County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is
approved/disap proved. The rationale is given in the comments below. The VSMP application
content requirements can be found in County Code section 17-401.
A- Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP
must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Just to confirm, this project wants its own DEQ permit, separate from others as shown
on the submitted registration statement?
2. Please provide updated Brookhill VAR permit coverage map, adding this area.
3. Please use the following SWPPP template:

a. Please note that the certification has been changed and the stamped plans will
be inserted at the back on the swppp when we approve the plans.
4. Registration statement and signed certification must be signed. This will have to be by
the operator once decided (not the County).
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. PPP plan view not provided. Please include in next submission in the plan set, a PPP only
sheet, and ensure everything from 17-404 is shown.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-
403.
1. Per County Code 17-412, this VSMP Plan cannot be approved until a preliminary plat is
approved.
2. Since the County is the property owner of this parcel, an agreement will be needed for
temporary access to construct the SWM facilities. This agreement will need to go before
the 130S.

3. The BOS will determine if they want the County to maintain the SWM facilities or have
or the HOA maintain them. If the HOA is responsible for maintenance, a maintenance
agreement and easement to the developer will be necessary.
4. If the County is to maintain, there may be additional comments or reviewers.
5. Was VIDOT contacted to see if use of their existing pond was possible?
6. Nutrient credits must be purchased before land disturbance permit can be issued. A letter
of availability must be provided before this WPO Plan can be approved. Please contact
Ana Kilmer [akilmer@albemarle.org 434-296-5832 ext. 3246] BEFORE purchasing credits.
7. Please provide the actual excel spreadsheet from Sheet 13.
8. Culvert cannot be installed until VIDOT has approved it. Please add a note on the plans or
provide VIDOT approval.
9. Provide a sheet flow analysis for runoff not captured in SWM per 9VAC25-870-66-
D.9VAC25-870-66.
10. The bottom of the proposed detention basin should be lower than the sediment trap to
ensure sediment is cleaned out.
11. Please clearly show the recorded forest and open space easement area from Blocks 9-11.
Label the area with the instrument number or DB/PG.
12. Please consider re -naming detention basin #4. There is already a pond #4 in Brookhill and
it may be confusing.
13. The minimum pipe under a public road is 15". Please increase the proposed 6" pipe.
14. Structure A3 should be a standard manhole to facilitate maintenance.
15. The proposed detention basin should have a safety bench.
16. Please have the proposed level spreader location staked out and schedule a site visit with
the County to confirm the location is suitable.
17. The conserved open space will need to be recorded in an easement to ensure protection
of the vegetated filter strip per 5.2. This will need County approval:

D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is approved/disapproved, and the reasons are provided in the comments below. The
erosion control plan content requirements can be found in County Code section 17-402.
1. [Cover sheet] Topography should be field verified within the past year.
2. [Sheet 2] Is this truly existing conditions? If some features are shown as an ultimate
condition of an approved plan, but are not currently existing, please note that on the
plans.
3. Ensure all applicable buffers are shown per the code of development 2.4.2 (Page 19).
4. [Sheet 3] Please check the years in the project description.
5. Please label the total area of disturbance/limits of clearing. The line is shown, but the
acreage is not listed.
6. Please add something similar to notes 6 & 7 from the sequence of construction to Sheet
4 on the plan view, so the contractor knows how/when to cross the stream to access the
other side of the site. Please define what is "enough fill material for crossing with earth
moving equipment".
7. Is this going to be a balanced site? If not, please note cut/fill amounts.

8. [Sheet 4] WP0202000004 must be amended to show the re-routed pipe as shown. A
new easement will also need to be recorded in the new location.
9. [Sheet 4] Please specify the size and type of rip -rap for the "proposed rip -rap at
transition".
10. [Sheet 4] Is anything draining to ST #3 in Phase I?

13. [Sheet 7] Sediment Trap #3 should be sized for 1.47 (Phase 111) aces not 1.43 acres (Phase
11).
14. [Sheet 7] Wet storage in Sediment Trap #3 appears to be deeper than 4 ft., which is the
maximum per VESCH 3.13, excavation, and Plate 3.13-2.
15. Baffles appear to be necessary on all traps. According to VESCH 3.13, the storage area
should have a minimum 2:1 length to width ratio (measured from point of maximum
runoff introduction to outlet).
16. Per VESCH 3.05, silt fence should be located 5 feet to 7 feet beyond the base of
disturbed slopes.
17. Per 5.2 of this, please show the filter strip on the E&S Plan:

The VSMP permit application and all plans may be resubmitted for approval when all comments
have been satisfactorily addressed. For re -submittals please provide 2 copies of the complete
permit package with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a
meeting to discuss this review.
Process:
After approval, erosion and sediment control and stormwater management improvements must
be bonded. The bonding process begins when the plan is approved, and the applicant submits a
bond estimate request form and fee to the Department of Community Development. A plan
reviewer will prepare estimates and check parcel and easement information based on the
approved plans. The County's Management Analyst will prepare bond agreement forms, which
will need to be completed by the owner and submitted along with cash, certificates or sureties
for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and
forms.

Stormwater Management Facilities Maintenance agreements will also need to be completed and
recorded. The County's Management Analyst or other staff will prepare the forms and check for
ownership and signature information. The completed forms will need to be submitted to the
County, who will record the agreement.
After bonding and agreements are complete, county staff enters project information in a DEQ
database for state application processing, if a DEQ permit is required. DEQ reviews the
application information based on local VSMP authority approval. At this time, the DEQ portion of
the application fees will need to be paid directly to the state. For fastest processing, this is done
electronically with the emails provided on the application. DEQ should notify applicants with
instructions on how to pay fees. When DEQ approves the application, they will issue a permit
coverage letter, which must be posted at the construction site.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction
conference. Applicants must complete the request for a pre -construction conference form and
pay the remainder of the application fee. The form identifies the contractor and responsible land
disturber, and the fee remaining to be paid. This will be checked by county staff, and upon
approval, a pre -construction conference will be scheduled with the County inspector. At the pre -
construction conference, should everything proceed satisfactorily, a joint VSMP and grading
permit will be issued by the County so that work may begin.
