Yes, that addresses the question. SO now we just need to get this scheduled for a BOS meeting date on the consent
agenda. For consent agenda items, we still ask applicants to appear at the meeting just in case the Board decided to
discuss the item. I don't expect that to happen in this case, but it is best if you or someone else appears just in case.
It looks like we could take this to the BOS on their November 2 meeting. Does that date work for you? If so, I will put
in the agenda item request. The BOS meetings start at 1 PM, and the consent agenda usually is acted on around
1:30-1:45 PM. Let me know if that time poses any conflicts with your schedule and we can look at another date.

The applicable Zoning Ordinance standard for parking for this use is as follows: Wholesaling or warehousing use
not otherwise identified: one space per employee plus one space per each 500 square feet of floor area open to
the public for customer parking, but in all cases a minimum of two customer parking spaces.

agenda. For consent agenda items, we still ask applicants to appear at the meeting just in case the Board decided to
discuss the item. I don't expect that to happen in this case, but it is best if you or someone else appears just in case.
It looks like we could take this to the BOS on their November 2 meeting. Does that date work for you? If so, I will put
in the agenda item request. The BOS meetings start at 1 PM, and the consent agenda usually is acted on around 1:30-
1:45 PM. Let me know if that time poses any conflicts with your schedule and we can look at another date.

A Zoning Clearance is required for any change of use like this. Please submit a Zoning Clearance along with the
Special Exception (SE) application. There is no need to include an SE number on the SE application as we do not
know that number yet (the one typed in is incorrect), and we don't know the Clearance number either. You can
note that it is for a Zoning Clearance application.
Please note on the Zoning Clearance how many employees will be there so that we know parking can work for the
site before we move forward with any SE application. You can also include that in your narrative/justification for
the SE.
I would say that it more than likely will be able to be on the consent agenda, but without reviewing the submitted
application, we will not know if this will go on consent or not. The Board of Supervisors must act on the application
within 90 days of the application being complete and paid for. We will do our best to get it on the earliest agenda

General Notes:
-Goodwill operated in the current Oreilly Auto building on the adjacent property for over a decade and this building
is virtually the same size. Even though this operation will be storage/warehouse/distribution versus retail, this
building will appear very similar to what they had next door.
-The ownership (myself and partners) for this property owns the 4 Goodwill Retail Stores in the area so there is
continuity and understanding for how the overall Goodwill operation works in Albemarle County.
-This Albemarle area is their number 1 area for donations and retail store volumes (out of 40 counties) and thus is
absolutely critical to their mission. This former Rexel building will enable them to better serve the Albemarle and
surrounding community. Over 90% of the monies received from their retail stores goes back into their mission of
helping local citizens with a variety of challenges achieve independence.

Francis- after reading the below clause in the ordinance, would this be applicable here?:
"The zoning administrator, after consultation with the director of planning and other appropriate officials,
may permit, as a use by right, a use not specifically permitted; provided that such use shall be similar to
uses permitted by right in general character, and more specifically, similar in terms of locational
requirements, operational characteristics, visual impact and traffic generation."
My thought is that the defining characteristics are high visibility and ease of access, thus a use like this
would not work in what would be considered a conventional warehouse/light industrial location. As far as
being similar to permitted by right uses, this building will be virtually indistinguishable from a regular
Goodwill operation in terms of appearance, traffic flow, etc. And please note a Goodwill store with a
similar sized warehouse building (9,000sf) operated on the adjacent property (now an Oreillys Auto store)
for over 10 years.

Yes, they would need a Zoning Clearance after the SE is approved. Zoning has no issue other than verifying the number
of employees so that the parking can be verified onsite. I think it is, but it would not hurt to ask them how many
employees there are for this calculation and the existing parking onsite. I know property lines have changed with the
recent development behind this site.
Wholesaling or warehousing use not otherwise identified _one space per employee plus one space per each 500 square
feet of floor area open to the public for customer parking, but in all cases a minimum of two customer parking spaces.

narrative that was submitted with the SE, it asks for an LZC for the use of the building beyond the 4,000 sq.ft. limitation
for storage/warehousing/distribution uses established by the HC District. It looks like they are just trying to occupy the
entire footprint of the existing building, and no expansion of the structure is proposed.
I know that the LZC would come after approval of the SE. I guess my real question is, does Zoning have any issues with

-This Albemarle area is their number 1 area for donations and retail store volumes (out of 40 counties) and thus is
absolutely critical to their mission. This former Rexel building will enable them to better serve the Albemarle and
surrounding community. Over 90% of the monies received from their retail stores goes back into their mission of
helping local citizens with a variety of challenges achieve independence.

use not specifically permitted." It sounds like a Zoning Clearance and Special Exception (SE) would be the way to
proceed. An SE can take up to 90 days to get on the Board of Supervisor's agenda. If staff can support the
modification, it can go on their consent agenda, which means no hearing/discussion from the Board. That said,

Francis- after reading the below clause in the ordinance, would this be applicable here?:
"The zoning administrator, after consultation with the director of planning and other appropriate officials,
may permit, as a use by right, a use not specifically permitted; provided that such use shall be similar to
uses permitted by right in general character, and more specifically, similar in terms of locational
requirements, operational characteristics, visual impact and traffic generation."
My thought is that the defining characteristics are high visibility and ease of access, thus a use like this
would not work in what would be considered a conventional warehouse/light industrial location. As far as
being similar to permitted by right uses, this building will be virtually indistinguishable from a regular
Goodwill operation in terms of appearance, traffic flow, etc. And please note a Goodwill store with a similar
sized warehouse building (9,000sf) operated on the adjacent property (now an Oreillys Auto store) for over
10 years.

Thanks for forwarding me the email from Mr. Wray. Side note — do you need to review the SE materials? In the
narrative that was submitted with the SE, it asks for an LZC for the use of the building beyond the 4,000 sq.ft. limitation
for storage/warehousing/distribution uses established by the HC District. It looks like they are just trying to occupy the
entire footprint of the existing building, and no expansion of the structure is proposed.
I know that the LZC would come after approval of the SE. I guess my real question is, does Zoning have any issues with
allowing them to occupy the entire 7,200 sq.ft. structure for storage/warehousing/distribution?

-The ownership (myself and partners) for this property owns the 4 Goodwill Retail Stores in the area so there is
continuity and understanding for how the overall Goodwill operation works in Albemarle County.
-This Albemarle area is their number 1 area for donations and retail store volumes (out of 40 counties) and thus is
absolutely critical to their mission. This former Rexel building will enable them to better serve the Albemarle and
surrounding community. Over 90% of the monies received from their retail stores goes back into their mission of
helping local citizens with a variety of challenges achieve independence.

It would not, as we have a use already defined in the ordinance. That clause is for when someone proposes "a
use not specifically permitted." It sounds like a Zoning Clearance and Special Exception (SE) would be the way to

Francis- after reading the below clause in the ordinance, would this be applicable here?:
"The zoning administrator, after consultation with the director of planning and other appropriate officials,
may permit, as a use by right, a use not specifically permitted; provided that such use shall be similar to
uses permitted by right in general character, and more specifically, similar in terms of locational
requirements, operational characteristics, visual impact and traffic generation."
My thought is that the defining characteristics are high visibility and ease of access, thus a use like this
would not work in what would be considered a conventional warehouse/light industrial location. As far as
being similar to permitted by right uses, this building will be virtually indistinguishable from a regular
Goodwill operation in terms of appearance, traffic flow, etc. And please note a Goodwill store with a similar
sized warehouse building (9,000sf) operated on the adjacent property (now an Oreillys Auto store) for over
10 years.

It would not, as we have a use already defined in the ordinance. That clause is for when someone proposes "a
use not specifically permitted." It sounds like a Zoning Clearance and Special Exception (SE) would be the way to
proceed. An SE can take up to 90 days to get on the Board of Supervisor's agenda. If staff can support the
modification, it can go on their consent agenda, which means no hearing/discussion from the Board. That said,
the Board can pull any item on the consent agenda and discuss it before they act.

Francis- after reading the below clause in the ordinance, would this be applicable here?:
"The zoning administrator, after consultation with the director of planning and other appropriate officials,
may permit, as a use by right, a use not specifically permitted; provided that such use shall be similar to
uses permitted by right in general character, and more specifically, similar in terms of locational
requirements, operational characteristics, visual impact and traffic generation."
My thought is that the defining characteristics are high visibility and ease of access, thus a use like this
would not work in what would be considered a conventional warehouse/light industrial location. As far as
being similar to permitted by right uses, this building will be virtually indistinguishable from a regular
Goodwill operation in terms of appearance, traffic flow, etc. And please note a Goodwill store with a similar
sized warehouse building (9,000sf) operated on the adjacent property (now an Oreillys Auto store) for over
10 years.

Having retail requires more parking than just a warehouse use. Without looking a the site closer, I do not know
if the site has clearly marked parking spaces. An evaluation of the parking is needed for either the 4000sgft for
warehousing or the entire 7200sgft with retail space.
Retail parking requirement
One space per each 100 square feet of retail sales area for the first 5,000 square feet and one space per each
200 square feet of retail sales area above 5,000 square feet. For purposes of this paragraph, "retail sales area"
shall be deemed to be: (1) 80 percent of the gross floor area; or (2) at the request of the applicant, the actual
retail sales floor area as shown on floor plans submitted by the applicant delineating the actual retail sales area,
which plans shall be binding as to the maximum retail sales area used.
Warehousing parking requirement
One space per employee plus one space per each 500 square feet of floor area open to the public for customer
parking, but in all cases a minimum of two customer parking spaces.

Hi Margaret. I hope all is well. Per my voicemail this morning, my partners and I own the 4 Goodwill locations
in Albemarle County (Ruckersville, Rte 29, Avon, and Lake Monticello). Albemarle County is their No. 1 most
successful locality in their entire 40 county territory. We are buying the Pantops Flow Mazda Property (see
attached) and want to let them use the middle building (1311 Stony Pt. Road on attached) for customer
donations and sorting. Donations are the lifeblood of their entire operation and mission. This 7200sf building is
the former Rexel Electronics building and is perfect for them to receive, sort, store, and then send product out
