Subject: SUB 2013 -00014 Charlottesville - Albemarle Airport - BLA
The County of Albemarle Planning Division will grant or recommend approval of the boundary line adjustment
plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)(4)] Private Easements. It appears that this boundary line adjustment removes access for TMP
32 -8 to the existing private right -of -way (Crickenberger Lane). It also appears that the driveway for TMP 32-
8 crosses Parcel 'A'. A private easement should be extended across Parcel 'A' to provide access to Parcel
8 unless some other easement exists that isn't shown on the plat.
2. [14- 302(A)(10)] Right of further division of proposed lots. The plat shall contain the following note: "Parcel
[letter or number] is assigned [number] development rights and may /may not be further divided. The residue
of Tax Map /Parcel [numbers] is retaining [number] development rights ". This boundary line adjustment is a
bit of an odd situation with the Airport parcel being Zoned RA, so for this submittal you can modify the
standard note to say something like, 'No development rights are transferred with this boundary line
adjustment; TMP 32 -8 retains X development rights and may /may not be further divided'.
3. [14- 302(A)(11)] Instrument creating property proposed for subdivision. Please add the most recent deed
reference for the Airport property, DB 3640 PG 191.
4. [14- 302(B)(2)] Name of the plat preparer. Please add the name and seal of the plat preparer.

Ellie,
Following up on a voicemail I just left you, I represent the Charlottesville Albemarle Airport Authority, and
I'm trying to help them close several property acquisitions necessary for their runway protection zone.
You issued comments on a proposed boundary line adjustment plat (see attached), and we had some
questions regarding comment 1.
As you can see, there is an existing right -of -way (Crickenberger Lane) through the property. The Airport's
intent has always been to grant an easement along the existing road to the adjacent property owner,
essentially preserving the status quo. Preservation of the status quo is important since the FAA may not
allow any "expanded" use within the runway protection zone.
Accordingly, would it be acceptable to you and satisfy comment one if the plat were revised to label the
existing gravel drive as such, but also as a new easement in favor of Virginia Land? Please let me know,
and feel free to call me with any questions or comments. We would like to resubmit the plat for final
approval as soon as possible. Thank you!

recommend showing the exact location of the easement with corresponding boundary information.

Note #7 looks good. The easement is the right idea, but it looks like it scales at 40' instead of 20'...am I missing
