Dear Ms. Thomas,
I am enclosing the documents we discussed in our telephone conversation on May 16, 1997.
The first page is a copy of the notification letter dated October 4, 1984 sent to William Brent.
The amendment approved by the board on October 3, 1984, granted sewer service to lots 2,3,
and 4 which are adjacent to lot 5 (for which we are now requesting service).
The second page shows the water and sewer jurisdiction for section 60. I have highlighted the
Terrell lots currently receiving service as well as our lot #5.
The third page is a diagram of the sewer pipeline in the Old Forge Road and Terrell
neighborhood. Lot # 5 has been highlighted.
Please read paragraph #9 in the Declaration for Terrell Subdivision, which I delivered to your
office on April 16, 1997, as it explains the easement agreement between the county and the
homeowners.
If you have any questions or comments please telephone. I would appreciate it if you would
inform me of the time and location of your recommendation to the board of supervisors.

DECLARATION
FOR
TERRELL SUBDIVISION
888 Corp. is owner and developer of the property situated
on Georgetown Road in the City of Charlottesville , Virginia , more
particularly described on plat of Wm. Morris Foster, dated May
16 , 1980 , last revised May 20 , 1982 , entitled ' Subdivision Plat
Showing Lots 1-29, Terrell' , which plat is of record in the
Clerk' s Office of the Circuit Court of Albemarle County in Deed
Book 744 , page 598 , and does hereby declare that all of the
property shown on such plat, except Lot 6 thereon , shall be bound
by the following provisions and covenants, which shall be
covenants running with the land and binding upon all of such •
Lots:
1 . There shall he an Environmental Preservation Board
consisting of three persons, with the initial board consisting
of R. E. Lee , Jr. , and David C. Lee and Gary C. McGee. In the
event of death, resignation, or withdrawal for any reason of any
of such members, the two remaining members shall elect a person
to replace such withdrawing member.
2. The Environmental Preservation Board shall regulate the
appearance ,• use, location and maintenance of the properties and
improvements thereon in such a manner so as to preserve and
enhance the values , to maintain a harmonious relationship among
structures and the natural vegetation and topography , to preserve
the woodland character , and to conserve existing natural
amenities and ecologically sensitive areas .

3. All improvements , alterations , repairs, excavation ,
changes in grade , clearing , major landscaping or other work which
in any way alters any property from its natural or improved state
existing on the date such property was first conveyed by 888
Corp. shall be made or done only with the prior approval of the
Environmental Preservation Board.
4. No tree which is not dead or diseased and is larger than
six inches in diameter measured four feet above ground level
shall be killed , cut or removed unless it is located within ten
feet of a main dwelling exterior wall , is located within five
feet of other improvements such as garage , driveway, pool , 'or
tennis court, or is located within a septic field , without the
prior approval of the Environmental Preservation Board.
5. Each owner shall keep all lots owned by him and all
improvements therein or 'thereon free of trash and other forms
of debris and in good order and repair. The Environmental
Preservation Board shall , after reasonable notice to the owners ,
have the right to enter upon any lot to correct any violation
of this section.
6. No dwelling costing less than $100 , 000 . 00 based upon cost
levels prevailing on the date these covenants are recorded shall
be erected or maintained on any lot. The plans for such dwelling
shall not be approved either expressly or by presumption unless
the dwelling has at least 1800 square feet of gross finished
floor area , not including basements, garages , porches , decks or
patios.

7. Wherever this Declaration calls for approval by the
Environmental Preservation Board, written plans or a request for
approval shall be filed with such board. If no written response
has been made by the board within sixty days from the date of
receipt of such filing , such plans or requests shall be
considered approved , if they are in accord with the above minimum
requirements and the provisions of this Declaration. .
8. No building shall be located nearer than one hundred feet
to a lot line fronting on a street. In the case of lots
adjoining more than one street, the front lot line shall be the
one with the shortest distance along a street. No building shall
be located nearer than fifty feet to any other lot line adjoining
(7 other property in Terrell Subdivision, including interior
streets. The Environmental Preservation Board may grant
exceptions to the setback requirements where necessary for the
purpose of preserving natural vegetation or because of existing
topography.
9. There is hereby reserved a permanent easement along- all
lot lines for the purpose of laying and carrying utilities ,
including water, electric, telephone , gas or sewer lines and also
including cable for the transmission of television or other
electronic signals. Such easements shall be ten feet in width
along all lot lines bordering on streets or property outside of
Terrell Subdivision and shall be five feet in width along all
lot lines adjoining other lots within- Terrell Subdivision . There

Corp. unless said lot is subdivided for the sole purpose of
increasing the area of an adjoining lot and not for the purpose
of creating an additional building site.
11. No noxious or unreasonable noises or activities
constituting a nuisance shall be carried on or created upon any

12. Lots 15 , 16 , 17 , 22 and 23 shall be bound by and subject
to the provisions of the Lake Maintenance Agreement for Terrell
Subdivision , a copy' of which is attached hereto as Schedule 1
and incorporated herein by reference.
