Does the County Attorney's office need to review this item, if so, see the attached draft? In the past (reference the 10 -17 -12 email from you about Whitewood Road Daycare, a similar situation) it is not the County Attorney who needs to review this deed but VDOT. See the attached deed and easement which was for a similar sight distance situation in which the owner of the property "dedicated the easement to Public use" for required VDOT right of way...etc Neither the County nor VDOT was referenced as the easement holders in the deed or plat; rather, it was given from the grantor (individual property owner) to the grantee (owner of the development)...thus neither VDOT nor the County is responsible for it, but the easement still exists. We need further clarification. Unfortunately, we are mightily confused on this issue and we need to determine how to proceed and we will do so. First, County says it's an easement dedicated to VDOT.
