The interface between Belvedere 5B and the Dunlora Farms VSMP plans will require agreement
between the two parties in regards to permission for access and responsibilities and measures during
construction. This letter shall serve as agreement between Belvedere Long Holdings, LLC (Owner,
Belvedere SB), Greenwood Homes —Charlottesville, LLC (Developer, Belvedere 5B) and Town District,
LLC (Owner, Dunlora Farms).
For construction for either Belvedere or Dunlora Farms, the entities signed below agree that:
1. The contractor listed as the Registered Land Distruber (RLD) for either project will have
permission for access to grade on the other property as shown on the approved site plan;
2. The County ESC inspection team will have permission for access as well;
3. The Belvedere developer and contractor listed as RLD will have responsibility on the Dunlora
Farms property inclusive but limited to the following:
a. Keep Belvedere Phase 5 SWPPP current, Including grading activity and contractor -
performed ESC inspections on Dunlora Farm property;
b. An expectation that final fill slope required to extend Fowler Drive is to be built
consistent with 18.4.3.3 design requirements;
c. An expectation to remedy any failure to meet 18-4.3.3 standards, and remedy any
failure of ESC measures, promptly;
d. An expectation that final grade be stabilized per approved WPO202000034 typical final
stabilization requirements;
e. All measures required to prevent and limit erosion in areas required to be graded to
construct Fowler Street will be deployed prior to land disturbance, maintained during
land disturbance, and removed upon final stabilization with county inspector approval;
f. All fill on Dunlora Farms will b structural, tested and certified as well as stabilized upon
completion.
A display of the grading impact of Belvedere SB grading on the Dunlora Farms property is attached and
signed by both developers.

To Whom It May Concern —
The Owner and Developer of Belvedere Phase 5 (TMP 62-1601i have been pro: Aeda Deed cf P,elease
for the utility and access easement across the Dunlora Farms property WAP 62-16A). this letter shall
serve as agreement between Belvedere Long Holdings, LLC (Owner, Belvedere 511), Greenwood Homes —
Charlottesville, LLC (Developer, Belvedere SB) and Town District, LLC (Owner, Dunlora Farms).
The Owner and Developer of Belvedere 5B will sign the Deed of Release for the Dunlora Farms property
upon approval of the plat for Phase 58. At that point, the access and utility easement across TMP 62-
16A is no longer of use to Belvedere and the release of this claim would unencumber the development
of Dunlora Farm.
The copy of the Deed of Release is attached.
