of Way requires the area to be free of large trees and bushes to maintain safety for the general public, avoid damage to the energized line and to ensure reliable power and does not apply to this situation. (ACP, 5-19). Impacts on Public Facilities and Public Infrastructure Properties surrounding the transmission line are rural with a mix of vacant, residential, farmland, hunting property, etc. All right of way is clear with a mix of maintained fields. No disruptions to traffic are anticipated. CVEC is working with property owners to determine access to their right of way and will make arrangements with impacted landowners. Multiple access points will be utilized along the transmission route as designated on the attached sketch plan. The majority of the work will take place Monday through Friday from 7: 00 am to 5: 00 pm. Some work may occur outside those hours as needed, such as to complete a phase of construction that would be impractical or dangerous to stop mid process, or in an effort to reduce impacts to customers, such as taking outages. Impacts on Environmental Features No impacts are expected from the proposed project due to the work being performed in an existing Right -of -Way. The design will avoid sensitive areas, and matting will be utilized for any work in a wetland or sensitive area. All work will be performed with a rubber -tracked vehicle throughout the project length. Existing right of way includes multiple overhead crossings of Mechums River, Dollins Creek and other unnamed tributaries lying with the Upper Mechums River Water Supply Watershed. Most of the proposed pole locations are accessible through existing dirt roads and access points avoiding waterbodies; other pole locations will be accessed through private properties and direct access from roads. CVEC is working with property owners to determine access to the work areas if not accessible directly from the DOT road. If any waterbodies are to be crossed, bridging and matting following the standard erosion and sedimentation control measures will be employed. The existing Right -of -Way is maintained and eliminates the need for clearing along the project area. Narrative should address plans for vegetation management in the corridor. Another SP recently approved by the Board included requirements (in line with that utility's plan) to apply Integrated Vegetation Management (IVM) within the corridor rather 5 1 P a g e * Booth & Associates than moving/clearing. If possible, we would recommend that this proposal also include the use of IVM. Central Virginia Electric Cooperative (CVEC) performs extensive work each year to cut and maintain rights -of -way for new and existing electric lines along its 4,500-mile system utilizing Integrated Vegetation Management (IVM). Well -maintained rights -of -way are essential to providing reliable and safe electric service as well as ideal habitats for wildlife and low -growth vegetation. In December 2019, CVEC was awarded a "Habitat Partners© Certificate "from the Virginia Department of Game and Inland Fisheries (DGIF) for work done to maintain their rights -of -way. The Certificate is awarded as part of the DGIF's Corporate Habitat program and is open to businesses and industries interested in habitat improvement projects on their lands which will make a substantial contribution to the welfare of wildlife communities. CVEC was awarded the certificate for recognition of their large-scale habitat management efforts in its rights -of -way to control invasive exotic species, minimize mowing and herbicide applications, and promote the growth of native perennial f owers, grasses, and sedges, which support a great diversity of wildlife species such as pollinators and quail. In an effort to protect milkweed plants and honeybee hives in/near the rights -of -way, CVEC uses its vegetation management software to map areas where the plants or hives are located, ensuring they are not disturbed by crews or contractors working in the area. CVEC also made use of its vegetation management system to remove trees that are crowding and shading plants vital to pollinators, including milkweed — the Monarch butterfly plant of choice. CVEC's vegetation management efforts promise positive results for both the environment and CVEC's service reliability. CVEC invests more than $2.5 million annually in its vegetation management system in order to increase reliability for its members and to remove danger trees from areas near the electric lines. Clearing the rights -of -way also allows safe access for CVEC linemen and trucks if the power needs to be restored or lines need to be repaired or upgraded. Need for Upgrade and increased pole/wire height This transmission line project does not include a capacity upgrade. The existing conductor is 336 ACSR and the new conductor will remain 336 ACSR. The transmission line project is an upgrade to the poles only. The existing 115 kV transmission line is 40+ years of age and needs to be replaced due to deterioration of the wood poles and wood cross -arms. The transmission line is a radial feed to four other substations serving almost 6,750 customers, including the Wintergreen Resort area. CVEC has had several outages within the past three years which affected all 6,750 customers. Rebuilding the existing 115 kV transmission line will provide a substantial increase in reliability to the customers served. The existing 115 kV Transmission Line is constructed with wood poles on an H-frame construction primarily near the west side of the CVEC easement. The existing 115 kV poles range in height 7 1 P a g e * Booth & Associates from 60' to 70'. The new 115 kV Transmission Line to replace the existing transmission line will be a single pole design on ductile iron poles with vertical construction and a three-phase distribution underbuild. Ductile iron poles are resistant to woodpeckers, insects, and rot, and has a weathered Natural Finish, which is bare iron and looks similar to a wood pole finish. The new 115 kV poles will range in height from 70' to 95'. There will be one 100' pole to be buried approximately 15' and having a final height of 85'. The existing 115 kV H frame transmission line will be removed once the new line is constructed. The new 115 kV single pole transmission line will be constructed near the center of the existing 150' CVEC easement. No additional easement will be required. Therefore, due to going from a two pole structure with flat construction on cross -arms to a single pole structure with vertical construction and underbuilding the distribution on the transmission line, the new poles require additional height to maintain proper clearances. The single pole construction will cleanup the transmission line and easement by reducing the overall number of poles required and make the visual impact much more pleasant. 2. Reasons for addressing only a portion of the corridor CVEC will be rebuilding an existing 115 kV Transmission Line from the CVEC Midway Substation southwest approximately 3.85 miles. The 3.85 miles is approximately 113 of the total distance of the transmission line from the Midway substation to the Martins Store substation. This 113 of the transmission line was chosen to start due to cost and the CVEC overall budget. CVEC plans to continue rebuilding this transmission line all the way to Martins Store in the next phase which is planned to begin in 2024. As a result, if possible, CVEC would want this Special Use Permit to include all the transmission line corridor remaining in Albemarle County. Otherwise, the eventual application will cover the entire corridor within County. 3. The project's relationship to the recently -approved Midway Solar project, if any, and the reasons for ending this portion of the upgrade at the Midway Solar Site. There is no relationship between the 115 kV transmission line and the recently - approved Midway Solar Project. The Midway Solar Project will not interconnect to the CVEC 115 kV transmission line. The 115 kV transmission line rebuild will end just south of the Midway Solar Project. The reason to stop the project at this location was three fold. Call to Order and Establish Quorum Ms. Firehock said the meeting was being held pursuant to and in compliance with Ordinance No. 20-A(16), "An Ordinance to Ensure the Continuity of Government During the COVID-19 Disaster." She said opportunities for the public to access and participate in the electronic meeting were posted at www.albemarle.org/community/county-calendar when available. She said there would be further instruction for public comment during public hearings. Ms. Shaffer called the roll. Ms. Firehock established a quorum. Other Matters Not Listed on the Agenda from the Public There were no speakers. Consent Agenda Ms. Firehock said there was no consent agenda. She noted that the item SP202100016 CVEC Cash's Corner Substation was requested for deferral. She explained that the Commission did not need to vote on the request because the applicant was not the party making the request. She said the request was due to an advertising error, and the item would be deferred to the February 15, 2022 Planning Commission meeting. Public Hearing SP202100015 Midway — Martin's Store 115kV Transmission Line Mr. Scott Clark said the special -use permit was for a transmission line upgrade. He displayed a map showing the area. He explained that the transmission line started in the Midway area and ran southward. He said the proposal was to upgrade an existing electrical transmission line that had been in place for several decades for the Central Virginia Electric Cooperative (CVAEC). He said the proposal would replace aging wooden H poles that carried the transmission line, which were 60 to 70 feet in height, with single metal poles 70 to 90 feet in height. ALBEMARLE COUNTY PLANNING COMMISSION FINAL MINUTES - January 18, 2022 Mr. Clark said that this would be the first phase of upgrades running from Midway in the northern end to the Albemarle/Nelson boundary and onwards into Nelson as there was available funding for the utility. He said the poles would be replaced in the existing right-of-way. He said the first phase of the upgrade was in the same parcel for the Midway Solar special -use permit that was recently approved, though unrelated. He said the solar facility was intended to connect to local distribution lines. Mr. Clark said the image showed an example of what the right-of-way looked like. He said H poles were double wooden poles with a cross bar that carried the transmission line. He displayed a graphic that compared the H poles to the proposed replacement metal poles. He noted that the metals poles came with a natural oxidized finished so they would look similar to the wooden poles. Mr. Clark said that the proposal did not cause any substantial detriment to adjacent properties because the right-of-way did not change or expand. He noted that the right-of-way had been in place for about 40 years, so the proposal would not change the character of the area. He said that the proposal was a measure to increase reliability for a public utility to provide power to the area, and it was needed because the existing poles were degraded due to age. He said public utilities were in harmony with and supportive of the agricultural and residential uses in the district. Mr. Clark noted that there were relevant code subsections in Chapter 5.1.12, Public Utility Structures and Uses. He said some of the subsections did not apply because they related to buildings and structures. He explained that subsection C discussed removal of poles and other similar facilities. He said the existing poles would be removed as part of the replacement process. He explained that the current distribution lines and the local poles carrying lower voltage lines would be removed so that the distribution line could be hung from the transmission poles, reducing the total amount of facilities within the right-of-way. Mr. Clark explained that subsection D discussed minimizing new utility easements and river crossings, but there were no new river crossings in the proposal because it was in an existing right-of-way. He said there was one temporary stream crossing proposed that would cross with a bridge mat to allow equipment to cross, and there would be no disturbance in the stream itself. Mr. Clark said that replacing poles in the existing right-of-way avoided disturbing or fragmenting other parts of the landscape, and the impacts were limited to the temporary construction work. He said that the utility line upgrade would increase service reliability without increasing the physical impacts or widening the existing corridor. He said staff had one condition along with the recommendation for approval, that supporting structures for the transmission lines shall remain within the existing right-of-way easement. He said the condition was standard for the type of service pole upgrade. Ms. Firehock said the application was similar to other applications the Commission had processed in the past. Mr. Bivins asked if there would be opportunities provided for cellular service equipment to be placed on the new poles. He asked if the poles could be used to enhance cellular coverage in the County. Mr. Clark said he was not aware if the applicants planned co -locations on the facilities. He said the issue was not raised during review. ALBEMARLE COUNTY PLANNING COMMISSION 2 FINAL MINUTES - January 18, 2022 Ms. Firehock said she would remind the applicants to address Mr. Bivins' question. She asked if there were further questions for staff. She asked if the applicant had an application or wished to speak. Mr. Bruce Maurhoff, the COO for the CVAEC, said Mr. Chuck Ward was also in attendance. He said that Mr. Clark had represented the project well. He said that regarding Mr. Bivins' question about cellular service, none of the structures were designed to have cellular communication facilities attached. He continued that there was the possibility to modify the structures if an agreement with a cellular provider were established. Ms. Firehock clarified that the applicant did not have a presentation. She said the primary purpose of the project was to improve the performance and safety of the corridor and to improve reliability. Mr. Ward said that Ms. Firehock was correct Ms. Firehock said that the average tree -height in Virginia was 67 feet. She said that the increase in pole height would make them less susceptible to limbs hitting wires, and the poles were much stronger. She said she was prepared to make a motion if there were no further comments. Mr. Clayborne said he suspected many similar projects would come before the Commission. He said the proposal seemed like an obvious one to approve, and he wanted to know if there was an administrative process to streamline the approval of similar projects to reduce the workload. Mr. Clark said that a new administrative process would require a change to the zoning ordinance. He explained that the local distribution lines were by -right, and the transmission lines and transmission pipelines, just like substations, required a special -use permit. He noted that the transmission line pre -dated the zoning ordinance requirements for the type of facility but still required a special use permit to perform upgrades. Ms. Firehock said she was reminded of when the Commission had to grant approval for restaurants to install a drive -through window. She said that they created design guidance that could be used and approved if staff felt a proposal met those criteria, to streamline the process and reduce the amount of work. She asked that staff investigate administrative remedies to reduce the amount of work required to approve transmission line upgrades. Mr. Rapp said that staff could look into those administrative routes. He mentioned similar processes had been approved for restaurant drive-throughs and veterinary clinics. He explained that when there was an item before the Board or Commission that was frequently approved with the same conditions each time, it was a good candidate to have performance standards added to the zoning ordinance to allow for administrative approval. Ms. Firehock said she hoped to see similar projects in the future. Mr. Bivins mentioned that there was spotty cellular coverage in the area of the proposal. He encouraged the applicant to investigate the potential for partnerships with cellular companies to install cellular facilities on the transmission poles. Ms. Firehock said there were plans for other lines to co -locate service. She said the projects were years away because Nelson County was first for some of the improvements. Mr. Missel seconded the motion. The motion carried unanimously (6-0). Old Business/New Business Ms. Firehock said she had asked at the beginning of the year if any commissioners had travel plans to ensure a quorum at meetings. She said commissioners should email her if there were out-of-town trips scheduled. She said that she would review the days commissioners would be absent to ensure there were no conflicts. She said there would not be a Commission meeting on January 25 because there were no topics for the session. Ms. Firehock mentioned there was the option to hold Commission meetings every other Tuesday of the month instead of on the first 3 Tuesdays of the month. She said the work session day would be held prior to a Commission meeting instead of on the fourth Tuesday. She said she wanted to open the topic up for discussion. She asked Mr. Rapp to weigh in with his opinion. She said that the format was currently demanding on staff as they had late night work sessions with the Board and with the Commission. She wanted to know if there were alternate times that would be easier for everyone involved. Mr. Carrazana said if there was enough lead time for the work sessions, then the schedule could be managed, but if the work sessions became more sporadic, then it would be harder to manage. He wanted to know how early of notice the commissioners would receive for the meetings. Ms. Firehock said commissioners would likely receive similar notice to the notice they currently received for work sessions —typically six weeks, by the first of the month at the latest. Mr. Rapp said that staff attempted to release the schedule a month early. He said that the schedule was traditionally crafted with a public hearing, followed by a work session, followed by a public hearing, then followed by the fourth Tuesday of every month. He said that the Board had work sessions in the afternoon followed by public hearings, and the meetings were on the first and third Wednesday every month. He said that was nearly the same schedule for the Commission, and so it stacked work for the staff. He said the Commission could meet on the second and fourth week of every month and host the work sessions prior to the meetings in order to stagger the meetings with the Board. Mr. Bivins said he was in support of staggering the meeting schedules to balance the workload. He said that as the County prepared for the Comprehensive Plan, a lot of the material would be presented and discussed during a work session. He said the Commission would be better served to have a Comprehensive Plan discussion separate from the public hearings. Mr. Missel said he supported the change in meeting schedule. He said it was helpful to have a day set off every month for a potential work session. He asked if it was likely there would only be one work session a month. Mr. Rapp said there was typically one work session a month. He explained that sometimes there was not a full work session of material, so the meetings were canceled or loaded up. Mr. Missel asked if there could be more than one work session a month ALBEMARLE COUNTY PLANNING COMMISSION FINAL MINUTES - January 18, 2022 Mr. Rapp said he had never had more than one work session in a month, but if needed, it could be called. He said commissioners had a lot of meetings to attend and the meeting load was quite heavy. Mr. Missel said he was not suggesting extra work sessions. Ms. Firehock said there had been multiple weeks where she had meetings from Monday night through Thursday night for the Commission. She said the agenda would need to be balanced so that major items were not scheduled for the same night and overload the meeting. She said that the Commission did not need to meet for meeting's sake. She proposed that Mr. Rapp review the upcoming schedule and see if the suggested changes were possible. She said that the change in the schedule would not cause further delay to applications.
