farm with the farm of C.G.Yaphls, this right of way to be a joint right of
way for the benefit of the property hereby conveyed and the property retain
by Mrs. Mamie E.Baber.
Said party of the first part covenant that she has the right
to convey said land to the grantee; that she has done me act to.eacnmber
said land; that the grantee shall have quiet possession of said land, free
from all encumbrances; and that she will execute such further assurances of
title as may be requelte.

WHEREAS, Clarence H. Fox died, intestate, on December
22, 1981, leaving as his sole heirs at law, his widow, Alma S.

WHEREAS, at the time of his death, Clarence H. Fox was
seised and possessed of the following interests in real property
lying in Albemarle County, Virginia, being as follows:
NO. 1: Fee simple interest in a tract of land with
improvements thereon and appurtenances thereunto belonging, con-
sisting of 65 acres, more or less, having been conveyed to
Clarence H. Fox by two deeds; one conveying 25 acres from John
Paul Dollins, single, bearing date April 20, 1929, of record in
the Clerk's Office of the Circuit Court of said County in Deed
Book 204, page 473 and the other containing 40 acres, having
been conveyed to Clarence H. Fox by deed of Mamie E. Baber, widow,
bearing date January 1, 1927, in Deed Book 196, page 10 with
right of way as set forth therein.

October 26, 1959, of record in said Clerk's Office in Deed Book
355, page 297; and
WHEREAS, it is the desire and intent of the parties
hereto, they being the sole heirs at law of Clarence H. Fox, to
partition between themselves said real property in such manner
that Ellis T. Fox and Sons, a Virginia partnership, assignee of
Ellis T. Fox, will own fee simple title, subject to the herein-
after described reserved life estate, in the 65 acre parcel and
John T. Fox and Margaret C. Fox will own fee simple title in the
aforesaid 123.75 acre parcel;
NOW, THEREFORE, for and in consideration of the mutual
conveyances, promises and covenants contained herein and the
sum of FORTY FIVE THOUSAND DOLLARS ($45,000.00), cash in hand
paid, receipt of which is hereby acknowledged, paid to Betty Jean
Mawyer and William Blaine Mawyer for their respective interest
in the aforesaid parcels of real property, the parties of the
first part do hereby GRANT, BARGAIN, SELL and CONVEY with GENERAL
WARRANTY and ENGLISH COVENANTS of TITLE unto Ellis T. Fox and
Sons, a Virginia partnership, all that certain tract or parcel

in Deed Book 766 at Page 617.
There have been no new parcels created since the property was deeded in Deed Book 766 at Page
617. Said deed refers to the property as being conveyed by two deeds, one conveying 25 acres in
Deed Book 204 at page 473 and 40 acres in Deed Book 196 at page 10.
We believe that current Tax Map 84 Parcel 25 consists of 2 parcels.
