This was submitted as a Rural Subdivision, however it doesn't not meet the requirements of a Rural Subdivision, and I believe that you meant to submit this as a Family Subdivision. I have attached the Family Subdivision application to be filled out and submitted. I have also attached the Family Division Affidavit form that will need to be filled out and submitted as well. Also, we have not cashed the check yet for this, so when you submit the new application, if you could pay the correct fee and we will return the other check to you. In order to assure that the development right is retained, revise the plat to sustain the minimum required for the zoning and the minimum required to maintain the additional development right (2 acres and 4 acres). Dear Ms. Yaniglos: On February 6, 2013, the County of Albemarle requested the Virginia Department of Health (via the Albemarle County Health Department) review the proposed subdivision plat identified above. This letter is to inform you that the above referenced subdivision plat is approved for individual Onsite Sewage Systems in accordance with the provisions of the Code of Virginia, the Sewage Handling and Disposal Regulations, and local ordinances. This request for subdivision review was submitted pursuant to the provisions of § 32.1 -163.5 of the Code of Virginia which requires the Health Department to accept private soil evaluations and designs from an Authorized Onsite Soil Evaluator (AOSE) or a Professional Engineer working in consultation with an AOSE for residential development. This subdivision was certified as being in compliance with the Board of Health's Regulations by: Thomas C. Hogge; Onsite Soil Evaluator Number 1940001091. This subdivision approval is issued in reliance upon that certification. Pursuant to § 360 of the Regulations this approval is not an assurance that Sewage Disposal System Construction Permits will be issued for any lot in the subdivision identified above unless that lot is specifically identified on the above referenced plat as having an approved site for an onsite sewage disposal system, and unless all conditions and circumstances are present at the time of application for a permit as are present at the time of this approval. We are trying to take a proactive role in the progress of our house completion. We were told that we would be in our new home by January /February, so we packed our children up and moved in with my mother -in -law at Thanksgiving. As you know we have a long way to go and are past February. My daughter graduates from high school in May so we are hoping that we can have her live in her new home for a little while before she goes off to college. I anticipate he will have that document reviewed sometime late next week, but he is not on my schedule, rather he has his own workload /schedule. Notably, I will be out of the office starting at noon on Monday and will be out all of next week and won't be back in the office till the 15 of April. Being that Ms. Kennedy will be on vacation the following week I would advise you to have her sign and notarize the second page of the Declaration which was recently submitted, while this has not yet received approval by the County Attorney, I'm hopeful that it will be, or if it needs any adjustments or corrections that they will be contained on page 1. Since the signature will be on sheet 2, I'm hopefully we can just slip sheet it, pending the County Attorney's review. Please speak with your legal team as to this as a potential solution.
