The Planner for the Planning Services Division of the Albemarle County Department of Community Development
will recommend approval of the plan referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
1. [14-302(A)4; 14-303(E)] Revise the name of the new easement to a "new 30' private street easement" This
travelway is being approved as a private street.
2. [14-302(A)15] Provide an address for each owner of the property.
3. [14-302(B)1] Provide the date of the last revision of the plat on all future submittals.
4. [14-302(B)10] There appears to be a WPO stream buffer on this property. Depict this stream buffer on the plat.
Also, include the following note on the cover sheet: "The stream buffer(s) shown hereon shall be managed in
accordance with the Albemarle County Water Protection Ordinance."
5. [14-303(E)] Include a note on the cover sheet of the plat that maintenance of the private street shall be by the
owners of the lots affected by the private street, not by the Virginia Department of Transportation or the County
of Albemarle.
6. [14-303(N)] Include the following note on the cover sheet of the plat:
UNLESS SPECIFICALLY DENOTED AS PUBLIC, THE STREETS AND OTHER REQUIRED IMPROVEMENTS IN THIS SUBDIVISION ARE
PRIVATE IN NATURE AND WALL NOT BE MAINTAINED BY EITHER THE VIRGINIA DEPARTMENT OF TRANSPORTATION OR ANY OTHER
PUBLIC AGENCY. THE MAINTENANCE THEREOF IS THE MUTUAL OBLIGATION OF THE AFFECTED LOT OWNERS. FAILURE TO
MAINTAIN THE IMPROVEMENTS IN SUBSTANTIALLY THE SAME CONDITION AS ORIGINALLY APPROVED BY THE COUNTY MAY
CONSTITUTE A VIOLATION OF COUNTY ORDINANCE(S)
7. [14-308.1] Because the lots in this subdivision are less than 21 acres, a Tier 2 Groundwater Assessment is required.
The County performs this assessment. However, the fee of $406.64 must be paid.
8. [14-309;14-310] Because one of the lots in this subdivision is less than five acres, review by the Health Department
is required. Provide soil reports for review by the Health Department to determine the feasibility of drainfields on
the property.
