Tax Map 32A,Section 38, Parcels 18 and 19 are not in the Service Authority's jurisdictional area. As such you will need to petition the Board of Supervisors to be included for this service. Application needs to be made through the Albemarle County Department of Planning&Community Development. A sanitary sewer is approximately 500 feet from your building site. A digital orthophoto with utilities shown is included for your use. You indicated an interest lo serving parcel 18 as well as 19. Since these are separate parcels they cannot share laterals. If approved for service you will need to obtain separate easements and force mains to the public manhole in Forest Lakes. I desire to obtain sewer service from the Albemarle County Service Authority. The Albemarle County Service Authority sewer line currently exists at a higher elevation approx 50 yards. from this property, across RT 649 ( Proffit Road) serving Forest Lakes North residences. I understand that to obtain this service, I would have to obtain right of ways, install a grinder pump, and install the sewer line, including crossing under Rt. 649. I further desire that this installation would also provide the sewer service for the lot I currently own adjacent to the subject lot, which is on a septic system and where water is supplied by Albemarle County Service Authority( account 0721455520). CONSENT AGENDA: ACTION: STAFF CONTACT(S):Messrs.Benish,Cilimberg, INFORMATION: Foley,Tucker ATTACHMENTS: Yes BACKGROUND: The applicant is requesting Jurisdictional Area designation for water service to a parcel(Tax Map 62, Parcel 24A)located on the west side of Route 20 and the east side of Dorrier Drive,just north of Darden Towe Park. The property is located within Urban Area Three(Pantops).The applicant is requesting water service due to contamination of the existing well on-site. DISCUSSION: The subject property is located in the Urban Area Neighborhood Three. The Comprehensive Plan provides the following concerning the provision of water and sewer service to the Development Areas: "General Principle:Urban Areas,Communities,and Villages are to be served by public water and sewer(p. 109)." "Provide water and sewer service only to areas within the ACSA Jurisdictional Areas(p. 125)." "Follow the boundaries of the designated Development Areas in delineating Jurisdictional Areas (p.125)." RECOMMENDATION: As a general policy,staff has advised that public utility capacity should be reserved to support development of designated Development Areas. This request is consistent with public utility policy of the Comprehensive Plan. Since this property is located within the designated Development Area the provision of both water and sewer service to the property would be consistent with the Comprehensive Plan public utility policy.Therefore,staff recommends proceeding to public hearing to consider providing water and sewer service to Tax Map 62,Parcel 24A. COUNTY OF ALBEMARLE EXECUTIVE SUMMARY AGENDA TITLE:Policy for properties split by water/sewer AGENDA DATE: ITEM NUMBER: jurisdictional area designations October 7, 1998 SUBJECT/PROPOSAL/REQUEST:. ACTION: INFORMATION: Board discussion to establish direction/policy on"partial" jurisdictional area designation for certain parcels. CONSENT AGENDA: STAFF CONTACT(S2: ACTION:INFORMATION: Messrs.Tucker,Cilimberg,Benish ATTACHMENTS: Yes REVIEWED BY: BACKGROUND: Questions have recently been raised regarding the interpretation of jurisdictional area designations that are located on only a portion of a particular parcel("splits" a property). The main question is if only a portion of the property is designated for service, is the service limited to the specific area designated or can the service be extended to any part of the parcel?The Albemarle County Service Authority(ACSA) has on at least two occasions determined that it could serve structures/uses that were located beyond the area of the parcel designated for service. However, the Board of Supervisors has never made a determination, or established a policy, addressing this type of situation. The County Attorney has indicated that such a determination is the responsibility of the Board of Supervisors and not the Service Authority. DISCUSSION: The interpretation of partial designation raises several questions. Specifically,are utility services available to the entire property,or only that portion designated for service? If the property owner wishes to provide service to another portion of the property instead of within the area designated,is that permitted or would an amendment to the jurisdictional area be necessary?If the area of the property within the jurisdictional area is too small to support a building site under the property's zoning,can service be extended to area outside the jurisdictional area or is an amendment required? The County staff and Service Authority need direction from the Board in interpreting these situations. Staff estimates that there are over 30 parcels with a partial (split)jurisdictional area designation and where the extent of service has not been limited by a specific Board action (with the granting of the jurisdictional area designation). Some of these parcels (8) straddle Development Area boundaries and the jurisdictional area designations correspond to those boundaries. Other"split"parcels were based on the old Growth Area boundaries of the previous Comprehensive Plans (Scottsville). Many of these properties appear to have been included in the jurisdictional area in 1982 and 1983 amendments to the jurisdictional area maps, or are a result of subsequent subdivision of those parcels. However, there is limited information specific to these properties and the reasons for the split designation. It should be noted that properties are not normally split under current practice. Whole parcels are included on the maps and any limitations on service approved by the Board for that property are noted in a text supplement to the jurisdictional area maps. The intent of the jurisdictional area process has been to provide service to those areas where the County wants to encourage new development to locate (Development Areas) and, conversely, limit service in those areas where development is discouraged (Rural Area) to address various goals and objectives of the Comprehensive Plan(water supply watershed protection and other resource protection purposes,and efficiencies in service delivery). Provision of water and sewer service has long been considered a major factor that can increase development pressures. Therefore, the County's policy has been to allow service in the Rural Area only in cases where there is a public health or safety issue and where the property is adjacent to an existing line(see attached). Based on these policies which have evolved over time, it is clear that in the case of the properties in the rural area, the jurisdictional area designation has never been intended to provide more opportunity for development than what can occur under the current zoning of the property. Based on the intent of the current policies already established, staff is of the opinion that for these split properties water and/or sewer service should be available to only that area designated for service on the jurisdictional area maps (unless otherwise limited by a specific Board action). Before service can be provided outside the jurisdictional area portion of the property, the normal Jurisdictional Area Amendment request would need to be submitted to the Board for their consideration and approval. This would include any intention to run a private line from that part of the parcel that is in the jurisdictional area to that part of the parcel that is out. The Board would then review that request based on goals, objectives and strategies of the Land Use Plan, the existing and proposed policies(provided below), as well as the unique circumstances of the particular request. RECOMMENDATION: In order to provide clear understanding of how these split properties are to be treated,staff recommends that the Board adopt the following policy clarifying the intent of jurisdictional area designations that are located on only a portion of a parcel. • For parcels with jurisdictional area designation on a portion,but not all,of the property and for which no other Board action describes availability of service to the parcel,water and/or sewer service shall be provided only to a structure(s)located substantially within the area included within the jurisdictional area.
