Box 148 North Garden, VA 22959 434-293-2583 [14-302 (A)(4); 14-302 (A)(5); 14-302 (A)(15); 14-3141 Please provide more information on the existing 'recreation easement' that is proposed to be vacated. Is this a public or private easement? Staff review of recorded instruments did not identify a previously recorded deed that explains who owns the rights to this easement, what its purpose is, etc. Please be aware that if this is a public easement, Board of Supervisors approval of the proposed vacation may be required prior to plat approval. This recreation easement was created by plat recorded in DB 816-745 with the creation of Parcel B. It is private in nature and for the benefit of Parcel B (TMP 132-18C) to enjoy the river. Since TMP 132-18C is being combined with other land that includes river frontage, current owners of the easement, the Johnsons, wish to vacate it. 2. [14-302 (A)(7)] Please clarify which TMP Area "A" will be apart of. Additionally, what TMP will the southeastern portion of that same area will be apart of? Please add the appropriate labels. I believe Area "A" to be clearly noted as being removed from TMP 132-18 and being added to TMP 132-18B in the area summaries on sheet 2 of this plat. The SW portion of land you speak of is already part of TMP 132-18 and included in its area. Please note the links showing how these parcels are connected. 3. [14-302 (A)(15)] The names and addresses of each owner of record and holders of any easements affecting the property. Please add another label for TMP 132-18A at the northwest portion of the plat. This label already exists in the NW portion of sheet 2 of the plat but I'll add another one to satisfy comments. 4. [14-302 (13)(1)] Please add a date of last revision once the edits are complete. I will add a date of revision to these two sheets of the plat and return to you once you are satisfied with these other comments. [14-303 (D)] According to Albemarle County GIS Data, TMP 132-18 is 25.60 acres and TMP 132- 18C is 5.13 acres. Please verify this and correct the acreage totals where appropriate on Sheet 2. TMP 132-18 is shown on the record plat (DB 1847-507) as containing 25.60 acres which I assume the County uses for GIS and tax assessments. This record plat however clearly states that this 25.60 acres includes the R.O.W. for S.R. 602 which was conveyed to the Commonwealth by deed in DB 363-296. My BLA plat correctly removes the area within this 40' R.O.W from the 25.60 total. TMP 132-18C was resurveyed by me for the purpose of this BLA plat and its acreage (5.28 ac.) is correct. 6. [14-303 (H)] Please add a legend to label what "OHE" represents. I will add this label to the legend.
