We are completing design and will be advertising the urban water extension to serve the subdivision. Several parcels are currently being served by the community well that are not in the amended jurisdiction. Planning is preparing the appropriate request to include these lots. In addition to the above, in 1971 the Randolph's sold 33 acres to Alcova for inclusion in Key West (DB 497, Page 218) . The residue of 15.39 acres was later subdivided into 5 lots now being the same as TM 62, Parcels 49D, 49D1, 49D2, 49D3 and 49D4 (see the highlighted tax map) . Written in the agreement between Randolph and Alcova was the responsibility. . . "to construct a water line to bring water to (within 200 feet of the boundary) said point and to cause Key Commercial, Inc. , owner of the Key West water system, to permit said parties of the second part to have unlimited rights to tap on said water line at current rates. " Since the agreement does not grant this to "successors or assigns" will we have any obligation to provide this in the future? Enclosed are the applicable documents for your review. Virginia, containing 33 acres, more or less, more parti- cularly described in said deed; and ( WHEREAS part of the consideration for said conveyance in accordance with the contract of sale is the covenant herein- after set forth, t " NOW THEREFORE in consideration of the premises and $10 and other valuable consideration, said party of the first part for • itself and its successors in title hereby agrees with the parties of the second part that on or before September 20, 1975 it will dedicate a public road acceptable to the State of Virginia leading to the southern boundary of said 33 acre tract, which southern boundary is the northern boundary of other lands belonging to the parties of the second part.
