The last comment letter, dated July Ste 2019, indicated that the plan was basically ready for approval, pending confirmation that the proffer items had been addressed. CE met with Albemarle County and VDOT in August 2019 and discussed the completion of the project. In that meeting, it was deemed that the transportation proffers were not completely addressed until all VDOT approvals had been obtained. This included the VDOT approvals for the shop drawings associated with the entrance culvert and the retaining wall along Route 29. CE worked with VDOT over the past 3 years (during the pandemic) to obtain final approvals on the shop drawings for the North Pointe infrastructure associated with the road plan, site plan, and Route 29 entrance improvement plan. Attached is the letter from VDOT with the approval for these shop drawing designs. CE is resubmitting the final site plan for approval, addressing the comments below from the final review letter, dated July St', 2019. Planning 1. Comment previously addressed 2. North Pointe SDP2018-45-RequestforSubstitution ofRequiredRecreationa/Amenities Please consider this request to allow substitution of the recreation facilities specified in section 18- 4.16 of the Zoning Ordinance. Per the approved rezoning plan, the North Pointe density on this property is 184 townhouse units for the Northern residential development area of North Pointe. The required amenities, as listed below, includes (4) tot lots and (1) full basketball court The rezoning plan for the entire North Pointe development did not contemplate any active recreational areas or tot lot areas within this section of the overall project With the close proximity of these townhouse units to the proposed elementary school property, the active recreational elements can be accommodated for this townhouse development with the playgrounds and fields within the elementary school property. In addition, this section of the North Pointe Development is platting and dedicating approximately 16.23 acres of floodplain, Greenway, and trail area to Albemarle County as a recreational area for the benefit of the overall development and Albemarle County. Access easements to this area will also be platted, allowing public access to the Greenway and recreational area within this development Required Amenities The following summarizes the required amenities per the ordinance: Required Recreation area: 200 s.f. x 184 units = 36,800 s.f. or 0.85 ac Four (4) tot lots required, each to include: • 1 swing with 4 seats • 1 buckabout or whirl • 1 slide • 2 benches • 2 climbers (1) Full Basketball Court: Y2 court/100 units x 184 units =1 full or 2 half courts required ProposedAmenitiesr Land dedication to Albemarle County Greenway, Floodplain area, and trail area dedicated to Albemarle County along with access easements to this property through the townhouse development TOTAL AREA PROWDED: 16.23 acres Please consider this land dedication and proximity to the proposed elementary school site as a substitution for the required recreational amenities per the Albemarle County zoning regulations. The Greenway, floodplain, and trail area will be a public amenity to everyone within the development and also available to the residents of Albemarle County. In addition, the homeowners will have pedestrian access to the proposed Elementary school for active recreation. Re: North Pointe — Route 29 Improvements Plan (Lewis & Clark Drive) SUB-2016-00196 Review #7 Dear Mr. Wentland: The Department of Transportation, Charlottesville Residency Transportation and Land Use Section, as well as the Culpeper District Traffic Engineering and Location & Design Sections, have reviewed the above referenced plan as submitted by Collins Engineering, revised 26 April 2019, and finds it to be generally acceptable. Note that although the plans are approved, a permit will not be issued until the Culpeper District Structure & Bridge Section approves the plans for the proposed retaining wall and box culvert. Comments concerning these items have been provided in previous review letters. Also note that inventoried structures such as the proposed Lewis & Clark box culvert with utilities crossings will not be approved unless a maintenance agreement with the County of Albemarle is obtained in order to offset relocation of utility costs associated with maintenance of the culvert. The VSMP plan will need to be approved before the road plans can be approved. (Rev. 1) Response noted. (Rev. 3) The V SMP has not yet been approved. 2. The plan cannot be approved until VDOT has approved the hydrologic/hydraulic computations for the stream crossing [SP2006-34, Condition #2]. Comments have not yet been received from Planning. ACSA, Fire Rescue and ARB currently have no objection to the plans. VDOT comments were emailed on 6/18/19. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process; After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need Engineering Review Comments Page 2 of 2 to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. After bonding and agreements are complete, county staff will need to enter project information in a DEQ database for state application processing. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that work may begin.
