VWC/jcw ATTACHMENT Staff Person Ken Baker Planning Commission November 8, 1994 Review For Compliance With The Comprehensive Plan (15.1-456 Review): Albemarle County Service Authority (ACSA) Oak Knoll Subdivision Waterline Installation. As per Section 15.1-456 of the Code of Virginia the ACSA has requested the Planning Commission to review the installation of a water transmission line to serve the four existing structures in Oak Knoll Subdivision(Tax Map 59, Parcels 12F, 12F1, 12F2 and 12F4; 12 F3 does not have a structure). The subdivision is located in Ivy off of Route 250 (See Attachment A). BACKGROUND: In September of 1994, Lewis A. Martin requested the Board of Supervisors grant Jurisdictional Area designation for water only to existing structure(s). The request was for designation of one structure owned by the applicant and located on Tax Map 59-Parcel 12 Fl. The applicant stated that the existing well serving the house had dried up an attempt to dig a new well (400')had failed. Mr. Martin provided documentation to the Board of Supervisors from the well drilling company to validate his claim(See Attachment B-Staff Report). At its September 21, 1994 meeting,the Board of Supervisors considered whether or not to proceed to Public Hearing to consider the applicant's request for jurisdictional area designation. At that meeting, Mr. Bill Brent, Director of the Albemarle County Service Authority, stated that the groundwater in this vicinity is unreliable. Mr. Brent went on to state that within the past two decades wells have failed and public water service had to be provided to the nearby subdivisions of West Leigh, West Pines, and Kearsarge subdivisions as well as numerous other individual properties. Therefore, he concluded that "it would be shortsighted for the ACSA not to assume that public water will eventually have to be extended to the other three homes in the subdivision and that it would be more equitable to consider water service to all four homes in the Oak Knoll subdivision." The Board of Supervisors agreed with Mr. Brent and determined that it was reasonable to proceed to public hearing to consider Jurisdiction Area designation for water only to existing structures in the Oak Knoll Subdivision. At its October 12, 1994, the Board of Supervisors voted to amend the jurisdictional area boundaries of the Albemarle County Service Authority to extend water service only to existing structures in Oak Knoll Subdivision(See Attachment C-Staff Report). DISCUSSION The Oak Knoll Subdivision is not located in a Growth Area. The Comprehensive Plan states "only allow changes in jurisdictional areas outside designated Growth Area boundaries in cases where the property is (1) adjacent to existing lines; (2)public health or safety is endangered" (p. 146). The Board of Supervisors action was consistent with the Comprehensive Plan because the subdivision is located adjacent to a waterline along Route 250 West and at least one property in the subdivision has experienced water quantity problems. Furthermore, the Comprehensive Plan states that: (1) water and sewer service jurisdictional designation permits these services to be provided in a manner which can be supported by the utility's physical and financial capabilities, and(2) that jurisdictional areas are those portions of the County that can be served by water and sewer service (p. 146). RECOMMENDATION Staff believes that since the Oak Knoll Subdivision is within the ACSA jurisdictional area for water service only to existing structures and that no additional development will result from the extension of a waterline that this request is consistent with the intent of the Comprehensive Plan and recommends favorable action by the Planning Commission. Martin Jr., requests Jurisdictional Area designation for water only to existing structure(s) (See Attachments A and B). The request is for service to one unit located on Tax Map 59-12F1. The parcel is located in the Oak Knoll Subdivision approximately 500 feet south of Route 250 West in the Ivy area(See Attachments C and D). The applicant stated that the existing well servicing the house has dried up and an attempt to dig a new well (400') has failed (See Attachment B). The Albemarle County Service Authority indicates that a water line with adequate capacity exists along Route 250 West that can be extended south along Oak Knoll Drive to serve the subject property. DISCUSSION: The subject property is not within a Growth Area. The Comprehensive Plan states "only allow changes in jurisdictional areas outside of designated Growth Area boundaries in cases where the property is: (1) adjacent to existing lines; (2) public health or safety is endangered" (p. 146). Furthermore, the Comprehensive Plan warns that "such utilities are not to be extended to the Rural Areas as these services can increase development pressures" (p. 146). The property is not directly adjacent to the waterline; however, as mentioned earlier the house is only 500' from the existing waterline. There is one parcel between the subject property and the waterline along Route 250 (See Attachments C & D). The request appears to be most closely related to the second strategy listed above. Ivy is a former Growth Area and as such many nearby parcels are within the ACSA Jurisdictional Area. The parcel directly adjacent to the subject property to the west and the Greencroft Subdivision also located just west both have been designated for water only. The Kearsarge Subdivision located just east of the subject property also has a similar designation (See Attachment D). RECOMMENDATION: As a general policy, staff has advised that public utility capacities should be reserved to support development of designated growth areas. Past actions by the Board have typically been to limit utility service outside the designated growth areas. However, where properties have experienced quantity problems and are adjacent to existing lines, the Board has in certain circumstances granted jurisdictional area designation for water only to existing structures. Staff believes that the effect of amendment to the jurisdictional area on the intent of the Comprehensive Plan is minimal. No additional development will result from such change. Therefore, staff is recommending proceeding to public hearing to consider water only to existing structures for Tax Map 59, Parcel 12F1 based on the documented problems. At its September 21, 1994 meeting the Board set this public hearing to consider extending water service to all existing structures in the Oak Knoll subdivision based on the general groundwater problems in that area and the information provided by Mr. Brent in his September 19 , 1994 letter (attached) . DISCUSSION: The attached information from the prior staff report and Mr. Brent's i 'iptember 19 letter summarize the particulars of this consideration. At its _aptember 21 meeting, the Board determined that it was reasonable to proceed to public hearing for water service to all of Oak Knoll based on the following: (1) the problems with groundwater in the area which have lead to water service being granted to nearby subdivisions, and (2) the Albemarle County Service Authority's question of equitably funding connection of one property (the Martins) when the potential exists that other parcels in the subdivision will also eventually need water. RECOMMENDATION: _ In consideration of the particular groundwater conditions in this area and the previous allowance of water service to nearby subdivisions, staff can support amending the service area boundaries of the Albemarle County Service Authority to extend water service only to existing structures in Oak Knoll Subdivision (Tax Map 59, Parcels 12F, 12F1, 12F2 , and 12F4 ; 12F3 does not have a structure) . When this subdivision was developed in the mid-1980's the developer had planned to install public water to serve these lots but was unable to get the lots included in the jurisdictional area. The lots were then developed with wells. Groundwater in this vicinity is notoriously unreliable. Within the past two decades wells have failed and public water service had to be provided to West Leigh, West Pines, and Kearsarge subdivisions as well as numerous other individual properties. It appears Oak Knoll will be no exception. The Service Authority is now faced with the dilemma of justifying the expenditure of public funds to install a water main to serve recently developed property. I understand other property owners in Oak Knoll may be interested in water service because of concern about the reliability of their wells. It would be shortsighted for the Service Authority not to assume that public water will eventually have to be extended to the other lots and to not plan accordingly. I am sure you also recognize that limiting connections to this water main to one property lessens our ability to find an equitable basis for funding the project.
